Privacidad Digital En Ecuador: El Papel De La Vigilancia, La Jurisprudencia Y Los Derechos Humanos, Giselle Valdez
Independent Study Project (ISP) Collection
Systems Of Crime And Castigation: A Reevaluation Of The Punishment Bureaucracy, Lia Pikus
Systems Of Crime And Castigation: A Reevaluation Of The Punishment Bureaucracy, Lia Pikus
Independent Study Project (ISP) Collection
Models of reform within the criminal justice system often operate from a top-down perspective, affecting change on surface levels to attempt to better the system. One example of such a reform is Scotland’s Presumption Against Short Sentences. These kinds of changes, as I will illustrate in this paper, both fall short of achieving genuine change and often produce negative side effects. However, a few countries have made deeper changes to the ways their systems both view and handle crime and punishment; one such system is Norway. Through rehabilitation and restorative justice, Norway has greatly decreased rates of recidivism, increased social …
Uncertainty In Employee Status Across Federal Law, Ryan Vacca
Uncertainty In Employee Status Across Federal Law, Ryan Vacca
Faculty Publications
Numerous federal statutes rely on a distinction between employees and independent contractors. Based on a series of Supreme Court decisions from 1968 through 2003, courts and administrative agencies have used a common law multifactor test to draw this distinction. In an effort to enhance predictability and certainty within and across legislation, these cases have rejected a purposive approach in applying the test. But the Supreme Court has never said which, if any, of the factors are the most important in the analysis, nor has anyone determined whether the underlying purpose-enhancing predictability and certainty-has been attained.
This empirical study uses content …
Responsible Devolution Of Affordable Housing, Andrea Boyack
Responsible Devolution Of Affordable Housing, Andrea Boyack
Faculty Publications
The federal government has been heavily involved in promoting housing affordability since the 1930s and continues to have a critical role to play. Over the past several decades, the federal government has financed affordability by promoting development and income subsidies, but specific allocation decisions have devolved. Housing inequities can best be addressed locally, but only if localities are held to high standards of fairness and regional coordination is facilitated. Successful and sustainable local solutions to housing affordability will also require a substantial financial investment, one that the federal government can and should reliably and adequately provide. Each year, Congress permits …

It's Scandalous! - Limiting Profane Trademark Registrations After Tam And Brunetti, Gary Myers
Faculty Publications
Over the course of the last two years, the Supreme Court has engaged in a long-overdue assessment of the constitutionality of federal trademark law prohibitions on the registration of offensive marks. In its unanimous 2017 decision in Mata/ v. Tam, the Court held that the disparagement clause is a content-based provision that violates the First Amendment. In 2019, the Court in Iancu v. Brunetti held that the refusal to register the mark "FUCT" on grounds that it was immoral or scandalous would also violate the First Amendment. These cases offered an opportunity for the Court to clarify the proper role …
The Role Of Local Communities In Preventing And Countering Violent Extremism (P/Cve) In Jordan, Anna Fraher Klingensmith
The Role Of Local Communities In Preventing And Countering Violent Extremism (P/Cve) In Jordan, Anna Fraher Klingensmith
Independent Study Project (ISP) Collection
Bordering Syria, Iraq, Saudi Arabia, and Israel/Palestine, with Lebanon not too far away, Jordan’s location makes it at high risk for violent extremism. Although Jordan is considered one of the safest countries in the Middle East and North Africa (MENA) region, the country is known for having one of the highest numbers of foreign fighters in the world, and for being the homeland of the father of ISIS (Abu Musab al-Zarqawi). Also worrisome is the increasing number of desperate people turning to extremist ideologies due to the country’s economic crisis and lack of opportunities for political engagement. Jordan could be …
Not-So-Decriminalized: Consequences Of Intersectional Identity For Migrant Sex Workers In Switzerland, Teagan Langseth-Depaolis
Not-So-Decriminalized: Consequences Of Intersectional Identity For Migrant Sex Workers In Switzerland, Teagan Langseth-Depaolis
Independent Study Project (ISP) Collection
Sex work in Switzerland, which was decriminalized long ago, has been regarded as one of the most liberal systems of sex work in the world. However, this reputation is contested when factoring in the interaction between immigration and sex work policies. Migrant sex workers in Switzerland are put at a precarious intersection of decriminalized sex industry and restrictive migration policy and attitudes, and are not addressed or protected from violations of the law or violations of their human rights. Using databases containing Swiss legislation, I will critically examine the intersectional effects of migration policy and the treatment of migrants on …

Shadow, Light And Darkness: Bankruptcy's Business In-Fact And Business In-Law Justification Test Under Sec. 363(B), Kenneth D. Ferguson
Faculty Works
In this article, Professor Ferguson addresses the problem of business debtors who avoid the reorganization process of Chapter 11 bankruptcy by instead selling their business under Bankruptcy Code § 363. There is concern that the sales are not producing the best and highest values. Professor Ferguson proposes a two part business in-fact and business in-law process that he believes will produce fairer and more optimal results.

Handcuffing The Vote: Diluting Minority Voting Power Through Prison Gerrymandering And Felon Disenfranchisement, Rebecca Harrison Stevens, Meagan Taylor Harding, Joaquin Gonzalez, Emily Eby

For the purposes of legislative redistricting, Texas counts prison populations at the address of the prison in which they are incarcerated at the time of the census, rather than their home prior to incarceration—regardless of whether the prisoners themselves maintain a residence in their home communities and intend to return home after incarceration. This deprives those home communities of full representation in the redistricting process. Combined with Texas’s felon disenfranchisement laws, this also results in arbitrarily bolstering the representational power of some Texans on the backs of other Texans who themselves are unable to vote. All of this takes place …

Assessing The Efficacy Of The Bayh-Dole Act Through The Lens Of University Technology Transfer Offices (Ttos), David Orozco
Assessing The Efficacy Of The Bayh-Dole Act Through The Lens Of University Technology Transfer Offices (Ttos), David Orozco
North Carolina Journal of Law & Technology
Universities are unique environments that thrive on the research and curiosity of faculty and students. To disseminate knowledge and potentially derive lucrative sources of funding, universities have aggressively entered the field of technology commercialization and patenting. The passage of the Bayh-Dole Act was instrumental to encourage this activity and the result has been an explosion of university-related patenting. This activity comes at a social cost, however, since patents restrict knowledge transfers and may create deadweight losses. These costs are amplified if technology transfer office (TTO) activities are viewed from a narrow financial or cost-benefit viewpoint. As demonstrated in this study, …

Agricultural Investments: A Primer For Host Government Lawyers And Local Lawyers In Private Practice, Tehtena Mebratu-Tsegaye
Columbia Center on Sustainable Investment Staff Publications
Attracting investment in agriculture has been a key policy goal of governments in the global south. Development partners have supported these policies. But what do governments hope to achieve by attracting investment in the agricultural sector? Why are companies interested in investing? What is in it for local communities? And what is the role of lawyers? This primer provides an introduction to some of the key issues that arise in the negotiation of contracts linked to investments in agriculture, and practical guidance for how to approach common issues. Section 1 of this primer outlines the typical goals of three important …

We understand that the ALI Council will consider Council Draft 3 (CD3) of the Restatement of the Law, Copyright (Copyright Restatement) project at its meeting on October 17-18, 2019. The Council may not appreciate how controversial a project this is: the U.S. Copyright Office, the U.S. Patent and Trademark Office, the American Bar Association’s Section of Intellectual Property Law, the New York City Bar Association’s Committee on Copyright and Literary Property, academics and other Advisers and Liaisons have expressed serious concerns about this and previous Council Drafts and Preliminary Drafts; indeed, the Register of Copyrights deplored the project as a …

Out Of The Quandary: Personal Jurisdiction Over Absent Class Member Claims Explained, A. Benjamin Spencer
Faculty Publications
Since the Supreme Court's decision in Bristol-Myers Squibb Co. v. Superior Court of California, San Francisco County, litigants and lower courts have wrestled with the issue of whether a federal court must be able to exercise personal jurisdiction with respect to each of the claims asserted by absent class members in a class action and, if so, what standard governs that jurisdictional determination. This issue is rapidly coming to a head and is poised for inevitable resolution by the Supreme Court in the near future; multiple circuit courts have heard appeals from district courts that have reached varying conclusions on …

Murr V. Wisconsin And The Inherent Limits Of Regulatory Takings, Lynda L. Butler
Faculty Publications
This article examines the confusion surrounding constitutional protection of property under the substantive due process and takings clauses, using Murr as a springboard for reconsidering the substantive due process/takings distinction and asking whether the regulatory takings doctrine should remain a viable constitutional concept despite its muddled principles. While powerful reasons support treating as compensable economic regulations that are functionally equivalent to physical takings, important differences between physical and regulatory takings need to be recognized as limits to the degree of equivalence possible and therefore to the regulatory takings doctrine. A look back at the evolutionary paths of substantive due process, …

Data has taken immense importance in the last years. Consider the amount of data that is being collected worldwide every day, industries are reshaping their activities into a data-driven business. The digital transformation of all industries, portent of the fourth industrial revolution, is creating a new kind of economy based on the datafication of almost any aspect of human social, political and economic activity as a result of the information generated by the numerous daily routines of digitally connected individuals and technology. The financial services industry is part of this trend. Embracing the digital revolution and creating the right foundations …
