Separating The Wheat From The Chaff: Delimiting Public Policy Influence On The Arbitrability Of Disputes In Africa, Akinwumi Olawuyi Ogunranti
Articles, Book Chapters, & Popular Press
This article focuses on the arbitrability of disputes. It examines the recent global trend of delimiting the role of public policy in determining matters that should be subject to arbitration. The evaluation shows that the application of doctrines of separability and kompetenz-kompentenz plays a vital role in the delimitation process. However, notwithstanding the global trend to restrict the role of public policy in determining arbitrability, some countries in Africa still widely interpret public policy to revoke arbitral clause, stay arbitral proceedings, or refuse enforcement of foreign arbitral awards. They justify this approach on the basis that public policy is a …

Cloudy With A Chance Of Taxation, Orly Mazur, Rifat Azam
Cloudy With A Chance Of Taxation, Orly Mazur, Rifat Azam
Faculty Journal Articles and Book Chapters
The growth of the digital economy, and, in particular, cloud computing, has put a significant strain on sales taxation and other consumption tax systems. The borderless, anonymous, and digital nature of cloud computing raises questions about the paradigm used to determine the character of the transaction and the location where consumption, and therefore, taxation occurs. From an American perspective, the effective resolution of these issues continues to grow in importance in light of the recent U.S. Supreme Court decision in South Dakota v. Wayfair and the growing number of U.S. businesses transacting overseas in jurisdictions that impose value-added taxes (VATs). …
Penile Polygraphy: The Admissibility Of Penile-Plethysmograph Results At Sentencing In Tennessee, Steven Poland
Penile Polygraphy: The Admissibility Of Penile-Plethysmograph Results At Sentencing In Tennessee, Steven Poland
Vanderbilt Law Review
State judges in Tennessee currently consider the results of penile plethysmograph ("PPG") evaluations when sentencing convicted sex offenders. These highly intrusive physical tests purport to identify whether an offender's arousal is considered "deviant" by measuring the change in penis size after viewing various stimuli. Because the results are usually buried in psychosexual evaluations that are part of general presentence assessments of recidivism risk, PPG evaluations suffer from a lack of standardization and little attention under the rules of evidence. Interestingly, PPG testing is similar to polygraphy in a number of ways, although studies have shown that PPG results are more …

The Single-Subject Rule: A State Constitutional Dilemma, Richard Briffault
The Single-Subject Rule: A State Constitutional Dilemma, Richard Briffault
Faculty Scholarship
Critics of the proliferation of omnibus legislation in Congress have pointed to the constitutions of the American states as providing an alternative, and potentially superior, model for lawmaking. Forty-three state constitutions include some sort of “single-subject” rule, that is, the requirement that each act of the legislature be limited to a single subject. Many of these provisions date back to the second quarter of the nineteenth century, and, collectively, they have been the subject of literally thousands of court decisions. Nor is the rule a relic from a bygone era; one recent study found the rule at stake in 102 …
New York Environmental Legislation In 2018, Michael B. Gerrard, Edward Mctiernan
New York Environmental Legislation In 2018, Michael B. Gerrard, Edward Mctiernan
Faculty Scholarship
In 2018, New York State enacted a Drug Take Back Act in response to environmental and public health concerns about improper disposal of unused drugs. Another enactment gave the Department of Health (DOH) greater discretion in enforcement actions against landlords that do not take adequate action to abate lead paint. Other new laws tinkered with legislation enacted in 2017 to protect drinking water and to promote clean energy and energy storage. In addition, Governor Andrew M. Cuomo signed laws concerning farmland and pollinator protection. In New York City, a Styrofoam ban went into effect on Jan. 1 after courts rejected …

Scientific reports, coming in a steady stream, are highlighting the urgency of reducing greenhouse gas emissions so as to avoid the worst impacts of climate change. Already, hurricanes, coastal and inland flooding, wildfires, heat waves and other extreme weather events are causing severe economic damage and loss of life, and their increasing severity has been attributed to climate change. The decades to come promise to be even worse.

Richard Gardner and I were colleagues for almost sixty years. The law faculty elevated us to its tenured ranks at the same meeting in 1959. We helped restore order after Columbia’s 1968 turmoil, he as a member of a disciplinary tribunal, I as chairman of the Executive Committee of the Faculty. We served under eight deans together; he
actually served under a ninth: me.
What Can We Learn From Stock Prices? Cash Flow, Risk And Shareholder Welfare, Joshua Mitts
What Can We Learn From Stock Prices? Cash Flow, Risk And Shareholder Welfare, Joshua Mitts
Faculty Scholarship
Price is expected cash flows discounted at the risk-free rate plus an additional discount for risk exposure. Price equivalency does not always imply welfare equivalency: shareholders are not necessarily indifferent between a price increase of $1 from higher cash flows and the same $1 increase from lower risk exposure. Even in complete markets, if managers enjoy private benefits of control, the social planner may prefer lower risk exposure to a price-equivalent increase in firm value from greater investor protection. This has implications for event studies, the trade-off between principal costs and agency costs, and the link between macroeconomic risk and …

What's Wrong With Jumpstart(Ing) Our Business Startups (Jobs) Act?, Lynnise E. Pantin
Faculty Scholarship
Lack of access to financial capital is a barrier for many entrepreneurs who seek to grow their business venture. In an effort to democratize the entrepreneurial ecosystem, Congress and the Obama Administration enacted the JOBS Act, which implements and regulates crowdfunding. The democratic nature of the online crowdfunding platforms is a seemingly attractive solution to structural and institutionalized barriers to fundraising within the entrepreneurship ecosystem. Although the JOBS Act is a laudable step, the legislation does not in practice help entrepreneurs and herein lies one of its greatest shortcomings. The JOBS Act is unduly burdensome and is yet another barrier …
Using Shifts In Deployment And Operations To Test For Racial Bias In Police Stops, John M. Macdonald, Jeffrey A. Fagan
Using Shifts In Deployment And Operations To Test For Racial Bias In Police Stops, John M. Macdonald, Jeffrey A. Fagan
Faculty Scholarship
In this paper, we exploit a policy experiment in the New York Police Department (NYPD) to test for bias in police stops. The NYPD launched Operation Impact in 2003 to change the scale of officer deployments. High crime areas were designated as “impact zones” and saturated with recent police academy graduates. These officers were encouraged to stop, question, and frisk (SQF) crime suspects as part of the NYPD’s overall crime-reduction strategy (MacDonald, Fagan, and Geller 2016). We focus on the expansion of impact zones in Brooklyn and Queens in July 2007. We use geographic data on the boundaries of the …
Fair And Impartial Adjudication, Thomas W. Merrill
Fair And Impartial Adjudication, Thomas W. Merrill
Faculty Scholarship
Any legal system that purports to respect the rule of law must ensure the fair and impartial adjudication of disputes under the law. Classic accounts of the rule of law assume that courts should resolve such disputes. However, this is too narrow. All forms of adjudication, not just by courts, need to be fair and impartial. In any event, no one could claim that courts or entities by that name are always fair and impartial. All legal systems need a guarantee of fair and impartial adjudication that applies to all forms of dispute resolution under law.
A dispute arising under …
Choice Of Law In Takings Cases, Thomas W. Merrill
Choice Of Law In Takings Cases, Thomas W. Merrill
Faculty Scholarship
This Article considers what law should apply in resolving subsidiary questions that arise in the course of deciding takings cases under federal constitutional law. It argues that there are three choices: federal constitutional law, state law, or a federal-patterning definition that lays down certain general parameters as a matter of federal constitutional law but otherwise follows state law if it is consistent with these parameters. The article illustrates these choices by considering a recent Supreme Court decision, Murr v. Wisconsin, which held that the horizontal dimensions of a “parcel of land” should be determined, for takings purposes, as a …
The Confrontation Right, Richard D. Friedman
The Confrontation Right, Richard D. Friedman
Book Chapters
This chapter examines the right of criminal defendants to be confronted with the witnesses against them. It first provides an overview of the nature, purposes, and costs of the confrontation right before discussing the history of the confrontation right. It then considers a range of issues that may arise in any jurisdiction (or in some cases, any common law jurisdiction) with regard to the confrontation right, using as a touchstone the current status of the right in the United States. In particular, it describes situations in which the question of whether a statement is testimonial typically arises, such as fresh …
The Architecture Of Property, Thomas W. Merrill, Henry E. Smith
The Architecture Of Property, Thomas W. Merrill, Henry E. Smith
Faculty Scholarship
Avoiding the reduction of property to a bundle or rights or to the working out of a single master principle, the architectural theory of property sees property as an integrated system or structure anchored in certain unifying principles. Because our world is neither chaotic nor additiviely simple, property law and institutions must achieve their plural ends in a fashion that manages the inherent complexity of the interaction of valued resource attributes and human actions. In managing complexity, some of the law’s structures receive functional explanations and justifications, which can be different from the explanations and justifications that apply to the …
Hardball And/As Anti-Hardball, David E. Pozen
Hardball And/As Anti-Hardball, David E. Pozen
Faculty Scholarship
Talk of constitutional hardball is in the air. Ever since Brett Kavanaugh’s confirmation to the Supreme Court, liberal commentators have been pondering tactics such as impeachment, jurisdiction stripping, and especially “packing the court” to a degree that would have been unthinkable a few years ago. Senate Republicans have played vigorous hardball on Supreme Court appointments in the past two Congresses, most obviously by refusing to consider Merrick Garland’s nomination, and there is a strong desire among many Democrats to respond with equal or greater vigor.

Migration is a phenomenon wherein individuals relocate from one country to another, albeit temporarily or permanently, for numerous reasons. The State of Qatar is a highly diverse nation with a large population of foreign residents. According to Priya D’Souza, as of 2017, 60 percent of the resident population in Qatar are from South Asia. Growing up in this environment, third culture kids develop a unique, hybrid culture through experiencing multiple cultures. This research investigates a dichotomy of belonging from the perspective of South Asians in Qatar. A series of hybridized spinning tops were produced in collaboration with a South Asian …
Exploring The Intersection Of Designing For Crime And The Future Of The Public Forum, Kathryn M. Benedict
Exploring The Intersection Of Designing For Crime And The Future Of The Public Forum, Kathryn M. Benedict
Theses and Dissertations
As more public spaces are under the influence of private stakeholders in cities, it is important to consider the role, both financial and social, that these stakeholders have on the design of the physical space and the users of the space. This analysis will utilize a qualitative methodological approach to understand the contested redevelopment of a public park in Richmond, Virginia as it transitioned from a city-owned space to a public-private partnership. By gaining a better understanding of the major spheres of influence involved in the redevelopment, namely the large public university and the corporations adjacent to the space, it …
