Prenatal Drug Exposure As Aggravated Circumstances, Frank E. Vandervort Nov 2019

Prenatal Drug Exposure As Aggravated Circumstances, Frank E. Vandervort

Articles

In Michigan, "a child has a legal right to begin life with sound mind and body." Yet the family court may not assert Juvenile Code jurisdiction until after birth. In re Baby X addressed the question of whether a parent's prenatal conduct may form the basis for jurisdiction upon birth. It held that a mother's drug use during pregnancy is neglect, allowing the court to assert jurisdiction immediately upon the child's birth. In deciding Baby X, the Court specifically reserved the question of whether parental drug use during pregnancy might be sufficient to permanently deprive a parent of custody. …

Liability For Data Scraping Prohibitions Under The Refusal To Deal Doctrine: An Incremental Step Toward More Robust Sherman Act Enforcement, Ioannis Drivas Nov 2019

Liability For Data Scraping Prohibitions Under The Refusal To Deal Doctrine: An Incremental Step Toward More Robust Sherman Act Enforcement, Ioannis Drivas

University of Chicago Law Review

The digital economy has become increasingly consolidated in recent years as a handful of companies (namely Google, Facebook, Microsoft, and Amazon) have come to dominate every corner of the internet. Several of these companies have attained such size and influence that labelling them monopolists seems unavoidable. These companies have reinvigorated the debate regarding how antitrust law should treat monopolists. Many scholars, typically associated with the Chicago School of antitrust, believe that courts should hesitate before taking action against internet monopolists because judicial intervention may discourage investment in the digital economy without benefiting consumers. Critics of the Chicago School meanwhile argue …

Settlement Malpractice, Michael Moffitt Nov 2019

Settlement Malpractice, Michael Moffitt

University of Chicago Law Review

Lawyers routinely settle lawsuits or advise their clients about settlement. One might expect, therefore, that clients routinely complain about some aspect of their lawyers’ settlement services. Ten years of data from eleven jurisdictions paint a vivid, different picture: although the vast majority of civil lawsuits are resolved through negotiated settlements and although complaints against lawyers are common, fewer than 1 percent of reported legal malpractice cases and only about 1.5 percent of bar complaints relate in any way to lawyers’ settlement-related conduct or advice. Even in those instances when clients do raise such complaints, clients rarely prevail. In short, even …

Reviewing Presidential Orders, Lisa Manheim, Kathryn A. Watts Nov 2019

Reviewing Presidential Orders, Lisa Manheim, Kathryn A. Watts

University of Chicago Law Review

Beginning with President Ronald Reagan, presidents of both political parties increasingly have relied on executive orders and other unilateral written directives as a means of exerting significant control over agencies’ policymaking activities. Nevertheless, no coherent or well-theorized legal framework exists to guide courts as they review presidential orders. In contrast, a robust body of administrative law principles—rooted largely in the Administrative Procedure Act (APA)—exists to guide courts in their review of agency action, including agency action that is heavily influenced by the president. Until recently, this gap in the legal framework did not prove particularly problematic because litigants generally waited …

New Report Surveys Extent Of Religious Liberty Activism On The Left, Law, Rights, And Religion Project

Center for Gender & Sexuality Law

New York, New York — A report released today from the Law, Rights, and Religion Project at Columbia Law School offers a sweeping account of religious liberty activism undertaken by social justice and humanitarian movements while demonstrating how right-wing activists have fought for conservative Christian hegemony rather than religious liberty for all. It thus challenges the leading popular narrative of religious freedom.

Our planet faces unprecedented threats, including irreversible global warming, loss in biodiversity, and water pollution and water scarcity. The impacts of these environmental crises also threaten human rights and exacerbate inequality. Slowing these worsening environmental trends – and addressing the impacts of environmental change on populations – will require cumulative policy responses at the national and international level.

The Best Laid Plans: How Administrative Burden Complicates Voting Rights Restoration Law And Policy, Jennifer L. Selin Nov 2019

The Best Laid Plans: How Administrative Burden Complicates Voting Rights Restoration Law And Policy, Jennifer L. Selin

Missouri Law Review

Despite significant literature on the electoral and democratic implications of laws that restore the right to vote to individuals with felony convictions, few scholars have explored whether these reforms result in practical changes. This Article examines the effect of administrative capacity and individual experience on policy implementation and finds that, even in the face of de jure felon rights restoration, policymakers can (knowingly or unwittingly) alter de facto restoration. Specifically, states have limited administrative capacity to absorb the costs of rights restoration. As a result, the burden of restoration falls onto citizens. Facing learning, compliance, and psychological hurdles to the …

New Tricks For An Old Dog: Deterring The Vote Through Confusion In Felon Disenfranchisement, Emily Rong Zhang Nov 2019

New Tricks For An Old Dog: Deterring The Vote Through Confusion In Felon Disenfranchisement, Emily Rong Zhang

Missouri Law Review

Felon disenfranchisement laws do not just disenfranchise. They also confuse. By imposing heavy penalties for failing to correctly navigate complex provisions, these statutes confuse eligible voters and discourage them from exercising their right to vote. In this way, felon disenfranchisement laws resemble modern voter suppression laws: they deter eligible voters from voting. Modest reforms can and should be implemented to affirmatively inform formerly incarcerated individuals of their restored voting rights.

Post-Denial Strategies: How To Get From "No" To "Yes", Diane M. Butler, Leslie K. Dellon, David Isaacson, Stephen W. Yale-Loehr

Cornell Law Faculty Publications

U.S. Citizenship and Immigration Services (USCIS) seems to be denying more petitions than ever these days. Cases that were solid approvals a few years ago now are receiving denials, even though the law and regulations have not changed. But don’t give up hope. Opportunities exist to overcome denials.

This practice advisory focuses on post-denial strategies for petitions filed with USCIS, not strategies in immigration court. The article discusses motions to reopen, motions for reconsideration, appeals to the USCIS Administrative Appeals Office (AAO), and litigation. This practice advisory also discusses when filing a new petition may be a better option, and …

Felon Disfranchisement In Missouri: 1821–1970, Pippa Holloway Nov 2019

Felon Disfranchisement In Missouri: 1821–1970, Pippa Holloway

Missouri Law Review

In Missouri, individuals who have committed a felony offense cannot vote until they have completed their prison sentence and any probation or parole. There are areas of both continuity and change over the two centuries since Missouri’s first constitution allowed the legislature to limit the suffrage rights of those convicted of infamous crimes. In pre-Civil War Missouri, the concept of infamy was a part of legal culture, as was the case in other states. Infamy connected the degradation of criminal activity and criminal punishment with the loss of citizenship rights and thus provided the intellectual foundation for felon disfranchisement. In …

The Uncertain Future Of Felon Disenfranchisement, Bruce E. Cain, Brett Parker Nov 2019

The Uncertain Future Of Felon Disenfranchisement, Bruce E. Cain, Brett Parker

Missouri Law Review

Felons represent a large majority of disenfranchised adult Americans, with a significant proportion remaining unable to vote even after completing the entirety of their sentences. As voter eligibility requirements become an increasingly contested partisan battlefield, the fate of these disenfranchised individuals has become increasingly unclear. With this backdrop in mind, we consider recent developments in felon disenfranchisement, the prospects for future legislative action, and the legal arguments that litigants might employ to challenge the practice. In so doing, we exploit newly collected polling data to determine (1) whether Americans are ready to end felon disenfranchisement, and (2) under what circumstances …

The Federalist Regulation Of Privacy: The Happy Incidents Of State Regulatory Activity And Costs Of Preemptive Federal Action, Henry Adams Nov 2019

The Federalist Regulation Of Privacy: The Happy Incidents Of State Regulatory Activity And Costs Of Preemptive Federal Action, Henry Adams

Missouri Law Review

The impact of society’s digital integration is difficult to articulate. It suffices to say much of our lives are now digitized, and digital technologies have yielded immeasurable benefits to the individual and society at large. Change heralds challenge, and the digital paradigm-shift has brought challenges of comparable numerosity and magnitude. Privacy is at the forefront of those challenges. In recent years, the digital industry has been subject to increased scrutiny over the rising number of privacy scandals and perceived market failures related to the collection and use of individuals’ personal information. New technologies, market developments, and increases in public attention …

Reinforcing Autonomy: Legal Ethics And Constitutional Compliance In Indigent Criminal Defense, George R. Brand Nov 2019

Reinforcing Autonomy: Legal Ethics And Constitutional Compliance In Indigent Criminal Defense, George R. Brand

Missouri Law Review

Regulating the judicial system is an inherently difficult task. With multi-ple stakeholder groups often at odds with each other and within themselves, it is almost impossible to create laws, rules, and norms that satisfy everyone. The unnervingly peculiar capital murder case of McCoy v. Louisiana typifies the many competing ideologies and motivations constantly in flux in the American judicial system. While unique idiosyncrasies within this case frame a series of events unlikely to be repeated, the Supreme Court of the United States’ split decision educes this ongoing debate amongst judges, litigants, and legislatures on the best practices and purposes undergirding …

Balancing Act: Admissibility Of Propensity Evidence Under Article I, Section 18(C) Of The Missouri Constitution, Emily Holtzman Nov 2019

Balancing Act: Admissibility Of Propensity Evidence Under Article I, Section 18(C) Of The Missouri Constitution, Emily Holtzman

Missouri Law Review

The American legal system has a long-standing ban against using character evidence to show a party’s propensity to act in conformity with that character. This rule has been especially stringent in the criminal system, where the notion is that when a criminal defendant is tried for a crime, that defendant should face trial only for the crimes charged. However, certain crimes, like sex crimes, can be incredibly difficult to prosecute and, accordingly, victim advocates have pushed for changes to these rules. The Federal Rules of Evidence (“FRE”) and several states have enacted rules that allow evidence of prior bad acts …

The Quest For Equal Dignity: Federal Statutory Protection Against Sexual Orientation Discrimination, Alec D. Guy Nov 2019

The Quest For Equal Dignity: Federal Statutory Protection Against Sexual Orientation Discrimination, Alec D. Guy

Missouri Law Review

Over one million Americans are married to someone of the same sex. Although the United States Supreme Court guaranteed the fundamental right of marriage to same-sex couples in 2015, these individuals can still be denied housing or fired from their dream job after getting legally married. For much of history, gay individuals have not been protected by the law, both statutorily and constitutionally. Private individuals are generally still free to discriminate against gay people today because federal statutes rarely prohibit discrimination based on sexual orientation. Consequently, many have argued that sexual orientation discrimination constitutes unlawful discrimination based on sex. Until …

Misdemeanors For All Purposes? Interpreting Proposition 47’S Ameliorative Scope In A New Era Of Criminal Justice Reform, Kayla Burchuk Nov 2019

Misdemeanors For All Purposes? Interpreting Proposition 47’S Ameliorative Scope In A New Era Of Criminal Justice Reform, Kayla Burchuk

Loyola of Los Angeles Law Review

In 2014, Proposition 47 reclassified seven low-level felonies to misdemeanors, demonstrating voters’ striking rejection of California’s historically punitive sentencing policies. This Note examines the recent wave of California Supreme Court jurisprudence interpreting Proposition 47 by exploring the court’s varied readings of the initiative’s ballot materials and statutory text. While the court has liberally construed relief for affected property crimes, it has responded ambivalently in more controversial areas such as drug offenses, mandatory parole periods, and automatic resentencing. This variation reveals ideological tensions between the goal of expanding ameliorative benefits to low-level offenders and anxiety regarding public safety. This Note analyzes …

The Future Of Bail In California: Analyzing Sb 10 Through The Prism Of Past Reforms, Adam Peterson Nov 2019

The Future Of Bail In California: Analyzing Sb 10 Through The Prism Of Past Reforms, Adam Peterson

Loyola of Los Angeles Law Review

The cash bail system is the cause of numerous injustices. It favors the rich over the poor, it packs jails to the breaking point, and it forces those who have yet to be found guilty to sit in jail—often for weeks or months at a time. In 2018, the California legislature passed SB 10. The bill purported to abolish cash bail wholesale and replace it with a risk assessment program. While SB 10 is a step in the right direction, it faces many obstacles before it accomplishes its goal. This Note examines the bill in light of past attempts at …
