National And State Research On Pre-Kindergarten, Sarah C. Mckenzie, Gary W. Ritter
Policy Briefs
Across the nation, over 1.3 million threeand four-year olds attend state funded pre-K programs in 40 states (and Washington D.C.).1 In Arkansas, over 25,000 three- and four-year olds are enrolled in state-funded programs. Since 2008, approximately $111 million a year of state funding has been spent on preKindergarten in Arkansas. 2 In the 2014 election season, the topic of pre-K and state funding for pre-K has been debated in a number of state races, including Arkansas. Therefore, the purpose of this policy brief is to describe pre-K in Arkansas and summarize the existing research examining the impact of pre-K.

Enlarged State Power To Declare Nullity: The Hidden State Interest In The Chinese Contract Law, Hao Jiang
Enlarged State Power To Declare Nullity: The Hidden State Interest In The Chinese Contract Law, Hao Jiang
Journal of Civil Law Studies
This article is on the hidden state interest that article 52(§1) of the Chinese Contract Law protects and the questionable applicability of freedom of contract to Chinese state-owned enterprises (hereafter “SOEs”). In common law, fraud and duress make a contract voidable. In Western civil law jurisdictions, including Louisiana, fraud and duress make a contract relatively null. Article 52(§1) of the Chinese Contract Law renders a contract induced by fraud and duress absolutely null (null and void if using common law terminology) when state interest is harmed. At the same time, according to article 54 of the Contract Law, fraud and …

Mixed Jurisdiction And The Scottish Legal Tradition: Reconsidering The Concept Of Mixture, Stephen Thomson
Mixed Jurisdiction And The Scottish Legal Tradition: Reconsidering The Concept Of Mixture, Stephen Thomson
Journal of Civil Law Studies
Scotland is typically regarded as a mixed jurisdiction based on an assessment of its combination of civilian and common law traditions. If this narrow definition of “mixture” is opened up, one will find several other traditions which are constituent parts of the Scottish legal tradition. Those range from the seemingly remote Celtic and udal law, through feudal and canon law, to the law of the European Union and the European Convention on Human Rights. An holistic approach to the question of mixture requires that each of these traditions is accounted for, especially because of the difficulties in assessing the legacy …
Civil Status And Civil Registry: Current Trends In Spanish Law, Sofia De Salas Murillo
Civil Status And Civil Registry: Current Trends In Spanish Law, Sofia De Salas Murillo
Journal of Civil Law Studies
Currently, in Spanish Law, civil status is a concept under discussion in regard to its definition, its content, the enumeration of possible civil statuses, and even its very subsistence as a category. The processing given to civil status in the corresponding Laws of the Civil Registry is especially important as precisely this Registry has the main, although not sole, objective to officially verify the “acts” or “facts concerning the civil status of persons,” although other legal facts, which are not classifiable as such, are also recorded. The interdependence of both concepts means that it is advisable to have combined …

Michigan V. Bay Mills Indian Community, Wesley J. Furlong
Michigan V. Bay Mills Indian Community, Wesley J. Furlong
Public Land & Resources Law Review
Justice Kagan’s gambling metaphors aside, Michigan v. Bay Mills Indian Community stands as a resolute affirmation of the Supreme Court’s refusal to qualify tribal sovereign immunity absent congressional action. Bay Mills reaffirms that as domestic dependent nations, tribes exercise inherent sovereign immunity, qualified only by the clear direction of Congress, not the Court. While the dissent vented its frustration with the precedent relied on by the majority, the Court reaffirmed that tribal sovereign immunity extends to all commercial activities occurring off Indian land.

The Emerging Need For Hybrid Entities: Why California Should Become The Delaware Of "Social Enterprise Law", Ross Kelley
The Emerging Need For Hybrid Entities: Why California Should Become The Delaware Of "Social Enterprise Law", Ross Kelley
Loyola of Los Angeles Law Review
Recognizing the limitations and restraints posed on socially conscious for-profit organizations, several states have begun to develop a legislative model that blends attributes of traditional for-profit and not-for-profit entities into “hybrid” organizations. Chief among these states is California, which has emerged as a leader of this new social enterprise reform. California is the only state to allow a business to incorporate as a Benefit Corporation or a Flexible Purpose Corporation. Additionally, the state legislature has proposed a third type of hybrid entity—the Low-Profit Limited Liability Company. By addressing the limitations of the traditional corporate structure, California’s new hybrid entities afford …

Outed At School: Student Privacy Rights And Preventing Unwanted Disclosures Of Sexual Orientation, Evan Ettinghoff
Loyola of Los Angeles Law Review
Lesbian, gay, bisexual, transgender, and questioning (LGBTQ) individuals often identify their sexual orientation during their formative school years. During this time, they make important decisions about whether they will come out, to whom, and under what circumstances. However, some school officials have taken matters into their own hands, disclosing information about a student’s sexual orientation to parents or family members without the student’s permission, and without considering the student’s well-being and potential consequences at home. This Note explores a student’s constitutional right to privacy in their sexual orientation. It begins by examining the unique problems LGBTQ youth encounter while developing …
