Three Proposals For Regulating The Distribution Of Home Equity, Ian Ayres, Joshua Mitts Jan 2014

Three Proposals For Regulating The Distribution Of Home Equity, Ian Ayres, Joshua Mitts

Faculty Scholarship

The Consumer Financial Protection Bureau’s recently-released “qualified mortgage” rules effectively discourage predatory lending but miss an equally important source of systemic risk: low-equity clustering. Specific “volatility-inducing” mortgage terms, when present in a substantial cluster of mortgage contracts, exacerbate macroeconomic risk by increasing the chance that the housing and lending markets will have to absorb a wave of simultaneous defaults after a downturn in housing prices. This Article shows that these terms became prevalent in a substantial proportion of residential mortgages in the years leading up to the home mortgage crisis. In contrast, during the earlier “amortization era” (when mortgagors were …

Justice Policy Reform For High-Risk Juveniles: Using Science To Achieve Large-Scale Crime Reduction, Jennifer L. Skeem, Elizabeth S. Scott, Edward Mulvey

Faculty Scholarship

After a distinctly punitive era, a period of remarkable reform in juvenile crime regulation has begun. Practical urgency has fueled interest in both crime reduction and research on the prediction and malleability of criminal behavior. In this rapidly changing context, high-risk youth – the small proportion of the population where crime is concentrated – present a conundrum. Institutional placement or criminal court processing can exclude these youths from interventions that would better protect public …

Cross-Validation Of The El Paso Risk Assessment Of Juveniles At Intake Scale (El Paso Raji), Dilata Ranadive Jan 2014

Cross-Validation Of The El Paso Risk Assessment Of Juveniles At Intake Scale (El Paso Raji), Dilata Ranadive

Open Access Theses & Dissertations

No published risk assessment instrument is designed for the specific purpose of identifying high risk first-time juvenile offenders at their first contact with the juvenile justice system. The El Paso Risk Assessment of Juveniles at Intake (El Paso RAJI) was developed by Valenzuela (2011) for this purpose. The current study had three aims: i) to assess the validity of the RAJI as a predictor of recidivism among first-time juvenile offenders, ii) to compare the predictive power of RAJI items with the predictive power of similar items from another risk assessment instrument, the Pre-Positive Achievement Change Tool (PrePACT), and iii) to …

Interpreting Begay After Sykes: Why Reckless Offenses Should Be Eligible To Qualify As Violent Felonies Under The Acca’S Residual Clause, Cornelia J.B. Gordon

Duke Law Journal

Passed as part of the Armed Career Criminal Act, 18 U.S.C. § 924(e) subjects felons in possession of firearms to a strict mandatory minimum sentence if the offenders have three prior state or federal convictions that qualify as serious drug offenses or violent felonies. A crime qualifies as a violent felony under the residual clause, 18 U.S.C. § 924(e)(2)(B)(ii), if it is one of the enumerated offenses of "burglary, arson, or extortion, involves use of explosives, or otherwise involves conduct that presents a serious potential risk of physical injury to another." Current federal circuit court interpretations of the Supreme Court's …
