Do Judges Systematically Favor The Interests Of The Legal Profession?, Benjamin H. Barton Oct 2007

Do Judges Systematically Favor The Interests Of The Legal Profession?, Benjamin H. Barton

Scholarly Works

This Article answers this question with the following jurisprudential hypothesis. Many legal outcomes can be explained, and future cases predicted, by asking a very simple question: is there a plausible result in this case that will significantly affect the interests of the legal profession (positively or negatively)? If so, the case will be decided in the way that offers the best result for the legal profession.

The article presents theoretical support from the new institutionalism, cognitive psychology and economic theory. The Article then gathers and analyzes supporting cases from areas as diverse as constitutional law, torts, professional responsibility, employment law, …

Survey Of Cooperation Among Clinical, Pro Bono, Externship And Legal Writing Faculty, Susan Wawrose, Sarah E. Ricks

School of Law Faculty Publications

Recent surveys by a committee of the Legal Writing Institute (LWI) show that many legal writing faculty around the country are engaged in exciting and creative collaborations with their colleagues in clinics and in externship and pro bono programs. Faculty from these different programs work together around course and curriculum planning, on large and small teaching initiatives, and on scholarship. Whether the proper metaphor for this type of collaboration is collision or something more constructive, the inspiring fact is that these collaborations are taking place.

Agency By Analogy: A Comment On Odious Debt, Deborah A. Demott Oct 2007

Agency By Analogy: A Comment On Odious Debt, Deborah A. Demott

Law and Contemporary Problems

DeMott focuses on how one might think about the phenomenon of odious debt from the standpoint of common-law agency. Though this analogy has its flaws, some useful insights can be gathered by examining the similarities and differences between the two doctrines, especially when contemplating the theory of liability in the sovereign context. To illustrate the complexity of comparing odious debt to agency law, she develops a series of comparisons between the consequences of borrowing by a sovereign and that by a private corporation afflicted with inept or corrupt management.

Odious Debt In Retrospect, Daniel K. Tarullo Oct 2007

Odious Debt In Retrospect, Daniel K. Tarullo

Law and Contemporary Problems

In the eighty years since Alexander Sack coined the phrase "odious debt," academics and activists have periodically rediscovered Sack's idea, often arguing for its application or extension-to this point, in vain. Here, Tarullo reveals the degree to which current interest in the problem of odious debt is intertwined with other problems that strike more critically at the well-being of developing-and emerging-market countries. He reasons that the necessarily complex effort needed to institutionalize a doctrine of odious debt is a potentially effective organizing principle for generating the political will to address these other persistent, debilitating problems.

Corporate Governance, The Securities And Exchange Commission, And The Limits Of Disclosure, J. Robert Brown Jr. Oct 2007

Corporate Governance, The Securities And Exchange Commission, And The Limits Of Disclosure, J. Robert Brown Jr.

Sturm College of Law: Faculty Scholarship

This article explores the role of the Securities and Exchange Commission in the corporate governance process. Traditionally, most have viewed substance as a matter for the states and disclosure for the Commission. This "neat" dichotomy has been long accepted but little examined.

The Commission was always meant to play a role in the governance process. Congress assigned to the SEC the authority to regulate disclosure in part to prevent various abusive practices by management, including the payment of excessive compensation and self perpetuation. Disclosure largely eliminated secrecy but did end self interest. Instead, pressure built on states to loosen substantive …

From Mothers' Allowance To Mothers Need Not Apply: Canadian Welfare Law As Liberal And Neo-Liberal Reforms, Shelley A. M. Gavigan, Dorothy E. Chunn

Osgoode Hall Law Journal

In this paper we examine changes in the form and content of Canadian welfare law through a historical, feminist lens using the exemplar of mother-headed families. Our analysis of how the state dealt with sole support mothers in several provinces throughout the twentieth century reveals important continuities, as well as discontinuities, between the past and the present that have shaped and reshaped the lives and experiences of poor women and their children. In doing so, it helps to illuminate how they have been rendered "undeserving" or "never deserving" with the neo-liberal (re)formation of the Keynesian state in Canada.

The Ties That Bind? Regionalism, Commercial Treaties, And The Future Of Global Economic Integration, Chris Brummer Oct 2007

The Ties That Bind? Regionalism, Commercial Treaties, And The Future Of Global Economic Integration, Chris Brummer

Vanderbilt Law Review

A revolutionary shift in international cooperation is underway. Many governments, frustrated with dissension hampering multilateral trade reform at the World Trade Organization ("WTO"), are now turning to bilateral and regional treaties to forward their commercial interests.1 Under these agreements, which rocketed from fewer than 390 in 1989 to more than 2,400 today,2 states have relinquished key aspects of their economic sovereignty to participate in two-party pacts and regional trade clubs like the North American Free Trade Agreement ("NAFTA") and the European Union ("EU"). As a result of such cooperation, most countries no longer may levy tariffs easily, subsidize their domestic …
