The December 2007 issue of CityLand covers major land use and development initiatives across New York City. It features contentious hearings on the redevelopment of Willets Point, the approval of a 63-story tower at 50 West Street using Battery Tunnel air rights, and the Planning Commission’s modifications to Columbia University’s Manhattanville expansion and Community Board 9’s 197-a plan. The issue also highlights new zoning standards for parking lots, a proposed crackdown on illegal hotel conversions, and a green roof tax incentive resolution. Domain Tasting Is Taking Over The Internet As A Result Of Icann’S “Add Grace Period”, Christopher Healey Dec 2007

Domain Tasting Is Taking Over The Internet As A Result Of Icann’S “Add Grace Period”, Christopher Healey

Duke Law & Technology Review

When a domain name is registered, the registrant is given five days to cancel for a full refund. While the purpose of this grace period is to protect those who innocently err in the registration process, speculators have taken advantage of the grace period through a process called "domain tasting." These "domain tasters" register hundreds of thousands of domain names and cancel the vast majority of them within the five-day grace period, keeping only those that may be valuable as placeholder advertising websites or to holders of trademark rights. This iBrief will outline the "domain tasting" process, analyze why it …

Characterization Patterns Of Milcon Project Contract Modifications, Tyler K. Nielsen Dec 2007

Characterization Patterns Of Milcon Project Contract Modifications, Tyler K. Nielsen

Theses and Dissertations

Change orders are used by project managers of construction projects to account for unexpected changes in construction projects after the contract has been finalized. This can include everything from weather events to last minute changes requested by the user. This effort analyzed data from the U.S. Air Force Military Construction (MILCON) program to find the major causes of change orders in the hopes that the associated costs may be minimized and that the insight gained may improve project management efforts. The data was analyzed using means comparison testing through the nonparametric Kruskal-Wallis test; the results were then ranked using the …

Court Briefs

No. 07-618
Goss International Corp. v. Tokyo Kikai Seisakusho, Ltd.

On Petition for Writ of Certiorari to the United States Court of Appeals for the Eighth Circuit

From the Introduction and Summary of Argument

This case presents issues of jurisdiction, equity, and international comity that require this Court’s resolution. As we understand the facts, in 2003 the petitioner, Goss International, obtained a judgment under the Antidumping Act of 1916, 15 U.S.C. § 72 (2000) (repealed 2004), against the respondents, which are a Japanese corporation and its wholly-owned American subsidiary. The consonance between the Antidumping Act and the obligations of the …

Facts: MK Ramon was convicted of committing an indecent act. According to statute, a person is barred from being a member of the Knesset or a cabinet minister only if he has been convicted of an offence involving moral turpitude and is given a custodial sentence. The court that sentenced MK Ramon did not give him a custodial sentence and it held that the offence did not involve moral turpitude.

Shortly after serving the sentence of community service, MK Ramon was appointed a member of the government with the position of Deputy Prime Minister. The appointment was approved by the …

Testimony Before The National Prison Rape Elimination Commission, The Role Of Courts And Litigation In Regulating Prison And Jail Prevention Of Sexual Violence And Misconduct, Margo Schlanger

Other Publications

I have been asked to focus my testimony on litigation and how it contributes to oversight of jails and prisons, in particular to incentivizing appropriate prison and jail supervisory practices and policies that minimize sexual misconduct and sexual violence behind bars. Litigation is an accountability mechanism operative in many spheres, of course, but whereas in most other areas of governmental activity, other such mechanisms have pride of place, we have as a polity largely failed to implement any other effective regulatory system to govern our burgeoning incarcerative apparatus. At least in many states prison and jail systems, litigation is one …

Translated Opinions

Facts: The appellant suffered from a mental illness. On 1 October 1999, the appellant attacked the respondent, who was then an eight year old child, and seriously wounded him. The appellant then attacked his own daughter and killed her. The appellant was indicted for murder and attempted murder, but because of the mental illness from which he suffered, he was found not to be responsible for his actions, and he was hospitalized in a psychiatric hospital. The respondent, through his parents, sued the appellant for compensation.

Held: Tort law does not recognize a defence of insanity according to the meaning …

How To Repair Unconscionable Contracts, Omri Ben-Shahar Dec 2007

How To Repair Unconscionable Contracts, Omri Ben-Shahar

Law & Economics Working Papers Archive: 2003-2009

Several doctrines of contract law allow courts to strike down excessively one-sided terms. A large literature explored which terms should be viewed as excessive, but a related question is often ignored—what provision should replace the vacated excessive term? This paper begins by suggesting that there are three competing criteria for a replacement provision: (1) the most reasonable term; (2) a punitive term, strongly unfavorable to the overreaching party; and (3) the maximally tolerable term. The paper explores in depth the third criterion—the maximally tolerable term—under which the excessive term is reduced merely to the highest level that the law considers …

The Troublemaker's Friend: Retaliation Against Third Parties And The Right Of Association In The Workplace, Alex B. Long Dec 2007

The Troublemaker's Friend: Retaliation Against Third Parties And The Right Of Association In The Workplace, Alex B. Long

Scholarly Works

Title VII theoretically provides virtually unlimited protection from retaliation for one kind of workplace troublemaker - the employee who files a formal charge of discrimination. However, the protection from retaliation enjoyed by such individuals is significantly less when the troublemaker resorts to an employer's internal process for resolving discrimination complaints prior to the filing of a formal charge of discrimination. And what of the coworker who assists the troublemaker in pursuing such an internal grievance? Or the coworker who simply has some type of relationship with the troublemaker who files a formal charge of discrimination? What protection from retaliation do …

The Future Of The Economic Analysis Of Law In Latin America: A Proposal For Model Codes, Juan Javier Del Granado, M. C. Mirow Dec 2007

The Future Of The Economic Analysis Of Law In Latin America: A Proposal For Model Codes, Juan Javier Del Granado, M. C. Mirow

Chicago-Kent Law Review

Nothing excites civilian lawyers and judges more than commissions for codification. Codification is more than an academic enterprise. Codification projects directly cut across the interface between law and life. ALACDE intends to harness this Latin American interest in codification to bring the economic approach to Latin America. A new-generation law and economics civil and commercial code will be a conscious project to restate Roman law's usefulness for coping with today's problems. Through law and economics, Roman law will renew itself. As a paradigmatic private-law system, Roman law is eminently amenable to a state-of-the-art fusion with law and economics. Sensitivity to …
