In Memory Of Professor Janet R. Spragens, Nancy J. Altman Jun 2007

In Memory Of Professor Janet R. Spragens, Nancy J. Altman

American University Law Review

A eulogy for Professor Janet R. Spragens given by her sister, Nancy Altman. “Janet died much too young, before she had time to express all the laughter, love, happiness, and contribution to public service she had within her. Rather than dwell on what might have been, though, I choose to celebrate her life—her wonderful, vibrant, and unique qualities and the gifts she bestowed not only on her friends and family but on countless others who never knew her.”

Engagement As A Way Toward Peace, Mahmood Monshipouri

Human Rights & Human Welfare

The Bush administration’s active support for the Israeli government is counterproductive in its refusal to recognize a Palestinian unity government which includes Hamas. A great majority of American Jews have called for Israel to withdraw from the territories occupied in 1967 and support the creation of a Palestinian state. A hard-line minority of politicians in the United States, along with their affiliated media networks and think-tanks, have continued to dominate the main Jewish lobbying group, the American-Israel Public Affairs Committee (AIPAC).

Judging The Voting Rights Act, Adam B. Cox Jun 2007

Judging The Voting Rights Act, Adam B. Cox

Public Law and Legal Theory Working Papers

The Voting Rights Act has radically altered the political status of minority voters and dramatically transformed the partisan structure of American politics. Given the political and racial salience of cases brought under the Act, it is surprising that the growing literature on the effects of a judge’s ideology and race on judicial decisionmaking has overlooked these cases. This Article provides the first systematic evidence that judicial ideology and race are closely related to findings of liability in voting rights cases. Democratic appointees are significantly more likely than Republican appointees to vote for liability under section 2 of the Voting Rights …

The Protection Of Databases, Daniel J. Gervais Jun 2007

The Protection Of Databases, Daniel J. Gervais

Chicago-Kent Law Review

In Parts I and II of this Paper, the author analyzes the legal protection of databases first in international treaties, in particular the Berne Convention and the WTO TRIPS Agreement, and second under national and regional copyright, sui generis, or other (e.g., tort) law in Europe (both the European Directive on the legal protection of databases of 1996, which was under review, and a number of relevant national laws), the United States, and a number of foreign jurisdictions (Australia, Canada, China, Nigeria, Russia, and Singapore). In Part III, the author provides a critical analysis of the effort to expand the …

Quibbling Siblings: Conflicts Between Trademarks And Geographical Indications, Dev Gangjee Jun 2007

Quibbling Siblings: Conflicts Between Trademarks And Geographical Indications, Dev Gangjee

Chicago-Kent Law Review

The relationship between trademarks and geographical indications ("GIs") has historically been tempestuous. Each of these quibbling siblings, members of the broader family of unfair competition law, entitles registrants to the exclusive use of a sign. So what happens when a GI collective and a trademark proprietor lay claim to the same sign within a single jurisdiction? As part of the renewed interest in TRIPs flexibilities and attempts at accommodating or reconciling differences between national laws, this paper explores a newly emerging space that may just be big enough for the both of them. The analysis draws on a recent World …

The Role Of International Ngos In The Intellectual Property Policy-Making And Norm-Setting Activities Of Multilateral Institutions, Duncan Matthews Jun 2007

The Role Of International Ngos In The Intellectual Property Policy-Making And Norm-Setting Activities Of Multilateral Institutions, Duncan Matthews

Chicago-Kent Law Review

International NGOs play a significant role in relation to intellectual property policy-making and norm-setting in the following multilateral institutions: the World Trade Organization ("WTO"); the World Intellectual Property Organization ("WIPO"); the World Health Organization ("WHO"); the Convention on Biological Diversity Conference of the Party ("CBD-COP"); and the Food and Agriculture Organization ("FAO') of the United Nations. International NGOs enhance the capacity of developing country delegates to multilateral institutions to negotiate on intellectual property issues. Although there are limits to the relationship between developing country delegates and international NGOs, relative to the resources available, international NGOs have had a considerable impact, …

Technological Change And The Design Of Plant Variety Protection Regimes, Mark D. Janis, Stephen Smith Jun 2007

Technological Change And The Design Of Plant Variety Protection Regimes, Mark D. Janis, Stephen Smith

Chicago-Kent Law Review

In this paper, we examine the potential for plant variety protection ("PVP") regimes—that is, sui generis, industry-specific intellectual property regimes—to become compromised as a result of technological change. In particular, we analyze the shift in plant breeding from phenotypic selection to genotypic selection, and consider the impact of that shift on existing plant variety protection. We also lay out an alternative structure for plant intellectual property protection based on unfair competition, a model that differs radically in some respects from current PVP schemes. We offer our model as a starting point for debate on adaptations that might improve PVP …

What Does Happiness Research Tell Us About Taxation?, David A. Weisbach Jun 2007

What Does Happiness Research Tell Us About Taxation?, David A. Weisbach

Coase-Sandor Institute for Law & Economics Research Paper Series

This paper analyzes the consequences of the findings from research into self-reported well being or happiness for taxation. It primarily considers two findings: that happiness depends on status as well as income, and that individuals may adapt to disability, exhibiting relatively small losses in happiness from disabilities. In each case, it examines how adding these concerns to standard tax models changes the results and then compares the empirical findings of the happiness literature to see whether they provide the type of data needed to parameterize the models. In both cases, the theoretical models ask for different types of data than …

Valuing Laws As Local Amenities, Anup Malani Jun 2007

Valuing Laws As Local Amenities, Anup Malani

Coase-Sandor Institute for Law & Economics Research Paper Series

The conventional approach to evaluating a law is to examine its effect on proximate behavior. To evaluate a new criminal law, for example, the conventional approach would look to changes in the crime rate. This paper argues instead that laws should be judged by the extent to which they raise housing prices and lower wages. The logic is that the value of a law, much like the value of a lake or a public school, is capitalized into local housing and labor markets. Desirable laws increase housing prices and decrease wages because more people want to live in the relevant …

Optimal Bail And The Value Of Freedom: Evidence From The Philadelphia Bail Experiment, David Abrams, Chris Rohlfs Jun 2007

Optimal Bail And The Value Of Freedom: Evidence From The Philadelphia Bail Experiment, David Abrams, Chris Rohlfs

Coase-Sandor Institute for Law & Economics Research Paper Series

This paper performs a cost-benefit analysis to determine socially optimal bail levels that balance the costs to defendants against the costs to other members of society. We consider jailing costs, the cost of lost freedom to incarcerated defendants, and the social costs of flight and new crimes committed by released defendants. We estimate the effects of bail amounts on the fraction of defendants posting bail, fleeing, and committing crimes during pre-trial release, using data from a randomized experiment. We also use defendants' bail posting decisions to measure their subjective values of freedom. We find that the typical defendant in our …
