The Politics Of Wine: Trade Barriers, Interest Groups And The Commerce Clause, Alan E. Wiseman, Jerry Ellig
The Politics Of Wine: Trade Barriers, Interest Groups And The Commerce Clause, Alan E. Wiseman, Jerry Ellig
Vanderbilt Law School Faculty Publications
We investigate the contemporary impacts of the commerce clause of the U.S. Constitution by focusing on recent changes in state laws governing interstate direct shipment of alcohol. The elimination of interstate trade barriers, consistent with the intent of the commerce clause, clearly facilitates efficient markets. More specifically, in 2003, the state of Virginia legalized direct wine shipping to consumers from out-of-state sellers, and by 2004, the average price differential between online sellers and bricks-and-mortar stores in Northern Virginia was approximately 26–40% lower than in 2002. Virginia bricks-and-mortar retailers also began pricing their products as a function of interstate shipping costs …

Countering Chinese Influence In Sudan, Ali Wyne
Human Rights & Human Welfare
It is difficult to imagine a more poisonous symbiosis than that between China and Sudan. The former requires a continuous flow of low-cost oil imports to satisfy its soaring oil demand, and the latter requires sufficient economic support to immunize itself against international interventions and preempt potential internal uprisings. Sudan supplies 64 percent of its oil to China (meeting seven percent of the economic power’s demand in 2006), and China, for its part, has invested heavily in Paloich, one of the country’s central oil-producing areas.
Electronic Records As Documentary Evidence, Ken Chasse
Electronic Records As Documentary Evidence, Ken Chasse
Canadian Journal of Law and Technology
The new electronic record provisions that are now part of almost all of the Evidence Acts in Canada are as important as any statutory law or common law concerning the use of records as evidence. They bring six important improvements to the evidentiary law of business records. It is argued, however, that their most serious defects are that they: (1) perpetuate the best evidence rule — a rule rendered redundant by electronic records and information management (RIM); (2) do not deal with hearsay issues; (3) do not cure the defects of the business record provisions in regard to electronic records; …

The Adverse Economic Effects Of Spectrum Set-Asides, Robert W. Crandall, Allan T. Ingrahm
The Adverse Economic Effects Of Spectrum Set-Asides, Robert W. Crandall, Allan T. Ingrahm
Canadian Journal of Law and Technology
In February 2007, Industry Canada released a consultation that outlined a proposed auction design for spectrum Ifor Advanced Wireless Services. As part of its consultation, Industry Canada contemplated a spectrum set-aside in the AWS auction to facilitate the entry of a new wireless service provider in Canada; however, it noted that a potential drawback of a spectrum set-aside is that it can induce uneconomic entry into the market. In this paper, we show that a set-aside for AWS spectrum in Canada is more likely to result in uneconomic entry than in a viable domestic entrant into the Canadian wireless industry. …
