Privacy, Free Speech & The Garden Grove Cyber Café Experiment, Brett Stohs Oct 2004

Privacy, Free Speech & The Garden Grove Cyber Café Experiment, Brett Stohs

Duke Law & Technology Review

In response to gang violence at local "cyber cafés," the City Council of Garden Grove, California, passed an ordinance requiring cyber cafés to install video surveillance systems. The constitutionality of the provision was subsequently challenged, and a California Court of Appeal determined that the video surveillance requirement did not violate free speech or privacy protections under either the federal or California Constitutions. This decision was immediately challenged, by commentators and a dissenting judge, as opening the door to Orwellian-type, government intrusions into individuals' personal lives. This iBrief analyzes the appellate court's decision and concludes that not only did the majority …

Summary Of Middleton Vs. Warden, 120 Nev. Adv. Rep. 74, Ryan Hall Oct 2004

Summary Of Middleton Vs. Warden, 120 Nev. Adv. Rep. 74, Ryan Hall

Nevada Supreme Court Summaries

The Nevada Supreme Court removed Middleton’s appointed appellate counsel due to substandard representation. On initial review, the Nevada Supreme Court ordered Middleton's counsel to submit an amended brief, limited to 80 pages. Counsel's "amended" brief was simply the original brief with the final few pages removed so as to meet the 80-page requirement. Counsel had repeatedly violated court orders, and the work product he ultimately submitted was unacceptable for representation of a client who was facing a death sentence.

Defining Dicta, Michael Abramowicz, Maxwell Stearns Oct 2004

Defining Dicta, Michael Abramowicz, Maxwell Stearns

ExpressO

The doctrine of stare decisis applies only to holdings of past cases, but scholars and courts have paid far more attention to stare decisis doctrine than to the distinction between holding and dicta, particularly in recent years. The lack of attention that the distinction receives may reflect a sense among legal analysts that they know dicta when they see it, but the problem is considerably more analytically complex than it may at first appear. In this Article, Professors Abramowicz and Stearns identify a number of structural problems that may affect whether statements in judicial opinions should be classified as holding …

Tribe V. White Wolf Hall, 04-Ap-14 (Blkft. Tr. Ct. App., Oct. 7, 2004), Blackfeet Appellate Court Oct 2004

Tribe V. White Wolf Hall, 04-Ap-14 (Blkft. Tr. Ct. App., Oct. 7, 2004), Blackfeet Appellate Court

Court Decisions

  • In the Blackfeet Tribal Court of Appeals, the Court considered whether the defendant’s rights were violated when the lower court judge did not follow sentencing guidelines for the defendant. In this case, the defendant was convicted of child abuse and domestic abuse, with consecutive sentences, allowing parole after six months.

  • The Court noted that the lower court should have utilized Blackfeet Family Code, Ch. 22, Sec. 4, for child abuse providing that sentences should be between $50-200 and a term of imprisonment to not exceed 15 days.

  • Also, for domestic abuse, the Blackfeet Law and Order code, ch. 9, Sec. …

Marceau V. Skunk Cap, 04-Ap-12 (Blkft. Tr. Ct. App., Oct. 7, 2004), Blackfeet Appellate Court

Court Decisions

  • In the Blackfeet Tribal Court of Appeals, the Court considered the timeliness of an objection. The Blackfeet Law and Order Code, Ch.9, Rule 10-A, states “any motion filed with the Court in a Civil or Criminal Matter must be objected to within (5) days after service upon the opposing party.”

  • The respondent sought a Writ of Mandamus to the Appellate Court to order the lower court to rule on a motion to “stay,” not reverse, a lower court order of child support.

  • The lower court issued a stay on execution, but also reinstated a previous court order without ruling on …
