Antitrust And Competition Law Update: F. Hoffman-La Roche Ltd. V. Empagran: Supreme Court Restricts Extraterritorial Reach Of U.S. Antitrust Laws, James Burling

Wilmer Cutler Pickering Hale and Dorr Antitrust Series

On June 14, the U.S. Supreme Court issued an important opinion on the extraterritorial reach of U.S. antitrust laws in F. Hoffmann-La Roche Ltd. v. Empagran, S.A.1 The opinion, written by Justice Breyer, restricts the extraterritorial application of the antitrust laws under the Foreign Trade Antitrust Improvements Act of 1982 (FTAIA). The Court unanimously held that purchasers in overseas markets claiming injury from price fixing (or other antitrust violations) cannot sue in U.S. courts by alleging that they were harmed by conduct that also injured consumers in the United States, at least absent allegations that injury to U.S. consumers facilitated …

Democratic Responses To Terrorism: A Comparative Study Of The United States, Israel And India, Arunabha Bhoumik

After describing each model, the paper introduces different variables that are relevant in understanding a country’s counter-terrorist policies. Using these variables, the paper attempts to analyze and classify each country’s counter-terrorist policies.

Criminal Case Complexity: An Empirical Perspective, Michael Heise Jun 2004

Criminal Case Complexity: An Empirical Perspective, Michael Heise

Cornell Law Faculty Publications

Criminal case complexity persists as a central tenet in many academic and public critiques of our legal system even though little is known about two critical questions. One question is whether key actors (juries, attorneys, and judges) view case complexity similarly. In other words, do juries, attorneys, and judges agree on whether a case is complex? A second question involves the determinants of case complexity for each group. That is, what factors make a case more (or less) complex for juries, attorneys, and judges. This article explores both questions from an empirical perspective with the benefit of recent data from …

Clarifying The Rules And Roles Of Land Use Boards, John R. Nolon, Jessica A. Bacher Jun 2004

Clarifying The Rules And Roles Of Land Use Boards, John R. Nolon, Jessica A. Bacher

Elisabeth Haub School of Law Faculty Publications

This article discusses the rules and roles of land use boards, including planning boards, and zoning boards of appeals. Local governments are given broad authority to create land use regulations by the New York state legislature, and so long as they stay within the boundaries of the state land use statutes, the local government’s fact based decisions are usually upheld in face of legal challenges in court. This column analyzes several recently decided cases in an attempt to clarify the uncertainties involved with the decisions of local land use boards, and challenges to land use board decisions.

Translated Opinions

Facts: An enabling law of the Knesset empowers local authorities to enact bylaws that prohibit or restrict the sale of pig meat and meat products within the municipal boundaries. The respondent municipalities enacted such bylaws, which restricted or prohibited the sale of pig meat and meat products within their respective boundaries. The petitioners challenged these bylaws, arguing that they violated the freedom of occupation of the sellers of pig meat, and the liberty of the consumers to adopt whatever lifestyle they saw fit, without interference amounting to religious coercion.

Held: The purposes underlying the enabling law empower the local authorities …

Separation Of Powers And The Commander In Chief: Congress’S Authority To Override Presidential Decisions In Crisis Situations, Reid Skibell Jun 2004

Separation Of Powers And The Commander In Chief: Congress’S Authority To Override Presidential Decisions In Crisis Situations, Reid Skibell

ExpressO

This paper represents an in-depth examination of Separation of Power issues raised in the context of the Legislative and Executive Branch’s exercise of their War Powers. Specifically, the paper considers the argument raised by the Bush Administration that Congress cannot constitutionally infringe on the President’s exercise of his Commander in Chief Power in the fight against terrorism. Such an argument would effectively insulate most Presidential decisions related to terrorism from Congressional oversight. The implication being that even if Congress wanted to accomplish something like ending the detainment of detainees at Guatanamo Bay it would be outside their Constitutional authority. The …
