Foreword, Jeffrey S. Lehman

Michigan Law Review

Why celebrate? Some people hate law reviews. They would think it unseemly to celebrate a centennial such as this. They might compare it to a 1448 celebration of the first hundred years of the Bubonic Plague. Their criticisms are familiar. Why do we entrust the development of the scholarly canon to second- and third-year law students? Why do law reviews publish really bad things and reject really good things? Why do they encourage a style of argument in which each article must begin by summarizing all that has been written before? Why do they insist that any assertion of fact, …

The Report Of The Attorney General's National Committee To Study The Antitrust Laws: A Retrospective, Thomas E. Kauper Jun 2002

The Report Of The Attorney General's National Committee To Study The Antitrust Laws: A Retrospective, Thomas E. Kauper

Michigan Law Review

In 1955, the third year of the Eisenhower administration, the Michigan Law Review published what I believe to be the only symposium on antitrust law ever to appear in its pages. The occasion was the release in March of that year of a Report of the Attorney General's National Committee to Study the Antitrust Laws,2 a nearly fourhundred- page examination of virtually all facets of federal antitrust doctrine and enforcement. The pages of the symposium led me of course to revisit the Report itself, a visit a little like seeing an old high school friend long forgotten some forty years …

The Political Economy Of School Choice, Michael Heise, James E. Ryan Jun 2002

The Political Economy Of School Choice, Michael Heise, James E. Ryan

Cornell Law Faculty Publications

This paper examines the political economy of school choice and focuses in particular on the role of suburbanites. This group, which we contend is the most important and powerful stakeholder in choice debates, has yet to receive much attention in the commentary. It turns out that suburbanites, by and large, are not wild about school choice, either public or private. Suburbanites are largely satisfied with the schools in their neighborhoods and want to protect the physical and financial independence of those schools (as well as their property values, which are tied to the perceived quality of local schools). School choice …

Crisci V. Security Insurance Co.: The Dawn Of The Modern Era Of Insurance: Bad Faith And Emotional Distress Damages, Jeffrey E. Thomas

Nevada Law Journal

I have chosen Crisci v. Security Insurance Co. as "my favorite insurance case" for this symposium issue because it typifies the doctrine of "bad faith," one of the most interesting and important contributions of insurance law to the general body of law. It "typifies" the doctrine with its classic, if somewhat extreme, fact pattern, and with its reliance on the implied covenant of good faith and fair dealing3 for the recognition of a cause of action that sounds in tort. Yet it also represents a potential for bad faith law that has not yet been fulfilled: the promise of …

Peeping Techno-Toms And The Fourth Amendment: Seeing Through Kyllo's Rules Governing Technological Surveillance, Christopher Slobogin

Vanderbilt Law School Faculty Publications

This article suggests that the Supreme Court's decision in Kyllo v. United States may not be as protective of the home as it first appears. Kyllo held that use of a thermal imager to detect heat sources inside the home is a fourth amendment search, requiring a warrant and probable cause. But it also held that use of technology that is in "general public use" or that only discovers what a naked eye observer could see from a public vantage point is not a search, even when the location viewed is the interior of the home. This article shows that …
