Expanding Health Coverage For The Uninsured: Fundamentals Of The Tax Credit Option, Beth Fuchs, Julie James

National Health Policy Forum

This paper seeks to provide the basics for understanding the current debate over tax credits as a vehicle for reducing the number of uninsured Americans and focuses attention on some of the associated issues: How is health insurance treated under current tax law? Why tax credits and not deductions? What are the major issues in designing tax credits? Who should be eligible and for what size credit? What changes, if any, would be needed to the insurance market to ensure that policies are available and affordable for people eligible for tax credits? What are the major issues related to administering …

The Union claims that the Employer has an obligation to notify employees at least an hour in advance of work shift overtime being extended longer than initially expected. The Employer submits that this has never been the practice, that it is contrary to the Agreement, and that it would be impractical.

The grievance fails. Application of the article in question as the Union seeks to have it interpreted is clearly not what the parties intended. Indeed, it would be unworkable where the original work shift extension overtime is only for one hour, as it quite often is.

Baseline 2000 Background Report: The Status Of Integrated Coastal Management As An International Practice (Second Iteration), Jens Sorensen

Urban Harbors Institute Publications

The Coastal Zone Canada 2000 Conference occurred in Saint John, New Brunswick from September 17 to 22. All of the 600 registrants received a canvas packet that included four separately bound publications: the final conference program, the tradeshow program, Canadian Synopsis (a table of ICM efforts in Canada), and Baseline 2000.

The Coastal Zone Canada Association organized and administered the Conference as they had done for three previous Canadian based international CZ conferences (Victoria, British Columbia in 1998, Rimouski, Québec in 1996, and Halifax, Nova Scotia in 1994).

Two of the fundamental objectives of the Coastal Zone Canada Association (CZCA) …

'Golden' Anniversary: 30-Year-Old Decision Is Fabric Of Land Use Law, John R. Nolon

Elisabeth Haub School of Law Faculty Publications

The famous New York case of Golden v. Ramapo helped create the movement towards smart growth thirty years ago. Ramapo, like most other towns in New York struggled with the familiar quandary of how to balance the pressures of absorbing growth while still controlling urban sprawl. Ramapo’s solution, to greatly reduce development in its jurisdiction for eighteen years in order to research more efficient development methods, sparked much controversy with local land owners. The United States Court of Appeals, in one of New York’s most significant contributions to smart growth, upheld Ramapo’s plan and created a groundbreaking precedent still widely …

Duke Law & Technology Review

This iBrief explores the European Data Privacy Directive and seeks to explain why the European Commission believes .Net Passport may be in violation of its privacy policies and a case for further investigation.

Schip Turns Five: Taking Stock, Moving Ahead, Jennifer Ryan

National Health Policy Forum

This issue brief notes the five-year anniversary of the effective date of Title XXI of the Social Security Act, the State Children's Health Insurance Program (SCHIP). It looks at the successes of the program, as well as some of the obstacles SCHIP will face as it moves from childhood into adolescence and attempts to maintain its effectiveness in providing health coverage to uninsured children and families. The paper explores the critical funding impasse created by the downturns in the economy and the financing structure of the SCHIP statute. It also highlights the emerging issue of program retention and the need …

Yated V. Ministry Of Education, Dalia Dorner, Edmond E. Levy, Theodor Or Aug 2002

Yated V. Ministry Of Education, Dalia Dorner, Edmond E. Levy, Theodor Or

Translated Opinions

Facts: The Special Education Law, 1998, provides that the State must provide special education, as per the definition of that term in the statute. Petitioners are the parents of children with special needs who are integrated into the regular educational system. They claim that that State does not provide financial aid to aid them with the expense of educating their children. Petitioners assert that this infringes their children’s fundamental rights, discriminates against them, and violates the provisions of the Special Education law.

Held: The Court held that the right to education is a fundamental right. This right is recognized by …

Estate Of Strangi, Section 2036, And The Continuing Relevance Of Byrum, Brant J. Hellwig Aug 2002

Estate Of Strangi, Section 2036, And The Continuing Relevance Of Byrum, Brant J. Hellwig

Scholarly Articles

This report analyzes the potential application of section 2036(a) to limited partnerships employed for estate planning purposes, using the facts of Tax Court case of Estate of Strangi v. Commissioner as a guide. Particular emphasis is placed on the Commissioner's argument for inclusion under section 2036(a)(2) based on the taxpayer's control over the property transferred to the partnership, as well as the taxpayer's argument under the Supreme Court case of United States v. Byrum that the existence of the taxpayer's fiduciary duty to the partnership negates the application of section 2036 altogether. The report concludes that, because the essential facts …

A Historical Overview Of The Bumpass Cove Landfill Controversy, 1972-2002., Robert Clinton Marsh Iii

Electronic Theses and Dissertations

With the assistance of information collected by residents of Bumpass Cove, Tennessee Department of Public Health records, and interviews with residents and local health officials, this study provides a historical overview of the inception of Bumpass Cove Landfill, the resulting problems stemming from its misuse, and the reaction of a persistent community during the 1970s and early 1980s. In its early days, Bumpass Cove was an active and productive mining site; however, the area would become a threat to the local residents’ safety with the opening of Bumpass Cove Sanitary Landfill. Years of illegal hazardous waste land filling wreaked havoc …

Waiting To Exhale?: Global Warming And Tax Policy, Roberta Mann

American University Law Review

This article explores the links between energy policy, tax policy and global warming. This article focuses on tax policy, because the emerging consensus among legal scholars favors economic incentives rather than command-and-control regulations for reaching environmental goals, and the Federal income tax has proved an effective delivery system for economic incentives.

After briefly discussing of the science of global warming and the provisions of the Kyoto Protocol on Climate Change, the article reviews the impact of both existing tax law and current proposals for energy legislation on global warming, as well as potential international law consequences of failure to act …

Weir River Area Of Critical Environmental Concern: Natural Resources Inventory, Urban Harbors Institute, University Of Massachusetts Boston Aug 2002

Weir River Area Of Critical Environmental Concern: Natural Resources Inventory, Urban Harbors Institute, University Of Massachusetts Boston

Urban Harbors Institute Publications

The Weir River Area of Critical Environmental Concern (ACEC) was designated by the Massachusetts Secretary of Environmental Affairs in 1986 in recognition of one of the largest and most productive salt marsh ecosystems in the Boston Harbor area. As an ACEC, the region is afforded additional attention and protection from state agencies in order to achieve the goals of designation--to restore, enhance, and manage the resources. The region was nominated by residents of the abutting communities of Hull, Hingham, and Cohasset who took the opportunity to call attention to the uniqueness of the environment and to their concerns that development …

Software Patents: What One-Click Buy And Safe Air Travel Have In Common, Michael Guntersdorfer

Duke Law & Technology Review

Have you ever sat in an airplane, typing on your laptop, when the darn thing crashes for the one-millionth time? Have you ever then thought about how the airplane you are sitting in is controlled by software, too--the technical term being "fly by wire"--and then started sweating uncontrollably? Software controls not only air traffic but plenty of other safety-critical technologies: the tightrope walk of controlling the chain reaction of radioactive elements in nuclear power plants; the navigation and activation of missiles;3 the moves and cutting-depth of a surgical laser when correcting eye-sights; the list goes on... With such reliance on …
