There are two ways of getting a job done. The person who wants it done can do it himself by his own efforts, management and hired help; or he can bargain with someone else for the desired result. When he hires per- sonal services and retains the management of the enterprise he is called a "master," the person hired is called a "servant," and the master is liable for what the servant does in the master's behalf. Evidentiary Privileges Against The Production Of Data Within The Control Of Executive Departments, William V. Sanford

In the conduct of their affairs the various executive departments and administrative agencies acquire much information--reports, documents, records of all kinds, and other data--which may be useful to litigants in civil and criminal actions. The public interest in a full and fair hearing of all disputes between individuals and between individuals and the state calls for the production and disclosure of all evidence relevant to the issues in dispute.' This public interest calls for the production and disclosure of relevant evidence within the control of executive departments and administrative agencies. In cases involving the sale of real estate, the legal maxim "Caveat Emptor" (Let the buyer beware) is applicable. In sales of personal property substantially the same rule applies.' The buyer in unfair trade cases is not confronted with such a burden and assumes the status of a "bona fide purchaser for value" in its true and literal meaning. Generally speaking courts do not decide unfair trade cases by the caveat emptor rule of buyer and seller.

Injunctive Law Enforcement: Leaven Or Secret Weapon, Frank E. Maloney

The historical development of English law resulted in the division of the law into three main branches: common law, equity, and criminal law. The common law as administered by the king's court developed into a rigid system of formal actions, with relief by way of money damages as the one remedy in personal actions. This development, together with the growth of highly technical rules of pleading, left many situations in which no adequate relief was available in those courts; and the resulting inflexibility of the system led to the growth of equity, under which the king's prerogative might be exercised …

Some Significant Recent Georgia Legislation, F. Hodge O'Neal, James C. Quarles

The General Assembly of Georgia enacted a total of 511 statutes and passed 40 resolutions during the 1949 Regular Session. This legislation covers more than 2,100 printed pages and ranges over many and diverse subjects. Even a cursory discussion of the statutes other than strictly local laws is impossible within the confines of a single law review article. The discussion in this article is therefore limited to four of the more significant statutes. The selection of these four statutes was of necessity more or less arbitrary, but an attempt was made to choose legislation of widespread and lasting interest to …
