The Regular Education Initiative In Light Of Selected State And Federal Court Decisions, Frederick C. Kubicek Jan 1993

The Regular Education Initiative In Light Of Selected State And Federal Court Decisions, Frederick C. Kubicek

Masters Theses

This study begins with a general categorization of the various positions which comprise the ‘Regular Education Initiative.’ The first of these three categories, entitled the 'Little Change' model, calls for the least number of changes within the current delivery system of special education services. The second, the 'Extreme change' model, calls for the total dismantling of the present 'dual delivery' system. The third general heading is that of the 'Moderate change' model. This position calls for a substantial reduction in the number of students being served by 'pull out' programs. These three positions were then analyzed in light of twenty …

An Analysis Of Contracting Terms: Expanding The Body Of Knowledge Within The Contract Management Profession, Marilyn J. Bayless, John H. Padgett Sep 1992

An Analysis Of Contracting Terms: Expanding The Body Of Knowledge Within The Contract Management Profession, Marilyn J. Bayless, John H. Padgett

Theses and Dissertations

This thesis establishes definitions for 50 contracting terms through the use of a detailed methodology comparable to that utilized on past theses of similar intent. Through a thorough review of current literature, existing definitions were examined. Based upon the results of this analysis, proposed definitions were assimilated. Through the use of a mailed questionnaire/survey, the proposed definitions were presented to randomly selected Certified Professional Contract Managers (CPCMs) for feedback. Based upon this feedback, the proposed definitions were then revised to reflect actual current usage of the terminology as indicated by the survey results. These revised definitions are the 'final' definitions …

Defining Contract Terms, Michael J. Cushing, Mary R. Spalding Sep 1992

Defining Contract Terms, Michael J. Cushing, Mary R. Spalding

Theses and Dissertations

The goal of this research effort was to develop consensus definitions for fifty-one (51) contracting-terms. This was accomplished by developing a synthesized definition for each term based on a review of the available published literature, subjecting the synthesized definitions to expert scrutiny via a survey distributed to recognized contracting professionals, and amending the literature-based definitions as indicated by the survey responses. Using this approach, consensus was achieved on all but one term. The consensus definitions developed in this way are recommended for inclusion in a comprehensive dictionary of contracting terminology, to be comprised of the results of this and other …

An Analysis Of Contracting Actions By United States Based Department Of Defense Organizations To Support Operations Desert Shield And Desert Storm, Kathleen E. Killen, Gavin P. Wilson Sep 1992

An Analysis Of Contracting Actions By United States Based Department Of Defense Organizations To Support Operations Desert Shield And Desert Storm, Kathleen E. Killen, Gavin P. Wilson

Theses and Dissertations

This study assembled the experiences of the contracting professionals who supported Operations Desert Shield and Desert Storm from their continental United States based Department of Defense offices. The results of the study show that these professionals actively supported the conflict just as much as the contingency contracting officers who were deployed to the Middle East. No major differences in contracting methods appeared among the different agencies studied. However, the study does suggest that certain regulations should be considered for changes or waivers that go into effect during military contingencies. Also, there are specific training requirements that contracting professionals should receive …

An Analysis Of Contract Cost Overruns And Their Impacts, Brian D. Wilson Sep 1992

An Analysis Of Contract Cost Overruns And Their Impacts, Brian D. Wilson

Theses and Dissertations

This study examines the tendency of major program DoD contracts, once in an overrun status, to remain in that status and in many cases, further deteriorate. In these times of budgetary constraints, it is important that government program managers and other key decision makers understand the ramifications of contract overruns especially early in a program's life. The overruns on the A-12 program, for instance, could have possibly been predicted much earlier and the program cancellation avoided if only the program manager had understood the implications of significant cost overruns early in the life of the program.

The Davis-Bacon Act: Cost Impact On The Air Force, Raymond Carpenter Sep 1992

The Davis-Bacon Act: Cost Impact On The Air Force, Raymond Carpenter

Theses and Dissertations

This study was performed to determine what cost impact, if any, the Davis-Bacon Act has on the cost of Air Force construction contracts. The Davis- Bacon Act is a federal labor statute requiring the payment of pre-established wages to workers employed under Federally funded construction projects. The research found that contract award prices could be approximately 22% lower if the payment of these wages were not required. This estimate was made based on the results of a survey of bidders competing for award of construction contracts issued by bases within the former Strategic Air Command. Additional findings and survey response …

Community & Environmental Health Theses & Dissertations

The purpose of this study was to determine if the Patient Self-Determination Act was effective in providing information to young adults and will young adults not only have an accurate understanding of their health care rights but sufficient opportunity to exercise those rights. From a sample of convenience, 83 college students were randomly selected to complete a questionnaire. The questionnaire contained 71 questions devised to reflect various aspects of the Patient Self-Determination Act. Five additional questions were asked to determine a generalized profile of the students. Data analysis of the responses identified 5 significant legal misunderstandings and 5 significant medical …

Deliberate Response Falsification On Corresponding Subtests Of Two Tests Of Intelligence: Indicators For Simulating Mental Retardation, Denis William Keyes May 1992

Deliberate Response Falsification On Corresponding Subtests Of Two Tests Of Intelligence: Indicators For Simulating Mental Retardation, Denis William Keyes

Special Education ETDs

Among concerns inherent in psychological testing is the possibility that examinees might perform less than accurately or honestly when responding to test items (Lezak, 1983). In context of some legal proceedings, individuals may stand to gain by performing poorly on physiological tests (Anastasti, 1988). For example, defendants could attempt to falsify their answers to impersonate an individual with mental retardation for the purpose of raising issues of incompetence to stand trial, nonresponsibility, or mitigation. In some states, a finding of mental retardation may mean the difference between a life sentence and execution for a defendant convicted of a capital crime. …

Contemporary Piracy And Maritime Terrorism: Towards An Effective International Legal Response, David L. Scott Jan 1992

Contemporary Piracy And Maritime Terrorism: Towards An Effective International Legal Response, David L. Scott

Marine Affairs Theses and Major Papers

Piracy at sea has been a threat which has plagued the mariner since the earliest trading vessels took to the sea more than two thousand years ago. to those outside of the maritime community, the notion of piracy likely conjures up visions of Captain Kidd and Blackbeard, the sort of lifestyle, popularized in the Errol Flynn movies of the 1930x, which has long since passed into history. In reality, violence and robbery at sea is alive and well in certain geographic locations around the globe. In the past decade, the problem of pirate attack upon merchant vessels has become especially …

Merchant Vessel Crew Levels: An American Perspective, Douglas A. Nemeth Jan 1992

Merchant Vessel Crew Levels: An American Perspective, Douglas A. Nemeth

Marine Affairs Theses and Major Papers

This paper, with an emphasis on policies of "effective manning," provides a critical appraisal on the issue of crew levels aboard large merchant vessels (those greater than 1,000 gross tons). Non-traditional approaches to crew organization and management are discussed. Special regard is made to addressing the various domestic and international laws, regulations, and conventions that pertain to ships' manning. The relationship between the seafarer and ships' safety is emphasized as it pertains to reduced crew size. It is argued that U.S. manning laws and regulations should be amended to permit not only smaller crews, but organizational changes aboard ship that …

The Americans With Disabilities Act Of 1990: Implications For The Manning, Operation And Construction Of U.S. Commercial Vessels, Steven M. Stancliff Jan 1992

The Americans With Disabilities Act Of 1990: Implications For The Manning, Operation And Construction Of U.S. Commercial Vessels, Steven M. Stancliff

Marine Affairs Theses and Major Papers

The Americans with Disabilities Act of 1990 adds a new dimension to the body of anti discrimination law in the United States. Encompassing nearly all aspects of employment and public life, it has sent a shock wave of concern throughout the commercial vessels industry. Through examination of the Act's salient features and potential application to commercial vessel operation, manning, and construction, it is concluded that the Act's goals may be substantially achieved without additional risk or significant financial harm to shipowners. The requirements of the Americans with Disabilities Act of 1990 are not considered to be inconsistent with a shipowner's …

The Politics Of Tidelands: A Case Study Of The Massachusetts Chapter 91 Program, Jane Mcnally Wright Jan 1992

The Politics Of Tidelands: A Case Study Of The Massachusetts Chapter 91 Program, Jane Mcnally Wright

Marine Affairs Theses and Major Papers

The Massachusetts Chapter 91 Waterways Program is a licensing program through which the Commonwealth carries out its responsibilities under the Public Trust Doctrine. It was unclear when this study was undertaken whether public participation in the program development process resulted in a different program than the draft program the state originally proposed in 1986. This qualitative case study was developed based on hundreds of pages of letters, comments and testimony from the public, press clippings and interviews. The primary finding is that public participation, particularly from so-called special interest groups, resulted in a final program which was significantly different from …

Problems Of Fisheries Management On The Patagonian Shelf: A Decade After The 1982 Falklands (Malvinas) Conflict, Gustavo A. Bisbal Jan 1992

Problems Of Fisheries Management On The Patagonian Shelf: A Decade After The 1982 Falklands (Malvinas) Conflict, Gustavo A. Bisbal

Marine Affairs Theses and Major Papers

The armed conflict between Argentina and Britain over the Falkland Islands (Islas Malvinas) early in 1982, resulted in a confusing partition of the maritime area around these islands. The military strategies and policies developed by both countries during and after the war created an unclear situation regarding limits and jurisdictions, thus delaying managerial actions and regulation enforcement over the fishing resources of the area. Several foreign fishing fleets operating in the region at the time, took advantage of the lack of protective legislation and recognized authority, resulting in overfishing of species such as squid and hake. No significant control was …

'Peace: A Gift Of God, A Human Task': Toward A Liberation Theology For Northern Ireland, David Miles Moore Jan 1992

'Peace: A Gift Of God, A Human Task': Toward A Liberation Theology For Northern Ireland, David Miles Moore

Honors Theses

PREFACE: I would have to cite the five months I spent in Cork, Ireland as the biggest motivating factor behind this paper. I knew next to nothing about Northern Ireland before this period. Soon after my arrival in Cork, however, I became fascinated with the socio-religious anomaly to the north of me. Since I became a religion major at Colby, I have always been interested in liberation theology. As I read about the poverty, injustice and violence that pervades Northern Ireland, I was reminded of the context in which Gustavo Gutierrez, Tissa Balasuriya, and Elsa Tamez write and live. The …

Harnessing Of Offshore And Deep Sea Fishery Resources In The Exclusive Economic Zone Of Sri Lanka, Ginigaddarage Piyasena Jan 1992

Harnessing Of Offshore And Deep Sea Fishery Resources In The Exclusive Economic Zone Of Sri Lanka, Ginigaddarage Piyasena

Marine Affairs Theses and Major Papers

Sri Lanka declared her Exclusive Economic Zone in 1977, under Section 56 of the Maritime Zone Law No.22 of 1976. With this declaration she extended her jurisdiction over a 500,000 km of sea area as a coastal state. The acquisition of this vast sea area enables Sri Lanka to provide the most needed animal protein requirement of her population by harnessing the fishery resources available in the EEZ. This paper reviews the impact of the declaration of the Exclusive Economic Zone on the offshore and deep sea fish production in Sri Lanka from 1977 to 1990 especially in relation to …

Race, Aggravated Murder, And The Death Sentence In Multnomah County, Oregon, 1984-1990 : A Descriptive Analysis And Review, Patrick Arthur Jolley

Dissertations and Theses

Criminal justice administrators in the United States have been challenged by a highly visible accusation of racial discrimination. This perception has weakened the confidence in, and support of, our judicial process. This study attempted to clarify this perception by examining the effect of race on certain judicial decisions related to the death penalty. The variables chosen for analysis focused on the persons involved in the homicide, the circumstances of the crime, and decisions made during the processing of capital cases.

Estimate-At-Completion Research - A Review And Evaluation, John W. Mckinney Sep 1991

The EAC studies consisted of models, comparison studies, and computer analysis programs. Each study was categorized by formula type and described in terms of methodology and conclusions. Each study was evaluated based on clarity, documentation, methodology, and source. After reviewing the studies some areas were found to be weak. The AFSC formula that uses weighted percentages of .2 SPI and .8 CPI, is not supported by a critical review of the literature. In the area of comparisons studies, different …

Selection Of A Development Methodology For The Acquisition Of Command, Control And Communication Systems, Martin W. Wituszynski Sep 1991

Selection Of A Development Methodology For The Acquisition Of Command, Control And Communication Systems, Martin W. Wituszynski

Theses and Dissertations

This study investigated command and control projects to see if certain program characteristics help determine the appropriate development methodology. A literature search revealed no previous research in this area; but did identify at least two possible development methodologies, and some suggestions for key characteristics. Four case studies were conducted to study the effects of certain characteristics on the success of the development methodology employed; either conventional or incremental. Requirements definition, availability of a previous system, system complexity, number of subsystems, development experience, user involvement, and funding all appear to impact the appropriateness of the two methodologies investigated.

Development Of Single Supply System Stock Funding Procedures For Depot- Level Reparables Under A Centralized General Support Management Activity, Robert E. Spoo

Theses and Dissertations

This study investigated the applicability of adopting a single supply stock funding procedure for depot-level reparables within the Department of the Army. A subjective comparison was made of a major proposal for depot-level reparable stock funding developed under contract by the Logistics Management Institute, in association with the Strategic Logistics Agency, and a modified version of that proposal later submitted by the Strategic Logistics Agency. Each proposal was appraised for its affect on adaptability to a single supply system, centralization of management functions, interoperability with other services, and speed of implementation. Field test results and early studies in stock funding …

An Examination Of The Assumptions Behind Attempts To 'Civilianize' Dod's Acquisition Process, Rolland J. Gagnon Sep 1991

An Examination Of The Assumptions Behind Attempts To 'Civilianize' Dod's Acquisition Process, Rolland J. Gagnon

Theses and Dissertations

This study investigated the validity of a number of assumptions underlying Congressional proposals to form an elite civilian acquisition corps. Specific assumptions examined were (1) civilian personnel in DoD procurement have longer average tenure in specific program positions than their military counterparts, (2) a more centralized civilian acquisition agency (modeled after agencies found in Western European countries) would be more efficient and effective than DoD's current decentralized system, and (3) tenure is positively correlated with organizational effectiveness. A literature review of the latter two issues failed to support these assumptions. Tenure data collected from personnel assigned to Aeronautical Systems Division …

A Contract Management Guide For Air Force Environmental Restoration, Grant S. Bowers Sep 1991

A Contract Management Guide For Air Force Environmental Restoration, Grant S. Bowers

Theses and Dissertations

This study was conducted to examine the extent to which written guidance was available to Air Force contracting officers involved in environmental restoration projects. The study examines literature from sources inside and outside the Air Force, classifies it by source, and extracts guidance from the subject matter. The study indicates that written guidance exists, but is fragmented. As a result, contracting officers lack concise guidance on the special considerations in contracting for environmental restoration. Guidance from the literature is summarized and presented in a stand-along guide appended to the report. The guide is targeted toward new and mid-level contracting officers …

Analysis Of The Expenditure Forecasting Process Within Air Force Systems Command With Emphasis On The Realization Of Expenditures, Timothy R. Thomas Sep 1991

Analysis Of The Expenditure Forecasting Process Within Air Force Systems Command With Emphasis On The Realization Of Expenditures, Timothy R. Thomas

Theses and Dissertations

This study investigated and documented the expenditure process within Air Force Systems Command. Specifically, this study examined the process between the time of obligation and the time of expenditure realization. Data gathered demonstrated no significance for predicting expenditure realizations. The primary focus was a graphic analysis for tendencies in the data. RDT and E appropriation tendencies proved to be similar to those for aircraft procurement appropriations. Obligation size by itself proved to be an unimportant factor in predicting expenditure realizations. The data demonstrated that approximately 85% of obligations will experience an expenditure within three years after the effective data of …

Estimating Potential Cost Growth Of The Most Probable Cost Estimate, Pamela J. Singleton Sep 1991

Estimating Potential Cost Growth Of The Most Probable Cost Estimate, Pamela J. Singleton

Theses and Dissertations

In today's environment of reduced funding it is imperative that an effective method of assessing likely cost growth be available early in the acquisition life cycle, and especially during the source selection process. This research sought to identify a method for predicting the range of cost growth around the most probable cost estimate generated during the source selection process. With the assistance of the Research and Cost Division of Aeronautical Systems Division, three factors were identified to be major contributors to cost growth for ASD programs; technical risk, configuration stability, and schedule risk. The data base consisted of 16 programs …

An Analysis Of The Price Analyst's Role In The Source Selection Process, Rita Lindsey Sep 1991

An Analysis Of The Price Analyst's Role In The Source Selection Process, Rita Lindsey

Theses and Dissertations

This research was conducted to determine if the price analyst's role in the source selection process results in the receipt of efficient contractor proposals and evaluation. The research was limited to the operational level of procurement. A literature review was performed on the evaluation factors used in the source selection process and the role of the price analyst. Interviews were conducted with contracting officers and price analysts experienced in conducting source selections. The research revealed a gap exists between the role of the price analyst as described in the literature and the role described by the field. The price analyst's …
