The March Of Judicial Cosmopolitanism And The Legacy Of Enemy Combatant Case Law, Madalina Lulia Sontrop Jan 2014

The March Of Judicial Cosmopolitanism And The Legacy Of Enemy Combatant Case Law, Madalina Lulia Sontrop

LLM Theses

This thesis explores the concept of judicial cosmopolitanism and its prevalence in enemy combatant case law. The author draws upon the theoretical and philosophical underpinnings of cosmopolitanism and cosmopolitan law to describe judicial cosmopolitanism as form of legal discourse through which judges show a willingness to extend constitutional protections based on a contemporary, functional understanding of sovereign jurisdiction. The purpose of this work is to address the correlation between enemy combatant jurisprudence and the aforementioned understanding of judicial cosmopolitanism. It is argued that a march of judicial cosmopolitanism developed early in enemy combatant cases, and that it came to a …

Informal Transnational Police-To-Police Information Sharing: Its Structure And Reform, Michael Robert Walton Jan 2014

Informal Transnational Police-To-Police Information Sharing: Its Structure And Reform, Michael Robert Walton

LLM Theses

This thesis examines the informal sharing of information and cooperation between police agencies across international borders, and how it is or should be informed by international human rights law. The author looks at how intelligence-led policing theory has affected transnational policing. A distinction is made between police actions made on domestic soil that have adverse consequences abroad and police actions made on foreign soil that have adverse consequences. The first category of cases is firmly within jurisdiction and covered by domestic and international legal obligations. The second category of cases introduces the concept of the extraterritorial application of international human …

Rules Of Disengagement: "Low Skill" Migrant Workers, Law And The Social Dimensions Of Exclusionary Inclusion, Brendan Breckman Jowett Jan 2014

Rules Of Disengagement: "Low Skill" Migrant Workers, Law And The Social Dimensions Of Exclusionary Inclusion, Brendan Breckman Jowett

LLM Theses

This thesis interrogates social exclusion among migrant workers under the NOC C & D (“low skill”) occupational stream of Canada’s Temporary Foreign Worker Program, a relatively new, fast-growing, and highly diverse stream which brings migrant workers into industry sectors and social settings where they were never seen before. The author develops a framework for understanding law’s role in producing social exclusion, and applies it to ethnographic data collected through interviews with migrant justice advocates and migrant workers in Brandon, Manitoba. This thesis ultimately establishes that migrant workers need not face spatial separation, discrimination from the community, or a historically gendered …

A Comparative Study Of Patent Infringement Remedies Related To Non-Practicing Entities In The Courts Of Canada, The United Kingdom, And The United States, Aleksandar Nikolic Jan 2014

A Comparative Study Of Patent Infringement Remedies Related To Non-Practicing Entities In The Courts Of Canada, The United Kingdom, And The United States, Aleksandar Nikolic

LLM Theses

This work examines the scope of non-practicing entity behavior and whether the debate on remedies can lead to changes that encourage the goals behind a patent system. Innovation is often the stated goal but the significance of innovation commercialization is often ignored. Furthermore, there has been an increase in business models that involve alternate means of monetizing patents, not all of which were contemplated in the purpose of the patent system. Using the goals of the patent system as a backdrop, this work provides an overview of the impact of remedies available to courts in Canada, the United Kingdom, and …

Adjudicating Human Rights In Transitional Contexts: A Nigerian Case-Study, 1999-2009 , Basil Emeka Ugochukwu Jan 2014

Adjudicating Human Rights In Transitional Contexts: A Nigerian Case-Study, 1999-2009 , Basil Emeka Ugochukwu

PhD Dissertations

While transitional justice and democracy literature bristles with the expectation that human rights conditions would improve with the progression from the “darkness” of a dictatorship to the “light” of democratic rule, Nigeria’s transition to civil rule in 1999 would seem to provide a sobering contra-reality. Democracy does not seem to have produced a better human rights environment in the post-transition Nigerian context. This dissertation answers the question why the restoration of civil rule in Nigeria has not translated to results in human rights practices that come close to matching the expectations of its citizens and the predictions of transitional justice …

Training Law Enforcement In Mental Health: A Broad-Based Model, Rachael Elaine Hatfield Jan 2014

Training Law Enforcement In Mental Health: A Broad-Based Model, Rachael Elaine Hatfield

Theses, Dissertations and Capstones

Police officers respond to many calls involving people suffering from a mental illness; yet many law enforcement training programs and workshops do not include mental health training. A literature review was conducted to explore the problems resulting from the lack of mental health training available for law enforcement officers and identify specialized training programs currently being implemented to address those problems. The review identified several program models being implemented throughout the United States including: Joint Police/Mental Health Team Model, Mobile Crisis Unit Model, Crisis Intervention Team Model, and the Broad-Based Training Model. These models include empirically supported components used to …

Leadership And Management Training In The North Carolina Judicial System: An Examination Of Identified Need, James E. Hardin Jr. Jan 2014

Leadership And Management Training In The North Carolina Judicial System: An Examination Of Identified Need, James E. Hardin Jr.

Duke Law Master of Judicial Studies Theses

The purpose of this paper is to ask whether North Carolina public service lawyers and judges believe that their judicial districts perform with maximum efficiency or whether there could be functional improvement with leadership and management training for system leaders, and with the perceived need of such training, as articulated by these professionals, what a general training model might look like. A brief examination of the institutionally provided leadership and management training offered to system leaders shows sparse resources are expended to develop leaders and train them so that they have the skills to direct individual organizations and change the …

Analysis Of The Efficacy Of Criminal Court Mediation As A Tool Of Restorative Justice, Teresa Hoerres

Capstone Collection

This capstone research paper aims to capture the personal narratives of how participants of criminal court mediation in Brooklyn, New York actual experience the program. The program, which is facilitated by New York Peace Institute, is a cornerstone of the organization’s restorative justice program. Restorative justice has been gaining traction over the last few decades, and its application to criminal matters as an alternative dispute resolution (ADR) service, is unprecedented.

The research was conducted using a mixed methodology approach, relying on the researcher’s ethnographic observations of the criminal court mediation program from August 2013 through March 2014, as well as …

Recycled Modernity: Google, Immigration History, And The Limits For H-1b, Neil Patten Jan 2014

Recycled Modernity: Google, Immigration History, And The Limits For H-1b, Neil Patten

Electronic Theses and Dissertations

Regulation of admission to the United States for technology workers from foreign countries has been a difficult issue, especially during periods of intense development. Following the dot.com bubble, the Google Corporation continued to argue in favor of higher limits under the Immigration and Nationality Act exception referred to as "H-1B" for the section of the law where it appears. H-1B authorized temporary admission for highly skilled labor in specialty occupations. Congressional testimony by Laszlo Bock, Google Vice President for People Operations, provided the most succinct statement of Google's concerns based on maintaining a competitive and diverse workforce. Diversity has been …

Hispanic Communities And Environmental Justice: A Comparative Study Of Mobility And Exposure To Air Toxics In Houston, Maricarmen Hernandez Jan 2014

Hispanic Communities And Environmental Justice: A Comparative Study Of Mobility And Exposure To Air Toxics In Houston, Maricarmen Hernandez

Open Access Theses & Dissertations

Environmental justice research has focused too little attention on immigrant communities. This study extends from the premise that themes of immigration and mobility among racial/ethnic minority communities must be more carefully analyzed by environmental justice (EJ) scholars. By clarifying why Hispanic people live where they live, and what factors shape their exposures to cancer risks from hazardous air pollutants, this study aims to contribute to the existing EJ body of knowledge. The analysis employs qualitative methods, implemented as part of a larger National Science Foundation-funded study. In-depth semi-structured phone interviews were conducted with randomly selected Hispanic individuals, some of whom …

In Search Of Refuge: Mexican Refugees And Asylum Seekers To The U.S. From 1980 To The Present, Taylor Kristine Levy Jan 2014

In Search Of Refuge: Mexican Refugees And Asylum Seekers To The U.S. From 1980 To The Present, Taylor Kristine Levy

Open Access Theses & Dissertations

An estimated 130,000 Mexicans have been murdered since 2006, with another 27,000 having been officially "disappeared;" approximately 2-3% of the adult Mexican population has been forced to leave their homes due to this violence, many of whom have entered the United States seeking refuge (Molloy, 2013; Olivares, 2012). These refugees have emigrated using a variety of both authorized and unauthorized channels, with a significant (and increasing) number applying for political asylum in the United States (Lyst, 2013). This Thesis seeks to provide a historic background and comprehensive analysis of the identity and struggles of the four types of modern Mexican …

From Commonwealth To Constitutional Limitations: Thomas Cooley's Michigan, 1805-1886, Robert Allan Olender Jan 2014

From Commonwealth To Constitutional Limitations: Thomas Cooley's Michigan, 1805-1886, Robert Allan Olender

SJD Dissertations

In response to what he perceived as the challenges associated with republican governance in the later portions of the nineteenth century, Michigan’s Thomas McIntyre Cooley penned his treatise concerning constitutional limitations on legislative power. In it, Cooley offered a vision of government where courts would check government power and would raise constitutional barriers against the impact of improper influences on legislators. As a student of history, Cooley grounded his beliefs and doctrines in experience, not philosophical reflections. Believing that “the fruits of speculative genius in government are of little value,” Cooley submitted that governing structures and law “must be the …

The Simple Truths Of Safety At Sea For Alaskan Tender Vessels: Feasible Regulatory Changes To Prevent Vessel Casualties In The 17th Coast Guard District Tender Fleet, Olivia Jacobs

CMC Senior Theses

Tender vessels in the United States will soon need to comply with new safety regulations as mandated by the Coast Guard Authorization Act of 2010. This thesis focuses specifically on assisting in the formation of an Alternative Safety Compliance Program (ASCP) for the unique tender vessel fleet and seeks to understand why tender vessels experience fatalities and vessel casualties. By analyzing data of tendermen fatalities and tender vessel casualties between 2000 and 2012, the report sheds light on the realities of these incidents. Among other findings, the data show that the most common cause of vessel casualty was striking rocks …

The Right To Digital Privacy: Advancing The Jeffersonian Vision Of Adaptive Change, Kerry Moller Jan 2014

The Right To Digital Privacy: Advancing The Jeffersonian Vision Of Adaptive Change, Kerry Moller

CMC Senior Theses

The relationship between privacy, technology, and law is complex. Thomas Jefferson’s prescient nineteenth century observation that laws and institutions must keep pace with the times offers a vision for change. Statutory law and court precedents help to define our right to privacy, however, the development of new technologies has complicated the application of old precedents and statutes. Third party organizations, such as Google, facilitate new methods of communication, and the government can often collect the information that third parties receive with a subpoena or court order, rather than a Fourth Amendment-mandated warrant. Privacy promotes fundamental democratic freedoms, however, under current …

Receptivity Of Capital Jurors To Mitigating Factors Of Mental Illness, Intellectual Disability, And Situational Impairments In Death Penalty Decisions : The Capital Trial Analyzed As A Mitigating "Weight And Counterweight" To Premature Decisions And Pro-Death Bias, Leona Deborah Jochnowitz Jan 2014

Receptivity Of Capital Jurors To Mitigating Factors Of Mental Illness, Intellectual Disability, And Situational Impairments In Death Penalty Decisions : The Capital Trial Analyzed As A Mitigating "Weight And Counterweight" To Premature Decisions And Pro-Death Bias, Leona Deborah Jochnowitz

Legacy Theses & Dissertations (2009 - 2024)

This research presents aspects of juror receptivity to mitigating factors of mental, cognitive/intellectual and situational impairments in capital sentencing decisions. The study examined types of mental factors, as well as the gender of defendants, the aggravating nature of the crime and victim vulnerability. An exploratory cross-tabulation analysis evaluated the percentages and relationships between juror closed-ended CJP survey responses to mental sentencing factors and mental evidence presented at trial for 38 cases. While the sample size was too small in some cells for significance testing, the percentages demonstrated patterns. A detailed qualitative analysis of 12 cases with strong evidence of mental …

Marriage And Family Law : Court Centered Legal Development, 1942-2012, Natalie Priya Johnson Jan 2014

Marriage And Family Law : Court Centered Legal Development, 1942-2012, Natalie Priya Johnson

Legacy Theses & Dissertations (2009 - 2024)

The goal of this dissertation was to explore the internal problem solving nature of state courts and thus produce a narrative about court-created legal development. By examining four policy areas related to marriage: divorce/annulment, alimony, adoption/custody and loss of consortium, I show the courts turn to performance as a way to adjudicate questions from individuals and couples operating at the margins of marriage, couples who do not live to the marriage ideal or more broadly the breakdown in the marriage ideal. Through an analysis of four unique policy areas I offer conclusions in this dissertation as to why performance matters …

Talking Rights, Talking Politics : The Development Of Abortion Policy In New York And New Jersey, 1970-2010, Jonathan Parent Jan 2014

Talking Rights, Talking Politics : The Development Of Abortion Policy In New York And New Jersey, 1970-2010, Jonathan Parent

Legacy Theses & Dissertations (2009 - 2024)

Policy can be made by all three branches of government, and the institutional location of change will have an impact on the shape of policy outputs. This dissertation examines the question of what factors will make courts more or less likely to undertake and continue policymaking in a given issue area. In particular, the study presented here considers the development of abortion policy in New York and New Jersey over a forty-year period beginning in 1970. Using both quantitative and qualitative research methods, this work proposes a theoretical framework whereby issue framing, coupled with institutional first movement, will greatly influence …

The Development Of Personal Status Law In Jordan & Iraq, Kelsey Cherland Jan 2014

The Development Of Personal Status Law In Jordan & Iraq, Kelsey Cherland

CMC Senior Theses

This thesis explores the historical development of personal status law, which governs a person’s marriage, divorce, and custody rights. It is significant because it is part of a framework that has defined women’s rights for centuries. I will argue that personal status law is a patriarchal framework that has been reinforced over time, leading up to the creation of nation-states in the Middle East. As such, this is the “institution” of personal status that will be traced using historical institutionalism theory. In this thesis I will argue that personal status has undergone a critical juncture, or crucial moment of potential …

An Analysis Of The Substantive Effectiveness Of The National Environmental Policy Act: Lessons From Ivanpah, Stephanie C. Oehler Jan 2014

An Analysis Of The Substantive Effectiveness Of The National Environmental Policy Act: Lessons From Ivanpah, Stephanie C. Oehler

CMC Senior Theses

Nearly 45 years ago, the National Environmental Policy Act (NEPA) was signed into law to become the first national policy for the environment of the United States. As it has evolved over time through implementation and litigation, numerous countries and states around the world have emulated NEPA with similar environmental impact assessment requirements. Many scholars have evaluated the success of the legislation in accomplishing its lofty goals. Most commonly, however, these studies address the procedural performance of agencies through the creation of environmental impact statements. This thesis examines the effectiveness of NEPA in accomplishing its substantive, rather than procedural, goals …

The Environmental, Social, And Economic Impacts Of Hydraulic Fracturing, Horizontal Drilling, And Acidization In California, Christina Whalen

CMC Senior Theses

The oil extraction mechanisms of hydraulic fracturing, horizontal drilling, and acidization have recently spread throughout the state of California. This thesis explores and assesses whether federal and state legislation should approve of fracking operations in California after studying its effects on human health, the environment, and the economy. This thesis assesses the impacts of fracking; analyzes the role of current legislation and regulation; compares California fracking to fracking in other states and countries; and provides recommendations for future action.

Sex Tourism In St. Thomas, United States Virgin Islands: An Exploratory Study, Elizabeth Estes Jan 2014

Sex Tourism In St. Thomas, United States Virgin Islands: An Exploratory Study, Elizabeth Estes

Department of Conflict Resolution Studies Theses and Dissertations

St. Thomas, United States Virgin Islands, is similar to other tourism dependent Caribbean nations where the tourism industry is dependent upon the `4 S's'- sun, sand, sea, and sex. This researcher posited that the phenomenon of sex tourism exists in St. Thomas as it does in other tourist destinations in the Caribbean like Jamaica, Belize, Costa Rica, Dominican Republic and Barbados (Bailey and Ricketts, 2003; de Albuquerque, 1998; Munshi, 2006; Ryan and Kinder, 1996). The lacuna of any U.S. Virgin Islands sex tourism literature prompted this researcher to conduct an exploratory case study in St. Thomas to learn whether or …

Rationalizing Voter Suppression: How North Carolina Justified The Nation's Strictest Voting Law, Megan C. Raymond Jan 2014

Rationalizing Voter Suppression: How North Carolina Justified The Nation's Strictest Voting Law, Megan C. Raymond

Scripps Senior Theses

In recent years, there has been a dramatic increase in instances of Republican-dominated state legislatures proposing changes to election law that some see as protecting electoral integrity and others understand as intended to suppress votes of traditionally Democratic constituencies. This thesis is a detailed collection of the rationales used to justify these changes, as examined through a case study of North Carolina’s enactment of the omnibus Voter Information Verification Act of 2013 (VIVA). By also including the arguments proffered during the legislative process by opponents of the law, and after evaluating the merits of the arguments on both sides, I …

La Tirania De La Invisibilidad: La Necesidad De Reconocer Y Analizar La Violencia De Genero En La Argentina, Laura Mallison Jan 2014

La Tirania De La Invisibilidad: La Necesidad De Reconocer Y Analizar La Violencia De Genero En La Argentina, Laura Mallison

Scripps Senior Theses

This thesis examines gender violence in Argentina in the context of the historic continuum of gender inequality, with a more in-depth analysis of gender violence during the 1976-1983 dictatorship. I argue that gender violence is perpetuated and normalized by its lack of recognition as a political issue with ramifications extending to daily life. I use the construction of a collective memory of the Dictatorship as a framework for making the intricacies of gender violence more visible and provide a detailed analysis of two laws against gender violence to demonstrate its systematic nature. Ultimately, laws are not sufficient to address such …

The Exclusion Of Improperly Obtained Evidence At The International Criminal Court: A Principled Approach To Interpreting Article 69(7) Of The Rome Statute, Michael Madden Jan 2014

The Exclusion Of Improperly Obtained Evidence At The International Criminal Court: A Principled Approach To Interpreting Article 69(7) Of The Rome Statute, Michael Madden

LLM Theses

This thesis examines article 69(7) of the Rome Statute, which creates an exclusionary rule for improperly obtained evidence at the International Criminal Court (ICC). Ultimately, the thesis proposes how the ICC should interpret its exclusionary rule. The thesis discusses the theory underlying exclusionary rules, the evidence law and remedial law contexts within which exclusionary rules operate, and numerous comparative examples of exclusionary doctrine from within national criminal justice systems. Finally, some unique aspects of international criminal procedure are described in order to demonstrate how an international exclusionary rule might need to differ from a domestic rule, and previous jurisprudence relating …

Detainee Rights And State Obligations: Charting The Shoals Facing The Royal Canadian Navy, Darin Reeves Jan 2014

Detainee Rights And State Obligations: Charting The Shoals Facing The Royal Canadian Navy, Darin Reeves

The thesis discusses the underlying lawful authority for these operations as well as the international law affecting the maritime environment. Next the thesis reviews extra-territorial extension of a State's jurisdiction and the rights and international and Canadian State obligations triggered when an individual is detained together with issues arising from breaches of these rights and obligations. Legal issues found in maritime operations are then analyzed in contrast to the …

Application Of The State Immunity Rule In The International Criminal Justice System: Problems Arising And A Critique Of Legal Response Mechanisms, Celestine Nchekwube Ezennia Jan 2014

Application Of The State Immunity Rule In The International Criminal Justice System: Problems Arising And A Critique Of Legal Response Mechanisms, Celestine Nchekwube Ezennia

LLM Theses

The state immunity rule was founded upon such sound rationales as respect for the sovereign equality of all states and non-interference with state functions. However, its application in the international criminal justice system produces numerous problems. These include impunity for violation of peremptory international legal norms (like the prohibitions on serious international crimes) and violation of human rights. It also undermines the individual accountability and justice administration missions of the system because it shields state officials from criminal responsibility and subjects their victims to injustice. The international community has adopted various legal mechanisms which attempt to respond to these problems …

Guilty Of Homelessness: Evaluating The Criminalization Of Homelessness Through A Human Rights Framework, Cristina M. Semi Jan 2014

Guilty Of Homelessness: Evaluating The Criminalization Of Homelessness Through A Human Rights Framework, Cristina M. Semi

Departmental Honors Projects

Several international treaties and declarations affirm adequate housing as a fundamental human right. However, the United States, while a signatory to several of these agreements, does not recognize this right. Homelessness violates the right to housing. Moreover, homelessness often subjects individuals to additional rights violations. These additional violations often occur because governments criminalize homelessness.

Public order laws that criminalize basic life-sustaining behaviors, such as sitting, lying, and sleeping in public spaces, violate several constitutional rights when applied to unsheltered individuals experiencing homelessness. Devoid of any accommodation aside from the public streets, such individuals must necessarily perform the prohibited conduct in …

When Speech Isn't Free: Legal Barriers And Consequences Of Reporting Sexual Violence, Kevin M. Fleming Jan 2014

When Speech Isn't Free: Legal Barriers And Consequences Of Reporting Sexual Violence, Kevin M. Fleming

Departmental Honors Projects

Incidents of sexual violence continue to be a serious problem for society. Likewise, acts of sexual violence impose severe consequences for survivors. The consequences initially begin at the onset of the survivor’s journey to psychological recovery following the traumatic sexual assault. The consequences take on a unique set of characteristics when the survivor attempts to use the justice system to confront the perpetrator who committed the offense. These characteristics can transform an adversarial process into an isolated battle for the survivor. In the worst cases, the justice system empowers individuals who wish to silence survivors with free speech restrictions instead …
