Barazia Gjinore Në Kosovë, Gani Seferi

Theses and Dissertations

How Has The Practice Of Unilateral Forcible / Military Intervention ( As Evident By The Case Of Kosovo, Tanzania, And Russia) Eroded The Primacy Of Territorial Sovereignty? This Question Is Answered Through The Use Of Three Different Frameworks : 1) Legal Positivism And 2) Normative Hierarchy, 3) Third World Approaches To International Law (Twail)., Sama Eissa

Theses and Dissertations

The principle of state sovereignty; the right of states to exclusive control over their own territory, is seen as an integral part of the current international order... The whole thesis project revolves around the impact of unilateral humanitarian intervention on the primacy of territorial sovereignty. To be more specific, it explores the role played by the emerging norm of unilateral humanitarian intervention and whether or not it washed away the notion of territorial sovereignty mentioned in the UN charter. The main question the thesis project aims to answer is: How has the practice of unilateral forcible / military intervention ( …

Discursive Security: F.B.I. Stings And The Nature Of Peace, Adam Testerman May 2015

Discursive Security: F.B.I. Stings And The Nature Of Peace, Adam Testerman

Dissertations and Theses

The current study utilizes Critical Discourse Analysis and Thematic Analysis to study newspaper coverage of F.B.I. sting operations in The New York Times, Washington Post, and USA Today. F.B.I. sting operations are a modern counter-terrorism policy designed to preempt acts of terrorism. This study develops a theoretical approach to understanding F.B.I. sting operations by reviewing the critique of security. The critique of security suggests that nations construct threats in order to produce and maintain ideological and practical hegemony. Thematic categories of the newspaper discourse are formulated and analyzed in the context of security. The study employs aspects of grounded theory …

A Gender Approach To Vulnerability And Natural Disasters, Ema Izquierdo May 2015

A Gender Approach To Vulnerability And Natural Disasters, Ema Izquierdo

Dissertations, Theses, and Capstone Projects

A natural disaster is a major adverse event resulting from natural processes of the earth that overwhelm local response and affect the social and economic development of the affected region. Natural disasters have been seen as situations that create challenges and difficulties mainly of a humanitarian nature. Still, progressively, it has come to be recognized that a gendered approach to humanitarian response is essential for vulnerable populations such as girls and women. Even though information about particular cases is scarce, evidence indicates that women are more likely to die after a natural disaster not because of biological reasons but because …

Rethinking The Law Of Interrogations And Confessions In Canada, Fariborz Davoudi May 2015

Rethinking The Law Of Interrogations And Confessions In Canada, Fariborz Davoudi

PhD Dissertations

This thesis is a discussion about the inadequacy of the Canadian confessions rule in light of what modern forensic psychology reveals about the human mind, and the propensity of legally-sanctioned interrogation tactics to cause suspects to make false confessions. Contemporary forensic psychology research makes it clear that many of the techniques used in police interviewing and interrogation can have the effect of subverting or overbearing an individuals free-choice and can cause them to make a false confession. Yet many of these same techniques are considered acceptable according to the Canadian law of voluntariness.

This thesis examines the confessions rule and …

Ecodistricts In San Francisco: The Implementation Of Neighborhood Regional Planning And Its Potential Effects On Environmental Resilience, Elizabeth M. Juvera

Master's Projects and Capstones

Ecodistricts, or neighborhood-scale, community-driven areas of sustainable development, have emerged internationally and within the U.S. to create models of adaptive environmental design and advanced urban infrastructure. Central SoMa is the first ecodistrict to be planned and implemented in San Francisco, with the intention of revitalizing and greening this urbanized region of the city. At this time, the Central SoMa area has very low biodiversity levels, inefficient infrastructure, and poor water management capabilities. Through the implementation of ecodistricts in San Francisco, the city can integrate physical and behavioral sustainability measures from existing ecodistricts such as permeable surfaces, green roofs, stormwater management, …

The Management And Stewardship Of A Cetacean Collection, Rebecca Vele

Seton Hall University Dissertations and Theses (ETDs)

Cetacean, by definition, is a marine mammal of the order Cetacea; a whale, dolphin or porpoise. In light of their social intellect and friendly appearance, cetaceans are used in institutions such as zoos and aquariums as a source of education and entertainment for the public. Before the Marine Mammal Protection Act of 1972, cetaceans were captured worldwide including in U.S. waters. In the United States today, there are over 224 zoos and aquariums accredited by the Association of Zoos and Aquariums. Out of those 224, 34 of these institutions display cetaceans.

Indigenous Land Rights Of The Khoi In South Africa, Chelsea Wilkins May 2015

Indigenous Land Rights Of The Khoi In South Africa, Chelsea Wilkins

Senior Honors Projects, 2010-2019

Upon discussions in classes at James Madison University, I became aware of the Khoi people. I became interested in their way of life, as well as the implications of globalization and industrialization worldwide. After researching the topic, I decided I wanted to not only write my thesis on this topic, but I wanted to travel to South Africa to learn more. I wanted to know how a refreshment station at the Cape for the Dutch East India Company transformed into a fight for land that ultimately led to the extreme disenfranchisement of the Khoi people and their way of life. …

The Globalization Of Crime Control: The Use Of Non-Criminal Justice Responses For Countering Organized Crime, Bjarni Halldor Sigursteinsson May 2015

The Globalization Of Crime Control: The Use Of Non-Criminal Justice Responses For Countering Organized Crime, Bjarni Halldor Sigursteinsson

LLM Theses

This thesis examines domestic authorities’ use of non-criminal justice responses to counter organized crime. Examples of responses used to counter outlaw motorcycle gangs in Canada, Germany, and Iceland are provided. These responses are significantly different from most international efforts focusing on criminal norms and cooperation in criminal matters.

As harmonization of legislation, policies and practices in this field become an international focus, I examine the role currently played by the European Union in promoting these non-criminal justice 'alternative' enforcement strategies for the purpose of furthering the development of international and domestic efforts to counter organized crime.

This study concludes that …

Reputational Privacy And The Internet: A Matter For Law?, Elizabeth Anne Kirley May 2015

Reputational Privacy And The Internet: A Matter For Law?, Elizabeth Anne Kirley

PhD Dissertations

Reputation - we all have one. We do not completely comprehend its workings and are mostly unaware of its import until it is gone. When we lose it, our traditional laws of defamation, privacy, and breach of confidence rarely deliver the vindication and respite we seek due, primarily, to legal systems that cobble new media methods of personal injury onto pre-Internet laws. This dissertation conducts an exploratory study of the relevance of law to loss of individual reputation perpetuated on the Internet. It deals with three interrelated concepts: reputation, privacy, and memory. They are related in that the increasing lack …

Dominican And Haitian Relations: Changing Constitutions And Migrant Rights, Tiffany Busch May 2015

Dominican And Haitian Relations: Changing Constitutions And Migrant Rights, Tiffany Busch

Honors Projects

The Dominican Republic and Haiti share the island of Hispaniola. The two nations’ shared history can best be described as tumultuous. The French and Spanish long fought for control over the small island before ultimately becoming two independent nations. Tensions still exist between the nations. The Dominican Republic, operating under antihaitianismo, fears that the influx of Haitian people will be detrimental to the country’s economic and cultural well-being. As a result, deportations have increased. Human Rights Watch has condemned the Dominican Republic for its unethical deportation methods. Moreover, the Dominican Republic enacted a new constitution in 2010 with more …

The Impact Of Realignment On Property Crime: Perspectives Of Chiefs Of Police, Daniel S. Llorens May 2015

The Impact Of Realignment On Property Crime: Perspectives Of Chiefs Of Police, Daniel S. Llorens

Dissertations

Realignment, instituted in October 2011, was California’s latest effort at prison reform by realigning responsibility for prisoners labeled nonviolent, non-serious, and non sex-related from the state to counties. Many of these offenders were in state prison upon conviction of property crime offenses. Realignment had a net decarcerative effect on offenders. Simultaneously, California cities’ officer staffing levels shrunk during the great recession. To determine what impact realignment may have had on property crime in small California cities, and to identify effective response strategies, property crime and officer staffing data was analyzed and a survey administered to the chiefs of those cities. …

The Bankruptcy Abuse Prevention And Consumer Protection Act: An Empirical Examination Of The Act's Business Bankruptcy Effects, Foteini Teloni May 2015

The Bankruptcy Abuse Prevention And Consumer Protection Act: An Empirical Examination Of The Act's Business Bankruptcy Effects, Foteini Teloni

SJD Dissertations

This paper uses a multivariate logistic regression model to examine empirically and quantify for the first time the effect of the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) on the Chapter 11 landscape. Two samples are tested: a general sample consisting of firms from various corporate sectors, and a sample consisting only of retailers. Both studies show that the 2005 amendments had a statistically significant effect on traditional Chapter 11 practice. In particular, post-BAPCPA we observe a rise in rapid dispositions through the form of a sale of all or substantially all debtor assets. Indeed, in the post-amendments era, …

Chapter 11 Duration, Preplanned Cases, And Refiling Rates: An Empirical Analysis In The Post-Bapcpa Era, Foteini Teloni May 2015

Chapter 11 Duration, Preplanned Cases, And Refiling Rates: An Empirical Analysis In The Post-Bapcpa Era, Foteini Teloni

SJD Dissertations

This article empirically examines and quantifies the effect of the Bankruptcy Abuse Prevention and Consumer Protection Act (“BAPCPA”) on three distinct aspects of the Chapter 11 process: a) the duration of traditional Chapter 11 cases; b) the use of prepackaged and prenegotiated bankruptcies; and c) debtor refiling rates. The sample studied consists of companies with more than $100 million in assets that both filed for and exited Chapter 11 between 1997 and 2014. BAPCPA is found to be associated with shorter Chapter 11 case duration, and an increased use of prepackaged and prenegotiated bankruptcies. Additionally, BAPCPA is found to be …

Preserving Value In The Post-Bapcpa Era — An Empirical Study, Foteini Teloni May 2015

Preserving Value In The Post-Bapcpa Era — An Empirical Study, Foteini Teloni

SJD Dissertations

Through the use of a multivariate regression model, this article studies the effect on debtor reorganization values of the shortened reorganization timeframe imposed by the Bankruptcy Abuse Prevention and Consumer Protection Act (“BAPCPA”). The study shows that BAPCPA is positively correlated at a statistically significant level with higher reorganization recoveries. This result is attributed to the increased proportion of prepackaged and prenegotiated bankruptcies observed in the post-2005 era, as these “fast-track” bankruptcy cases entail lower costs and better preserve the firm’s value.

Commuting Life Without Parole Sentences: The Need For Reason And Justice Over Politics, Jing Cao May 2015

Commuting Life Without Parole Sentences: The Need For Reason And Justice Over Politics, Jing Cao

SJD Dissertations

In the last thirty years, life without parole (LWOP) sentences have flourished in the United States. Of course the very reason for a LWOP sentencing scheme is to incarcerate the convicted defendant until death. But under the Pardon Clause of the Constitution, as well as under state laws granting the Governor the pardoning power, inmates serving LWOP sentences might be eligible for early release by commutations. On the one hand, the possibility of clemency could be regarded as an impermissible loophole that could be used on a case-by-case basis to undermine the certainty of a LWOP sentencing system. On the …

Quality Of State Attorneys' Oral Arguments In Supreme Court Litigation, Kaylee Johnson May 2015

Quality Of State Attorneys' Oral Arguments In Supreme Court Litigation, Kaylee Johnson

Undergraduate Honors Capstone Projects

In my thesis, I evaluate the conventional wisdom that attorneys representing state governments performed poorly in oral arguments before the Supreme Court. This led the National Association of Attorneys General in 1982 to create the Supreme Court Clearinghouse Project. The project was implemented in an effort to improve the quality of states' efforts before the Court. Pulling from Justice Blackmun's ratings of attorneys in oral arguments, I conduct a quantitative analysis to determine whether such efforts actually led to an improvement in states' performance in Supreme Court litigation. I take the 1,142 cases in which states were involved from 1970-1993 …

Chinese Foreign Direct Investment In The Caribbean, Kimberly A. L. T. Stephenson May 2015

Chinese Foreign Direct Investment In The Caribbean, Kimberly A. L. T. Stephenson

Honors College Theses

The purpose of this study is to examine the influence of trade patterns and market size in a short time period, in order to identify indicators of the objectives for Chinese foreign direct investment (FDI) into the Caribbean region. Key questions assessed are: What makes the Caribbean particularly advantageous for Chinese investors and how does the host country benefit? Is a higher level of trade, or wealthier markets, associated with higher Chinese FDI? Is China pursuing some foreign policy objectives with FDI in the region? I hypothesize that Chinese FDI is associated with trade, natural resources, or certain foreign policy …

Legal Education Reform In Saudi Arabia: A Case Study Of Taibah University, Rayan Alkhalawi

Maurer Theses and Dissertations

Legal education reform is a hot topic today. However, legal educators generally avoid discussing this important topic. Although legal education in Saudi Arabia is unique and complex, it is very hard to find academic literature about it. While this paper provides a brief explanation of legal education in Saudi Arabia, the main purpose of this paper is to discuss whether or not the current program at the College of Law prepares graduates for the best opportunities available in the legal market. And if not, how it could do a better job of making the program reach its full potential to …

From The Savings And Loan Association Crisis Of The 1980s To The Dodd-Frank Wall Street Reform And Consumer Protection Act: The Effect Of The Dodd-Frank Act On U.S. Thrifts And The Lesson For The Korean Savings Bank Crisis, Beumhoo Jang

Maurer Theses and Dissertations

The subprime mortgage crisis occurred in the United States in 2008, which struck the U.S. economy tremendously, and moreover, the world’s economy. In response to the crisis, the U.S. government enacted the Dodd-Frank Wall Street Reform and Consumer Protection Act. The Act, however, focused mainly on enhancing regulatory systems rather than considering how the Act affected small-scale financial institutions, including thrifts, which play a major role in the U.S. local housing development industry.

In addition, the Act did not accord with the principles of the Government Accountability Office, and left certain regulatory measures intact, including the Qualified Thrift Lending test. …

The Snowden Effect: The Conflict In A Free Society, Who Values Privacy Versus Who Values Security?, Matthew C. Blake May 2015

The Snowden Effect: The Conflict In A Free Society, Who Values Privacy Versus Who Values Security?, Matthew C. Blake

Political Science Theses and Capstones

The Obama Administration has come under scrutiny by both the public and Congress, since former National Security Agency (NSA) contractor Edward Snowden made known the scope of government surveillance programs being utilized by the U.S. government to gather intelligence on domestic citizens. Snowden’s disclosures about the government’s surveillance practices to the mainstream media began in June 2013. I focus on how public opinion towards the government’s surveillance practices and an individual’s reasonable right to privacy has shifted after revelations made by Edward Snowden on the practices of the NSA. Individuals may show support for more government surveillance in the name …

Enhancing The Compensatory Roles Of Financial Regulatory Agencies In South Korea: Lessons From The U.S. Sec's Fair Fund, Daeil Kim

Maurer Theses and Dissertations

Recent financial scandals in South Korea that caused massive harms to financial consumers instigated voices that financial regulators should play a more active role in recompensing victims for losses incurred by misconduct in the financial market. In this regard, this thesis aims to suggest several considerations in developing the compensation scheme for injured financial consumers in Korea. This thesis first reviews the Federal Account for Investor Restitution (FAIR) Fund operated by the U.S. Securities and Exchange Commission. Specifically, it broadly addresses the history, overall process, operation, and major issues related to the FAIR Fund. Based on the FAIR Fund review, …

Regulating The Dead: Rights For The Corpse And The Removal Of San Francisco's Cemeteries, Lance Muckey May 2015

Regulating The Dead: Rights For The Corpse And The Removal Of San Francisco's Cemeteries, Lance Muckey

UNLV Theses, Dissertations, Professional Papers, and Capstones

A specialized facet of American common law developed throughout the nineteenth century; that being mortuary law or the law of the corpse. This jurisprudence transferred limited property rights to dead bodies, which was a radical departure from the treatment of the dead under the English common law tradition that the United States had adopted after the American Revolution.

The dead fit into a unique category in law. Legally they do not exist and therefore have no voice. It thus falls to the state to speak for them in the form of statutes and judicial decisions, which represents a continuation of …
