Breaking The Legacy: Recognizing And Prosecuting Sexual Violence As A Violation Of Human Rights In The Democratic Republic Of The Congo, Miranda L. Weinstein May 2016

Breaking The Legacy: Recognizing And Prosecuting Sexual Violence As A Violation Of Human Rights In The Democratic Republic Of The Congo, Miranda L. Weinstein

Sustainability and Social Justice

This paper aims to outline the existing policies aimed at providing protection for sexual abuse survivors in the Democratic Republic of the Congo. In an attempt to provide justice for the survivors of sexual abuse, an analysis of the 1992-1995 Bosnia and Herzegovina post-conflict reconstruction is included. In particular, prosecution of sexual violence and rape as a weapon of war will be provided in order to weigh the benefits and weaknesses of international criminal law. The conflict in eastern Democratic Republic of the Congo witnesses widespread and systematic sexual violence abuses. With over 60 armed groups at any given day, …

Nuclear Power Plant Policy Comparison Between The U.S. And Republic Of Korea, Vara Ha May 2016

Nuclear Power Plant Policy Comparison Between The U.S. And Republic Of Korea, Vara Ha

Sustainability and Social Justice

Five years after the Fukushima accident, people and countries still argue about the opportunity costs of denuclearization. While nuclear power generation has safety and waste issues, it is carbon free. Climate change has created more pressure for greenhouse gas reduction, so a few countries have decided to maintain or even increase nuclear power generation. The United States ranks first for using nuclear power produced by electricity generation, while the Republic of Korea, the closest country in proximity to Japan, ranks fourth in countries that use nuclear power. In fact, Korea even rapidly increased nuclear business after the Fukushima accident. Despite …

The Priorities And Accomplishments Of Kentucky Legislators : Is There A Gender Difference?, Amanda Allen May 2016

The Priorities And Accomplishments Of Kentucky Legislators : Is There A Gender Difference?, Amanda Allen

College of Arts & Sciences Senior Theses

This thesis uses Kentucky as a case study of gender differences in the policy priorities and perceptions of accomplishments of state legislators. The research question is, “are there gender differences in the legislative priorities and perceptions of accomplishments of Kentucky legislators?” The legislative priorities of the legislators seemed to be similar, along with their own classification of women’s issues. The perceptions of success demonstrated that male legislators were not necessarily more likely to attribute success to themselves, whereas women would attribute success to collaboration efforts. The research was completed through confidential interviews with Kentucky legislators and analysis of the 2015 …

Aging American Prisons: Length Of Stay, Dying Behind Bars, And Implications For Public Health, Stephanie G. Barger May 2016

Aging American Prisons: Length Of Stay, Dying Behind Bars, And Implications For Public Health, Stephanie G. Barger

Sociology and Criminology Undergraduate Honors Theses

One notable consequence of mass incarceration is the growing population of elderly prison inmates in the U.S. This growth raises questions concerning the causes and implications of such a change, as housing older prisoners places a financial strain on state and federal correctional systems. Because this added cost is largely a result of medical needs, the growing elderly inmate population has raised questions about the impact of incarceration on health. This study investigates the causes of this “graying” of American prisons and its potential effects on correctional and community health. Using National Corrections Reporting Program data from 1990 to 2009, …

The Inter-American Court Of Human Rights: Emerging Patterns In Judgment Compliance, Shelom Velasco May 2016

The Inter-American Court Of Human Rights: Emerging Patterns In Judgment Compliance, Shelom Velasco

Maurer Theses and Dissertations

The Inter-American Court of Human Rights (ICHR) is one of the central institutions promoting adherence to fundamental human right norms in the Americas, yet States fully comply with only 5% of its judgments. This low rate of compliance threatens the Court’s effectiveness and undermines the legitimacy of this regional human rights system. This dissertation analyzes the problem of noncompliance with ICHR judgments. Furthermore, it connects the problem of noncompliance and existing explanations in the ICHR with broader theories from the study of international relations in order to ground this regional case study in the larger debates about international legal norms …

Obergefell V. Hodges And Support For Same-Sex Marriage : Changes In National And State Public Opinion., Adria Neal May 2016

Obergefell V. Hodges And Support For Same-Sex Marriage : Changes In National And State Public Opinion., Adria Neal

College of Arts & Sciences Senior Theses

Many have argued that Supreme Court decisions on culture war issues, issues that cause conflict between conservative and liberal values, stifle public progression on the very problems they are meant to resolve. They often cite political and electoral backlash following a decision as evidence of this stagnation in opinion. However, this backlash may not be representative of widespread public opinion. In order to understand the relationship between Court decisions and public opinion, changes in opinion on culture war issues following a Supreme Court ruling must be measured. This study utilizes national and state survey data in order to examine this …

Examining The Relationship Between Physical And Sexual Abuse And Mental Illnesses Among Female Inmates: Revising The Mental Health Care Process In Prisons, Josie Klepper

Undergraduate Honors Theses

Females are becoming a prominent population within America’s correctional facilities, which has led to incarcerated females increasingly becoming the popular subjects of more recent research. Along with the growing population of female inmates, the rates of sexual and physical victimization reported by incarcerated females is rapidly growing. The purpose of this project is to evaluate the pre-established correlation between mental health diagnoses, and the prior physical and/or sexual abuse of female inmates within the custody of correctional institutions, outline the current treatment process, and devise a revision of the treatment process in order to improve the future of mental health …

Access Versus Success: An Examination Of The Effectiveness Of The Summer Developmental Program In Mississippi Higher Education, Amanda Susanne King May 2016

Access Versus Success: An Examination Of The Effectiveness Of The Summer Developmental Program In Mississippi Higher Education, Amanda Susanne King

Dissertations

Historical racial segregation within Mississippi’s public universities and colleges has led to litigation that spanned 25 years and eventually led to sweeping changes in policies and practices. Among these changes were the standardization of admission criteria and the creation of the Summer Developmental Program (SDP). This study sought to better understand the intentions and motives behind the creation and implementation of the SDP at all of the four-year public institutions in Mississippi stemming from the United States v. Fordice (1992) higher education desegregation case. This study compared retention and graduation rates of SDP participants to non-SDP participants from the first …

A Comparison Of Ontario's Accessibility For Ontarians With Disabilities Act And The Canadian Copyright Act: Compliance, Enforcement, Risks, And The Implications For Ontario Community Colleges, Meaghan Shannon Apr 2016

A Comparison Of Ontario's Accessibility For Ontarians With Disabilities Act And The Canadian Copyright Act: Compliance, Enforcement, Risks, And The Implications For Ontario Community Colleges, Meaghan Shannon

Master of Studies in Law Research Papers Repository

The Accessibility for Ontarians with Disabilities Act [AODA] confers rights of accessibility by detailing how individuals and organizations offering goods and services should comply and monitoring compliance through the Accessibility Directorate of Ontario. By contrast, the federal Copyright Act confers rights upon authors and other rights owners without detailing how users of works and other materials can achieve compliance with the Act and without establishing an administrative body to monitor compliance. This research, through a case study of a community college, compares and contrasts the implications of the two different legislative styles in terms of the risks borne by affected …

The dissertation studies and analyzes current Saudi M&A laws with reference to comparative models from different countries and provides recommendations to improve the transparency and efficiency of Saudi Arabia’s M&A laws. Such improvements may help companies attempting to conduct M&A activity in Saudi Arabia address certain barriers and difficulties, which may in turn help to stimulate the Saudi Arabian economy.

Saudi Arabia is considered one of the world’s foremost emerging markets. Since Saudi Arabia joined the World Trade Organization, its stock market has been growing quickly, including rapid …

Formulating New Models In The More Guns, Less Crime Debate, Justin Shane Carothers Apr 2016

Formulating New Models In The More Guns, Less Crime Debate, Justin Shane Carothers

Student Theses and Dissertations

Recent statistical studies suggest that the presence of right to carry (RTC) laws increase crime on all fronts. Like many before it, this debate hinges on model specification and our ability to conceptualize real world mechanisms into social science models. I evaluate and modify previous economic models concerning the “More Guns, Less Crime” hypothesis in order to test those findings. I also expanded previous panel data that originally ended in 2006 with the most up to date uniform Crime Reporting (UCR) data and created a new open-carry dummy variable. Each model uses data from 1970 to 2013 for all fifty …

Trading Ahead Of Bad News: Evidence From Short-Sales Of Stocks And The Options Market, Nicholas E. Macksoud Apr 2016

Trading Ahead Of Bad News: Evidence From Short-Sales Of Stocks And The Options Market, Nicholas E. Macksoud

Business and Economics Honors Papers

Throughout the past ten years, the United States Environmental Protection Agency (EPA) has issued hundreds of enforcement actions in the electric, natural gas, and petroleum industries. The vast majority of these citations have been violations of environmental statutes, notably the Clean Air Act (CAA) and the Clean Water Act (CWA). My research evaluates the timing of informed investors’ actions pertaining to the public release of these EPA announcements. Since informed traders have much more leverage in the options market, there seems likely to be a concentration of abnormal put option activity shortly before the time in which the announcements reach …

Allied Paper Landfill, A Case Study Of Superfund, Kaitlin Braunschweig Apr 2016

Allied Paper Landfill, A Case Study Of Superfund, Kaitlin Braunschweig

Honors Theses

The Comprehensive Environmental Response, Compensation, and Liability Act (1980), more commonly known as Superfund, delegates the responsibility for cleanup of more than 1,300 hazardous waste sites to the federal Environmental Protection Agency (EPA). This thesis is designed as a case study to investigate the Superfund program through the lens of the Allied Paper Landfill portion of the Kalamazoo River Superfund Site. Through interviews with key stakeholders an evaluation was completed based on the following research questions: 1) are the current goals of Superfund appropriate, 2) is the funding mechanism sufficient to fulfill the goals of Superfund, and 3) is the …

Professional Discretion And The Law: Impact Of Actuaries On The Underfunding And Decline Of Private Sector Single Employer Defined Benefit Pensions In Canada: How Many "Post Nortel" Pension Fiascos Are Brewing In Canada?, Paul Charles Walker Apr 2016

Professional Discretion And The Law: Impact Of Actuaries On The Underfunding And Decline Of Private Sector Single Employer Defined Benefit Pensions In Canada: How Many "Post Nortel" Pension Fiascos Are Brewing In Canada?, Paul Charles Walker

LLM Theses

Considering that private sector single employer defined benefit pension plans must be fully funded by law, the legal issue emanating from their systemic underfunding is whether or not actuaries have been using their discretion in a manner which is within a reasonable interpretation of the margin of manoeuvre contemplated by the legislature, in accordance with the principles of the rule of law. This thesis discusses the merits of potential legal remedies to arrest the underfunding and decline in the number of private sector single employer defined benefit pensions in Canada, including the introduction of single employer target benefit plans, increasing …

Confronting (In)Security: Forging Legitimate Approaches To Security And Exclusion In Migration Law, Angus Gavin Grant Apr 2016

Confronting (In)Security: Forging Legitimate Approaches To Security And Exclusion In Migration Law, Angus Gavin Grant

PhD Dissertations

Perceived connections between security concerns and migration are a central preoccupation of our time. This dissertation explores how the preoccupation has played out in the Canadian context and asserts that a basic and common infirmity of administrative decision-making in this domain is a lack of justification. The dissertation commences by exploring foundational debates within immigration theory about borders, exclusion, the rule of law and the role of justification in decision-making in liberal democracies, particularly in times of perceived emergency. From there, the dissertation moves on to an exploration of immigration inadmissibility determinations in Canada, with particular attention to the emergence …

Corruption In International Arbitration, Inan Uluc Apr 2016

Corruption In International Arbitration, Inan Uluc

SJD Dissertations

Corruption represents a great menace to national and international development. It jeopardizes democracy, human rights, and social justice. Consequently, corruption is vehemently abhorred and denunciated by members of the international arbitration arena. Unfortunately, while these players purport repugnance towards corruption and do not condone corrupt acts, there has arisen a misplaced distrust of arbitral process as a proper dispute resolution system. Further, when amalgamating the inherent opaqueness of the arbitral process, its structure founded upon party autonomy, and the clear lack of authority for arbitrators to compel evidence, such distrust persists and encourages belief that arbitration is a venue where …

Who's In Charge Of Whom? A Study Into The Deference Paid By Federal Court Judges To Executive Agencies, Andrew Smallwood Apr 2016

Who's In Charge Of Whom? A Study Into The Deference Paid By Federal Court Judges To Executive Agencies, Andrew Smallwood

Honors College Theses

With judicial decisions instigating much of the immediate political changes in recent history, this study delves into the relationship between a judge’s tenure on the bench as well as other contributing factors, such as political ideologies, and the decision in cases relevant to politically charged agencies. This purposeful study into the United States Court of Appeals, District of Columbia Circuit, attempts to isolate specific determinants in cases involving the National Labor Relations Board and the Environmental Protection Agency. Logistic Regression analysis is used to determine the existence of possible relationships between judicial behavior and factors such as prior executive experience …

Having A Say: Democracy, Access To Justice And Self-Represented Litigants, Jennifer Ann Leitch Apr 2016

Having A Say: Democracy, Access To Justice And Self-Represented Litigants, Jennifer Ann Leitch

PhD Dissertations

Access to Justice is one of the most contested issues on the law-and-society agenda. There is a long-standing exchange over its meaning, objectives, and success. Beneath that engagement, there is a deeper and more basic debate about the overall ambitions for access to justice: is the goal to improve peoples access to the legal process and generate more positive outcomes (the practical thesis), or to enhance peoples participation and ultimately their ability to affect justice as an end in itself (the democratic thesis)? This thesis adopts the latter approach.

The plight of self-represented litigants (SRLs) offers a revealing glimpse into …

Extending Graham's Interpretive Theory Into Common Law: A Multiple-Case Study, Chris Hayes Apr 2016

Extending Graham's Interpretive Theory Into Common Law: A Multiple-Case Study, Chris Hayes

Master of Studies in Law Research Papers Repository

What determines the outcome of judicial decisions? A traditional answer to this question is that it involves a complex application of rules derived from the reasons for judgment of analogous common law decisions and applicable statutes under the doctrine of stare decisis. This answer is problematic. One significant problem of this answer is its inability to explain the outcome of cases where the judgment does not appear to be based on these traditionally recognized sources. An alternative answer, provided by a particular field of legal scholarship, Legal Realism, posits that “other” factors make a significant impact on the outcome …

Legal Approaches To Combating Sex Trafficking: A Compilation Of Research And A Comparative Analysis Of The Most Effective Means Of Reducing Trafficking Globally, Emily Ann Larkins Apr 2016

Legal Approaches To Combating Sex Trafficking: A Compilation Of Research And A Comparative Analysis Of The Most Effective Means Of Reducing Trafficking Globally, Emily Ann Larkins

Selected Honors Theses

This research explores the relationship between three important factors necessary for reducing sex trafficking globally through a comparative analysis of four specific countries and their success in addressing these factors. The three factors that will be discussed in their relation to sex trafficking are government cooperation, border control, and illegalization of prostitution. These factors were chosen based on how consistently they showed up in research done for this thesis. The countries chosen for analysis-Sweden, the Netherlands, Thailand, and Singapore- were chosen based on region, trafficking levels, and unique facts that stood out as potentially significant. As will be discussed, Sweden …

The California S.T.E.P. Act: Prosecuting Fraternities As Criminal Street Gangs, Courtney Lee Spears Apr 2016

The California S.T.E.P. Act: Prosecuting Fraternities As Criminal Street Gangs, Courtney Lee Spears

Undergraduate Honors Theses

This thesis project examines the similarities in structure, initiation processes, af liations, and motivations for joining both criminal street gangs and fraternities. These similarities serve as the foundation for the central idea of the thesis: using California’s street gang legislation, mainly the S.T.E.P. Act, to more severely prosecute fraternities for their crimes. My application of the legislation is supported through both comprehensive gang data, as well as case studies of fraternity crimes, as comprehensive data for this group does not exist. My research has important implications, as recent legislation serves to protect fraternity offenders from facing punishment for their crimes, …

Contributions Of The Jesuits To Human Rights In Mexico: A Case Study Of Center Miguel Agustin Pro Juarez, Luis Arriaga Valenzuela Apr 2016

Contributions Of The Jesuits To Human Rights In Mexico: A Case Study Of Center Miguel Agustin Pro Juarez, Luis Arriaga Valenzuela

LMU Theses and Dissertations

In Mexico, as in other parts of the world, human rights violations have deep historical roots. In the forty years before this study, these violations had been increasing, especially with respect to excluded populations and vulnerable groups, such as women, indigenous peoples, migrants, and victims of repression (Center Prodh, 2013). To reverse or at least decrease these conditions, disenfranchised people needed to become aware of their rights within civil society. Toward that end, diverse non-governmental organizations (NGOs) had taken on the task of providing education and strategic practices to disenfranchised people and communities. The Society of Jesus (the Jesuits) had …

Humanitarian Intervention: Determining The Effectiveness Of Outsourcing Humanitarian Intervention During Humanitarian Crises, Clarissa Caola Apr 2016

Humanitarian Intervention: Determining The Effectiveness Of Outsourcing Humanitarian Intervention During Humanitarian Crises, Clarissa Caola

Political Science Theses and Capstones

At the end of the Cold War we witnessed a growing reluctance on part of many national powers to intervene in international crises. This unwillingness allowed for the development of Private Military and Security Companies (PMSCs). PMSCs have been deployed to provide a wide variety of security-related functions including combat, logistics, training programs, and armed guarding of personnel and infrastructures. Exploring the concept of outsourcing these military functions, others have applied the idea towards addressing humanitarian crises. PMSCs may face fewer geopolitical impediments that can hinder the efforts of many state actors. In certain humanitarian crises PMSCs may better address …

Schoolwide Services For Students That Attend Private Schools: A Policy Recommendation To The Every Student Succeeds Act, Dr Shandowlyon L. Hendricks-Williams Apr 2016

Schoolwide Services For Students That Attend Private Schools: A Policy Recommendation To The Every Student Succeeds Act, Dr Shandowlyon L. Hendricks-Williams

Dissertations

The Elementary and Secondary Education Act (ESEA) of 1965, reauthorized under the Every Student Succeeds Act (ESSA) of 2015, provides federal funding for equitable services to nonpublic school students, families and teachers. This act was signed by President Obama on December 10, 2015 and replaces No Child Left Behind (NCLB). As it relates to private schools, the reauthorization of ESEA mirrors NCLB in all areas but three: (1) set asides discontinued; (2) state appointed ombudsman; and (2) state as the provider of services. Upon reviewing the reauthorized law, I found an area that allows for inequitable services to students who …

Examining American Attitudes On The Use Of Military Drones, Todd Brandon Apr 2016

Examining American Attitudes On The Use Of Military Drones, Todd Brandon

Political Science Theses and Capstones

Recent polls have revealed that Americans of both the political left and right support the use of military drones. This statement stands true among groups who traditionally do not support the use of military force. I hypothesize that people of a more liberal persuasion will be more concerned with whether or not the drone program endangers innocent civilians, while those of a more conservative view will be more concerned with the legality of conducting military drone strikes. I analyze data obtained from the Pew Research Center to examine people's attitudes on military drone strikes via framing theory. My hypothesis has …
