Exploring Refugee Administration Systems In Egypt, Jordan, And Uganda: A Comparative Study, Noura El Guindy Jan 2021

Exploring Refugee Administration Systems In Egypt, Jordan, And Uganda: A Comparative Study, Noura El Guindy

Theses and Dissertations

In this study, I compare three refugee administration models in the global south to one another: Egypt’s, Jordan’s, and Uganda’s. This research is conducted at what I believe is a curious moment of history, where host countries in the global south are encouraged by wealthier states to accept aid in exchange for keeping migrants in the south. In these circumstances, refugee administration models in host countries continue to operate, and new political approaches arise, such as the “Jordan Refugee Compact”. The aim of the comparative study is to spot both the successes and failures of each model in the three …

The Integration And Securitization Of Muslim Migrants In Europe, Yasmeen Nawwar Jan 2021

The Integration And Securitization Of Muslim Migrants In Europe, Yasmeen Nawwar

Theses and Dissertations

In its efforts to integrate newly entering migrants into their societies, Europe has established integration policies that negatively impact these migrants, especially those from racialized backgrounds. The policies mask an agenda of securitization against outsiders who are falsely considered to be a danger to national security and national identity. Since the 9/11 attacks on the World Trade Center in the United States, many Western countries, including European countries, began to build a culture of fear against Muslims. Europe began to increasingly associate migrants with problems such as trafficking, radicalization, and terrorism. As a result, Europe began to treat migration as …

The Legal Framework Of Apostasy In Egypt: A Manifestation Of Secular Reconstruction Of Sharia By A Modern State, Ahmed Sedky Mohammed Jan 2021

The Legal Framework Of Apostasy In Egypt: A Manifestation Of Secular Reconstruction Of Sharia By A Modern State, Ahmed Sedky Mohammed

Theses and Dissertations

The legal consequences of renouncing Islam or apostasy, which include depriving the apostate from some civil rights, and the non-recognition of the act itself by law in Egypt have been usually criticized as a blatant violation of the right to religious freedom. Such criticisms are based on the right’s definition according to international human rights law precisely the International Covenant on Civil and Political Rights. The dominant reasoning for this violation according to the majority of the related literature is the conservative interpretation of Sharia, the principal source of law, that has been adopted by Egyptian judiciary for more than …

When Shari'a Becomes A Science Of Law, Heba Sewilam Jan 2021

When Shari'a Becomes A Science Of Law, Heba Sewilam

Theses and Dissertations

The Sharīʿa codification, privatization and reconciliation present three reform movements to scientize Sharīʿa in the manner of liberal positivism. The scientism of Sharīʿa makes Islamic law predictable, rational and objective. Its final goal is to protect Sharīʿa from the political encroachments of the ruling elites and facilitate Sharīʿa implementation in a post-colonial era. The three reform movements are, however, incapable of harmonizing Sharīʿa with the liberal norms of a scientized law. Sharīʿa codification makes the law predictable but neglects Sharīʿa’s undemocratic methods of decision-making. Sharīʿa-compliant legislation is still the monopoly of the Muslim jurists and the ruling caliph. Sharīʿa privatization …

The Basha's Tools? Imagining Alternative Justice Futures In Egypt, Farah Ghazal Jan 2021

The Basha's Tools? Imagining Alternative Justice Futures In Egypt, Farah Ghazal

Theses and Dissertations

The dominant approach to addressing violence against women in Egypt today is carceral, or relying on the punitive instruments of the state to achieve justice (most visibly represented by the prison and police). While carceral responses are perhaps unsurprisingly advocated by state feminism, they are also promoted by what would typically be described as anti-state actors. This paradoxical entanglement takes place during what I identify as the 'carceral moment', a period marked by the intensification of political and social repression and during which incarceration appears more readily available as a solution to remedy perceived problems of governance. I argue that, …

Policy Implications Of Refugee Education In Urban Settings: A Case Study Of The Experience Of Refugee Community-Based Schools In Cairo, Dawood Mayom Jan 2021

Policy Implications Of Refugee Education In Urban Settings: A Case Study Of The Experience Of Refugee Community-Based Schools In Cairo, Dawood Mayom

Theses and Dissertations

Egypt hosts asylum-seekers and refugees originating from a large number of countries. Many refugees find themselves living in urban settings, and education and access to schools across various levels have increasingly become challenging for children. This study focuses on refugees’ education between the years 2011-2020 in Cairo. During these years, the number of students increased by five times, making the provision of education a challenging endeavor. The research aims to explore and understand the multiple barriers to Community-Based Refugee Education in Urban Egypt. This study used a qualitative case study because of its relevancy to this topic and context. The …

The Palestinian Refugee Regime: Tensions Between The Collective Right Of Return And Individual Rights, Shatha Oqab Abdulsamad Jan 2021

The Palestinian Refugee Regime: Tensions Between The Collective Right Of Return And Individual Rights, Shatha Oqab Abdulsamad

Theses and Dissertations

Since their initial displacement in 1948, the United Nations had devised a special temporary refugee regime for Palestinians, distinct from the international refugee regime. The distinct regime was structured in order to acknowledge Palestinian displacement as a result of a deliberate policy of state building by Israel as a national home for Jewish people in Palestine, as well as the effect of the United Nations Partition Plan. Premised as different from other refugee problems, the distinct regime devised for Palestinians was intended to be temporary, pending a final settlement that ensures their repatriation. The temporality and structure of the distinct …

Transformational Leadership, Conflict Management Style, And Job Satisfaction In Law Enforcement, Giuseppe Alise Jan 2021

Transformational Leadership, Conflict Management Style, And Job Satisfaction In Law Enforcement, Giuseppe Alise

Seton Hall University Dissertations and Theses (ETDs)

Abstract

Effective leaders are essential for any organization, including law enforcement. Police work is not free from the challenges of leadership, confronted with its own unique challenges, including developing ways to adapt to rapid change and continually having to adjust to various political and environmental factors.

This research is an in-depth examination of how transformational leadership and conflict management style drive job satisfaction in law enforcement. The goal is to determine whether employee satisfaction achieved through transformational leadership is, in fact, largely the result of how leadership handles conflict. The idea is to disentangle the relationship between transformational leadership and …

Mindfulness For Legal Professionals: An Appeal For Positive Change, Dianna Mejia Jan 2021

Mindfulness For Legal Professionals: An Appeal For Positive Change, Dianna Mejia

Mindfulness Studies Theses

Recent studies and reports address growing concerns about high rates of chronic stress, depression, and substance use by lawyers and law students. The National Task Force on Lawyer Well-Being identified the practice of law as a profession that is struggling and urged leaders to act now to improve the state of mental health and well-being of legal professionals. Among the recommendations in the 2017 report, The Path to Lawyer Well-Being: Practical Recommendations for Positive Change, the National Task Force included mindfulness as a practice to address the psychological and psychosomatic disorders permeating the legal profession. The National Task Force urged …

Article 6.21, Tatiana Stolpovskaya Jan 2021

Article 6.21, Tatiana Stolpovskaya

Theses and Dissertations

Article 6.21 is a short documentary film that aims to examine the state of censorship around queerness in Russia today and its effects on personal lives in the queer community.

Twenty years after Russia decriminalized homosexuality, on June 30th in 2013, President Vladimir Putin signed Article 6.21 "for the Purpose of Protecting Children from Information Advocating for a Denial of Traditional Family Values", also known as the "Gay Propaganda Law". Its broad and ambiguous wording allows the government significant leeway in deciding what kind of public queerness is punishable.

In 2020 Russia passed multiple constitutional amendments that affect many areas …

Censorship Concerns In College Media: A Multiple Case Study Analysis On The Silencing Of Student Journalists, Haley Nicole Matlock Jan 2021

Censorship Concerns In College Media: A Multiple Case Study Analysis On The Silencing Of Student Journalists, Haley Nicole Matlock

LSU Doctoral Dissertations

The aim of this qualitative study was to conduct a multiple case study that provides an analysis of censorship concerns at campus newspapers affiliated with public, four-year universities. Eighteen individuals from seven institutions participated in interviews. Interviewees consisted of former and current student journalists and advisers who worked at university publications where allegations of censorship have occurred within the last decade. The Student Press Law Center routinely investigates claims of censorship and provides pro bono legal counsel to student journalists (Zagier, 2011). While courts commonly sided with students in disagreements regarding free speech, Hazelwood v Kuhlmeier (1988) scaled back freedoms …

Examining Scott Peterson’S Appeals, Paige Bonavito Jan 2021

Examining Scott Peterson’S Appeals, Paige Bonavito

Selected Full-Text Master Theses Collection 2018-

This works discusses the Scott Peterson case, which took place from 2002-2004. Scott Peterson was convicted of murdering his wife Laci and unborn son Conner in 2004, and was given the death penalty. Peterson has filed automatic appeals and habeas corpus appeals since his trial, which have made their way through the California court system. Peterson’s death sentence was overturned by the California Supreme Court in 2020, and the California Supreme Court ordered the San Mateo trial court to look into overturning Peterson’s conviction. This work not only discusses the Peterson case at great length, it also serves to examine …

Challenging The Limitations Of Asserting Jurisdiction: A Case Study Of The South China Sea, Joshua Villanueva Jan 2021

Challenging The Limitations Of Asserting Jurisdiction: A Case Study Of The South China Sea, Joshua Villanueva

Electronic Theses and Dissertations

The South China Sea dispute challenges the future development of maritime legal order and international law. China’s behavior in the South China Sea challenges widely accepted rules governing maritime jurisdiction worldwide as it tries to expand the limits of its jurisdiction. In China’s view, the Arbitral Tribunal in Philippines v. China also challenged the jurisdiction of the UNCLOS by taking a highly political issue related to sovereignty. This thesis argues that mere rhetorical rejection of China’s actions in the South China Sea will not determine the resolution of the dispute. China’s behavior will be dependent on striking the right balance …

Because I Said So: The (Re)Production Of White, Ableist Narratives Through Legal Discourse In Endrew F. V. Douglas County Re-1, Stephen F. Fusco Jan 2021

Because I Said So: The (Re)Production Of White, Ableist Narratives Through Legal Discourse In Endrew F. V. Douglas County Re-1, Stephen F. Fusco

Electronic Theses and Dissertations

As families and advocates of students of color labeled with dis/abilities face mounting inequities they turn to the courts seeking protection. Unfortunately, even after courts issue written decisions ostensibly designed to protect students labeled dis/abled, these students continue to experience systematic oppression in school. This is due, in part, to the discourse used by the courts when addressing issues affecting students labeled dis/abled and the elitism of the judicial system. The purpose of this study was to examine the legal discourse used in the most recent Supreme Court case concerning the education of students labeled dis/abled, Endrew F. v. Douglas …

Violence After Victory: Explaining Variation In State Repression Following Contentious Politics, Christopher Wiley Shay Jan 2021

Violence After Victory: Explaining Variation In State Repression Following Contentious Politics, Christopher Wiley Shay

Electronic Theses and Dissertations

If conflict onset leads to increases in human rights abuse, how can these abuses be curbed once conflicts have ended? To answer this question, researchers have traditionally focused on a country’s regime type and leaders’ incentive structures. This is insufficient, I argue, because many regimes with obvious incentives to curb repression (especially democracies) fail to do so. In addition to regime-type, therefore, the answer depends on whether a given regime can count on the cooperation of its military and law enforcement institutions, which I refer to collectively as the security apparatus. This is because security agents’ prior experiences usually create …

International Humanitarian Law And Civilians In Modern Day Warfare, Allyna R. Storms Jan 2021

International Humanitarian Law And Civilians In Modern Day Warfare, Allyna R. Storms

Political Science Theses and Capstones

The present study aims to reflect the effect of International Humanitarian Law on non-state actors. The effect of International Humanitarian Law on non-state actor seems to be minimal, causing a rise in civilian deaths and injury. This study presents an overview of International Humanitarian Law, the purpose and effects of such on state actors, and recent research on International Humanitarian Law and non-state actors. Following will be an analysis of civilian deaths (dependent variable) and various independent variables as they relate to region, type of conflict, and incompatibility.

The Impact Of Particular Provisions Of The 2017 Tax Cuts And Jobs Act On The United States Economy Amidst The Covid-19 Pandemic, Hillary Obinna Maduka

LL.M. Essays & Theses

The Tax Cuts and Jobs Act is the most significant overhaul of the U.S. federal tax system in the last two decades. This paper seeks to discuss some of its most significant provisions and examine their overall impact on the U.S. economy, especially throughout the ongoing coronavirus pandemic.

This paper begins by undertaking an overview of the legislative history of the Act and then proceeds to discuss three provisions of the Tax Cuts and Jobs Acts which have had a tremendous impact on the U.S. economy by altering some major provisions of the United States Internal Revenue Code of 1986. …

Navigating The Human Side Of Workplace Conflict: A Comparative Study Of Organizational Ombuds' Similarities And Differences, Linda Kovack Jan 2021

Navigating The Human Side Of Workplace Conflict: A Comparative Study Of Organizational Ombuds' Similarities And Differences, Linda Kovack

Department of Conflict Resolution Studies Theses and Dissertations

Navigating the human side of workplace conflict poses challenges. A gap in knowledgeexists within an alternative dispute resolution option known as the organizational ombuds. Prior research referenced the ombuds' perception of his/her own role and functionality yet did not explore ombuds in differing organizational sectors. The research I explored was: What are the similarities and differences among and between ombuds in employment environments of higher education, the public or private sector, and the federal government? To address this question, I presented comprehensive case study profiles on a total of 8 organizations: 3 in higher education, 3 in the federal government, …

Ndihma Dhe Mbrojtja Juridike E Viktimave, Atdhetare Sabedini Jan 2021

Ndihma Dhe Mbrojtja Juridike E Viktimave, Atdhetare Sabedini

Theses and Dissertations

Theses and Dissertations

False Confession In Wrongful Convictions And The Effect Of Recording Custodial Interrogations Through Exoneration, Nana F. Owusu Jan 2021

False Confession In Wrongful Convictions And The Effect Of Recording Custodial Interrogations Through Exoneration, Nana F. Owusu

West Chester University Doctoral Projects

To reduce false confessions and guilty pleas, twenty-seven states have passed a law to have all custodial interrogations electronically recorded. According to the Innocence Project briefing book (2017) on the electronic recording of interrogations, electronic recording is audio and audiovisual (Innocent Project, 2017). This study explores the factors that lead to false confessions and guilty pleas in wrongful convictions. The literature explains how deprivation, coercion, violence, and evidence fabrication can lead to false confessions and guilty pleas. Using the comparative/experimental research approach to study two groups (27 states with recording laws and 27 states (including territories) with no recording laws), …

State Government’S Impact On Campus Services For Unaccompanied Homeless Students, Tori Nuccio Jan 2021

State Government’S Impact On Campus Services For Unaccompanied Homeless Students, Tori Nuccio

West Chester University Doctoral Projects

College campuses have been creating targeted support programs in the last decade to assist students coming from at-risk backgrounds including those who are homeless. Although research has begun to look at the impact these programs are having on the students they serve, little research has been done on how outside support has influenced the development and construct of these programs. My research addresses this gap in prior works via an exploratory study of how the existence of statewide supports, including the formation of networks, within three different cases impact colleges’ ability to build support programs. As part of a case …

Establishing State Responsibility In Mitigating Climate Change Under Customary International Law, Vanessa S.W. Tsang Jan 2021

Establishing State Responsibility In Mitigating Climate Change Under Customary International Law, Vanessa S.W. Tsang

LL.M. Essays & Theses

As acknowledged in the Paris Agreement’s Preamble, climate change is a “common concern of humankind.” To tackle the anthropogenic greenhouse gases (GHGs) at source, State governments played a pivotal role in implementing climate change policies. It thus justifies the approach of looking into the solutions to climate change from a state responsibility perspective. As mentioned by James Crawford, “[a]ny system of law must address the responsibility of its subjects for breaches of their obligations.” The finding of state responsibility in mitigating climate change will complement the treaty-based climate change regime, providing grounds for climate change litigations and policy formulation.

Lessons And Opportunities For Negotiation Teachers Following The Covid-19 Pandemic, Ana Lenard Jan 2021

Lessons And Opportunities For Negotiation Teachers Following The Covid-19 Pandemic, Ana Lenard

LL.M. Essays & Theses

In 2020-2021, and resulting from the Covid-19 pandemic, I taught and studied university negotiation courses online. In this essay I reflect on my experiences of teaching and learning online, ground them in pedagogical research, and distil key lessons and opportunities for negotiation teachers across three topics (creating inclusive classrooms, the role of technology, and equipping our students to meet the demands of the modern world). Teaching online has led to a collective upskilling in our understanding of our students, of what matters in life, and of how technology can enhance our teaching. We have agency in our classrooms to help …

The Durability Of Authenticity: An Examination Of The Art Conservator’S Role In Preserving Authenticity, Emily Crozier Jan 2021

The Durability Of Authenticity: An Examination Of The Art Conservator’S Role In Preserving Authenticity, Emily Crozier

MA Theses

This thesis will focus on the conservation of privately owned paintings by deceased artists to determine the durability of authenticity. The concept of authenticity is fragile and illusive. However, there are certain theories and attributes which help to determine whether a painting is authentic. It is generally agreed that the authenticity of a painting can be maintained or lost through conservation. It is therefore presumed that the conservator is ethically driven to preserve the authenticity of a painting as its cultural value is of paramount importance in the conservation process. However, conservation is not a purely ethical issue as it …

Reconstructing The Voting Rights Act: Subnational Action And Voting Rights Post-1965, Sean M. Holly Jan 2021

Reconstructing The Voting Rights Act: Subnational Action And Voting Rights Post-1965, Sean M. Holly

Honors Theses

The discussion of suffrage and the development of the U.S. electorate is misguidedly based solely around federal action; constitutional amendments and federal legislation are commonly revered as primary determinants of the right to vote. This tendency poses a specific problem with contemporary discussions of the Voting Rights Act of 1965. Specifically, discussions of the VRA ignores the ability of subnational actors to innovate politically and readjust their vehicles of political development in the wake of federal supposition of state powers. The Voting Rights Act did not destroy state authority regarding the right to vote; it merely disrupted their vehicles of …
