Grading Injustice: Initial Appearance Report Cards, Malia N. Brink, Jiacheng Yu, Pamela R. Metzger
Deason Center Reports
Arrested people across the United States often wait in jail for days, weeks, or even months before seeing a judge or meeting an attorney. In November 2021, the Deason Criminal Justice Reform Center published Ending Injustice: Solving the Initial Appearance Crisis, a comprehensive report about this ongoing crisis in pre-trial due process. That report described the devastating consequences of delayed and uncounseled initial appearances.
Now, these Initial Appearance Report Cards offer a closer look at the laws governing post-arrest procedures in each U.S. state, the District of Columbia, Guam, Puerto Rico, and the U.S. Virgin Islands. While the Deason …

Citation Sources For Legal Scholarship: Ranking The Top 28 Law Faculties, John R. Beatty
Law Librarian Contributions to Books
Published in The Role of Citation in the Law: A Yale Law School Symposium, Michael Chiorazzi, ed.
This study examines the effects of the data source on citation metrics and faculty rankings by comparing three sources of legal scholarship citation data: Google Scholar, Westlaw, and HeinOnline. It compares six years of citations to works by all of the tenured and tenure-track members of the top twenty-eight faculties as determined by two recent legal citation studies. Rankings generated using the Leiter-Sisk method on the data from the three sources showed moderate to high correlation (0. 77 to 0. 96) to each …

Commentary On Consumer Protection Act, 2019, Ashok R. Patil
Books
The development of new technology in the form of e-commerce and the increasing integration of global markets and supply chains have changed the way consumers interact with the marketplace. This has given rise to new challenges for the consumer, and the existing consumer protection framework falls short in dealing with them. To address these concerns, the Consumer Protection Act, 2019, seeks to lay down a more robust scheme for consumer protection with the introduction of new measures such as the establishment of a general regulator, providing for a product liability regime, encouraging mediation, and developing appropriate regulations to protect and …

Presidential Interpretation And War Powers, Tobias T. Gibson, Matthew R. Trout
SLU Law Journal Online
Judicial deference toward presidential decision making in national security has led to largely unencumbered presidential action in national security concerns. In this article, Matthew R. Trout and Tobias T. Gibson argue that presidential interpretation is a power of the president—a power that has enhanced an outsized presidential role in national security.

The Gospel Of Freedom, Alicestyne Turley
Civil Rights
Wilbur H. Siebert published his landmark study of the Underground Railroad in 1898, revealing a secret system of assisted slave escapes. A product of his time, Siebert based his research on the accounts of northern white male abolitionists. While useful in understanding the northern boundaries of the slaves' journey, Siebert's account leaves out the complicated narrative of assistance below the Mason-Dixon Line. In The Gospel of Freedom: Black Evangelicals and the Underground Railroad, author Alicestyne Turley positions Kentucky as a crucial "pass through" territory for escaping slaves and addresses the important contributions of white and black antislavery southerners who united …

The Papers Of Clarence Mitchell Jr., Volume Vi : The Struggle To Pass The 1960 Civil Rights Act, 1959–1960, Clarence Mitchell Jr., Denton L. Watson
Ohio University Press Open Access Books
The Civil Rights Act of 1960 aimed to close loopholes in its 1957 predecessor that had allowed continued voter disenfranchisement for African Americans and for Mexicans in Texas.
In early 1959, the newly seated Eighty-Sixth Congress had four major civil rights bills under consideration. Eventually consolidated into the 1960 Civil Rights Act, their purpose was to correct the weaknesses in the 1957 law. Mitchell’s papers from 1959 to 1960 show the extent to which congressional resistance to the passage of meaningful civil rights laws contributed to the lunch counter sit-ins in Greensboro, North Carolina, and to subsequent demonstrations. The papers …

Genetic Freedom Of The Seas In The Age Of Extractivism: Marine Genetic Resources In Areas Beyond National Jurisdiction, Irus Braverman
Genetic Freedom Of The Seas In The Age Of Extractivism: Marine Genetic Resources In Areas Beyond National Jurisdiction, Irus Braverman
Contributions to Books
Published as Chapter 4 in Laws of the Sea: Interdisciplinary Currents, Irus Braverman, ed.
Areas beyond national jurisdiction are the largest environment on earth and marine genetic resources are its new, and perhaps final, frontier. It is no wonder, then, that the scope and protection of marine genetic resources in this oceanic space have been hotly contested and that a new doctrine for ocean governance has been coined in this context: mare geneticum. This chapter examines different definitions of marine genetic resources debated in the ongoing treaty negotiations over areas beyond national jurisdiction (the BBNJ), the conflicting interests involved, and …

Amphibious Legal Geographies: Toward Land–Sea Regimes, Irus Braverman
Contributions to Books
Published as ine introduction to Laws of the Sea: Interdisciplinary Currents, Irus Braverman, ed.
This introduction presents an overview of the key concepts discussed in the subsequent chapters of this book. The book discusses the juridical thinking that has enshrined the land/sea divide into contemporary governmental infrastructures, disciplinary traditions, and regulatory apparatuses, and charts the disastrous implications that such a legal fixation on the land/sea binary has wrought on human and other-than-human lifeworlds. As the collection proceeds, a second broad theme emerges, building on the first: when one rethinks the abstraction of law as played out on the ground, the …

The Papers Of Clarence Mitchell Jr., Volume V : The Struggle To Pass The 1957 Civil Rights Act, 1955–1958, Clarence Mitchell Jr., Denton L. Watson
Ohio University Press Open Access Books
Volume V of The Papers of Clarence Mitchell Jr. records the successful effort to pass the 1957 Civil Rights Act: the first federal civil rights legislation since 1875.
Prior to the US Supreme Court’s landmark 1954 decision in Brown v. Board of Education, the NAACP had faced an impenetrable wall of opposition from southerners in Congress. Basing their assertions on the court’s 1896 “separate but equal” decision in Plessy v. Ferguson, legislators from the South maintained that their Jim Crow system was nondiscriminatory and thus constitutional. In their view, further civil rights laws were unnecessary. In ruling that legally mandated …

Planning For Emerging Threats: Rethinking The Presidential Line Of Succession, Fordham Law School Rule Of Law Clinic, Gregory Ascher, Myrna Nakhla, Colin Shea
Rule of Law Clinic
From the COVID-19 pandemic to the Ukraine war, recent events have highlighted possible threats to the continuity of presidential leadership. The presidential line of succession in the Presidential Succession Act of 1947 has several flaws. Some of the successors it designates might be ill-suited to discharge the powers of the presidency. Others concerns include its constitutionality, inappropriate incentives it might create, and the democratic legitimacy of outcomes it might produce. This report proposes several reforms to the line of succession for pre- and post-inaugural succession contingencies.

Othering In Immigration Laws, Andrea Wright, Quenten Jackson, Cesar Raymundo
Immigration Scholarship: History, Trends and Development in Global Immigration
The ethical wrongs in immigration laws severely impact what it means to be an immigrant American citizen. The Hispanic and Latino groups experience “citizenship” in the United States in a way that portrays them as uneducated and poor criminals, and this paper seeks to understand the reasoning behind this unfair reputation. In order to answer questions of ethics and law, this paper begins with studying the root of othering, regarding immigration in the United States. This research paper investigates the evolution of race-based exclusion laws in immigration and focuses on the relationship between these exclusion laws and race hierarchy in …

Wesley Newcomb Hohfeld: On The Difficulty Of Becoming A Law Professor, John Henry Schlegel
Contributions to Books
Published as Chapter 18 in Wesley Hohfeld A Century Later: Edited Major Works, Select Personal Papers, and Original Commentaries, Shyam Balganesh, Ted Sichelman & Henry Smith, eds.
Wesley Hohfeld (1879 - 1918) is well known to legal philosophers and to property teachers for his table of fundamental conceptions, a terminological framework for understanding legal doctrine and reasoning. This work was also substantively important for some members of the American Legal Realist movement and Critical Legal Studies. More personally he was part of the generation of law teachers who had to figure out how to become a professional academic in the …

Academic Brands And Cognitive Dissonance, Mark Bartholomew
Academic Brands And Cognitive Dissonance, Mark Bartholomew
Contributions to Books
Published as Chapter 7 in Academic Brands: Distinction in Global Higher Education (Mario Biagioli & Madhavi Sunder, eds., Cambridge University Press, 2022).
It is hard to reconcile the research university’s supposed reason for being – the reasoned pursuit of knowledge – with its methods for building brand awareness and equity. Just like pitches for other luxury goods, the selling of higher education depends on irrational appeals devoid of information and marketing missives meant to hug the line between legally protected puffery and outright fraud. Although universities have always borrowed from the selling strategies of the commercial sphere, in recent years, …
