Mediating The Mediterranean: The Israeli-Lebanese Maritime Border, Aaron Silverman
Mediating The Mediterranean: The Israeli-Lebanese Maritime Border, Aaron Silverman
Cardozo Journal of Conflict Resolution (CJCR) Blog
The governments of Israel and Lebanon have reached a historic U.S.-mediated agreement, putatively putting an end to the countries’ decades-long dispute over their maritime borders and related disputes over access to lucrative natural resources in the Eastern Mediterranean. The agreement definitively settles the neighboring countries’ maritime boundary, leaving the Karish natural gas field within Israel’s territorial waters and the Qana natural gas field mostly within Lebanon’s territorial waters, with a small portion extending into Israeli waters. Lebanon will pay royalties to Israel on revenues from the Qana field.

Abortions At Sea: In Search Of Creative Reproductive Healthcare Solutions Post-Dobbs, William Fox
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
Following the Supreme Court’s decision in Dobbs, access to reproductive healthcare and the right to abortion have been severely restricted across the United States. Indeed, within days of the decision, multiple states implemented trigger laws criminalizing abortion (in some cases without exceptions for instances of rape or incest) to the detriment of millions women across the country. This infringement on a woman's right to choose her own healthcare needs has profoundly impacted women living in conservative-led states, particularly minorities and those in the American South.

To Drink Or Not To Drink? Canada’S New Guidelines For Alcohol Consumption, Lauren Cutler
Cardozo International & Comparative Law Review (CICLR) Blog
On January 17, 2023, Canadian health officials from the Centre on Substance Abuse and Addiction released new guidelines for alcohol consumption, replacing a previous set from over ten years ago. These guidelines are reflective of “growing evidence, after decades of sometimes conflicting research, that even small amounts of alcohol can have serious health consequences.” In the technical summary, the Centre states that the costs associated with alcohol use in Canada in 2017 were a whopping $16.6 billion. $5.5 billion of that sum was attributable to healthcare costs.

Cardozo Arts & Entertainment Law Journal (AELJ) Blog
Recently, artificial intelligence (AI) artwork has gained tremendous attention in the art world and beyond. Though digitally generated AI art platforms have been available to creators for decades, recent programs have made it possible “to create complex, abstract or photorealistic works simply by typing a few words into a text box.” Because of these new advancements, AI art has widely varied in both form and function: from self-portrait TikTok trends to high end galleries and art competitions.

Should Canada’S Expansion Of Its Medical Assistance In Dying Program Concern Americans?, Tova Wolkenstein
Cardozo International & Comparative Law Review (CICLR) Blog
After suffering from severe chronic back pain and fearing losing his home, 54-year-old Canadian Amir Farsoud applied to Canada’s Medical Assistance in Dying program (MAID) to alleviate the stresses of his life. Farsoud is just one instance of an individual choosing to die with a physician’s help under the new criteria of MAID. As Canada is America’s “neighbor to the North,” the expansion of physician-assisted suicide there might be a canary in the coal mine as to what will happen in the United States, unless there is an active pushback to stop it.

As web3 and the metaverse expand, casting horizons have broadened to allow virtual talent to participate in the fashion and entertainment industries. Tommy Hilfiger, Etro, Selfridges, Dolce & Gabbana, Guo Pei, and Paco Rabanne, among other brands, participated in the launch. The second annual MVFW is scheduled to return in March of this year, promising events that include runway shows, exclusive wearable …

Section 230: The Legal Shield Perpetuating Algorithmic Discrimination In Big Tech, Arifa Abrahim
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
Section 230 of the Communications Decency Act shields “providers of interactive computer services” against liability arising from content generated by third parties. In a generation marked by the prolific use of social media platforms that operate on user-generated content, the immunity conferred by Section 230 endows platforms like Meta and Twitter with an implicit license to field discriminatorily-targeted ads.

In 1948, the United Nations General Assembly recognized the universal right of safety from persecution for the first time in history. The Universal Declaration of Human Rights was a response to the horrors of World War II and the Holocaust and set out fundamental human rights that states ought to protect. Among them, the right to seek asylum – or safety from persecution. This right was enshrined in the 1951 Refugee Convention and again in the 1967 Protocol. The core principle of this right is non-refoulment: a refugee should not be returned to a country where they face serious threats …

Arbitration Clauses In The Field Of Life Science And Cannabis Law, Zachary Chaikin
Cardozo Journal of Conflict Resolution (CJCR) Blog
Federally, the Controlled Substances Act (CSA) governs the manufacture, importation, possession, and use of drugs. Cannabis is currently included on Schedule I of the CSA, which effectively prohibits profiting from its possession, cultivation, or distribution. However, this stands in direct conflict with certain state laws that expressly allow for the possession, cultivation or distribution of marijuana. California was the first state to legalize medical marijuana in 1996. Since then, medical marijuana has been legalized in 39 states and the District of Columbia. The recreational or adult-use of cannabis has been legalized in the District of Columbia and 21 states. The …

Commentary about the Supreme Court's 2021 decision in United States v. Arthrex, Inc. has focused on the nexus between patent and administrative law. But this overlooks the decision's seismic and as-yet unappreciated implication for copyright law: Arthrex renders the Copyright Royalty Board ("CRB") unconstitutional. The CRB has suffered constitutional challenge since its 2004 inception, but these were seemingly resolved in 2011 when the D.C. Circuit held that the CRB's composition did not offend the Appointments Clause as long as Copyright Royalty Judges ("CRJs") were removable atwill. But when the Court invalidated the selection process for administrative patent judges on a …

No Sense Of Decency, Kathryn E. Miller
Articles
For nearly seventy years, the Court has assessed Eighth Amendment claims by evaluating “the evolving standards of decency that mark the progress of a maturing society.” In this Article, I examine the evolving standards of decency test, which has long been a punching bag for critics on both the right and the left. Criticism of the doctrine has been fierce, but largely academic until recent years. Some fault the test for being too majoritarian, while others argue that it provides few constraints on the Justices’ discretion, permitting their personal predilections to rule the day. For many, the test is seen …

Arbitration: Who Does It Better?, Emma Pearson
Arbitration: Who Does It Better?, Emma Pearson
Cardozo International & Comparative Law Review (CICLR) Blog
Arbitration is a form of dispute resolution used as an alternative to litigation. It has become an increasingly common method of dispute resolution in the United States, with over 9,000 cases and 15 billion dollars going to arbitration in 2021. Arbitration is seen as a beneficial alternative to litigation in the United States for a number of reasons. It takes much less time than traditional litigation so parties can expect to have a resolution to their claim much faster. Additionally, it can be much more cost effective than litigation because it does not have the same extensive discovery process as …
