Movement for Quality Government v. Knesset concerned challenges to Amendment No. 3 to Basic Law: The Judiciary (the “reasonableness amendment”). In view of the controversy surrounding the amendment and the fundamental constitutional question it raised in regard to the Supreme Court’s jurisdiction to review Basic Laws, the Court took the unprecedented step of sitting en banc. A translation of the official abstract issued by the Court appears here.
On January 1, 2024, a majority of the Court (12 of 15 justices) held that the Court held the authority to conduct judicial review of Basic Laws and to intervene in …

Jack Daniel's And The Unfulfilled Promise Of Trademark Use, Stacey Dogan, Jessica Silbey
Jack Daniel's And The Unfulfilled Promise Of Trademark Use, Stacey Dogan, Jessica Silbey
Cardozo Arts & Entertainment Law Journal
The article examines the Supreme Court's decision in Jack Daniel's v. VIP Products and its implications for the use of trademarks in artistic and expressive works. The Court's ruling established a "trademark use" doctrine, distinguishing between uses of trademarks as a designation of source for goods and non-trademark, expressive uses. While the decision does not overturn the Rogers v. Grimaldi test, it creates uncertainty in applying Rogers to expressive works, leading to inconsistent lower court decisions and threatening First Amendment protections for creative uses of trademarks.

"Who Are The Landlords Here?" - Group Rights In The Age Of Populism: Jewish Ownership Of Symbolic And Geographic Space In Israel, Meital Pinto
Cardozo International & Comparative Law Review
The world is witnessing the rise offar-right political parties. In Israel's recent national legislative election, Jewish Power (Otzma Yehudit), a far-right, anti-Arab political party, reached an unprecedented achievement. The party won six seats in the Knesset and its leader, Itamar Ben Gvir was appointed as the Minister of National Security. "Who are the Landlords Here?" was the party's election slogan; it signals that Jews should not only own the state but also its public space. This normative political statement aligns with the dominant attitude towards group rights for the Arab-Palestinian citizens of Israel. The dominant attitude perceives group rights in …

Music, Mayhem, And A Mississippi: Still Burning-The Hope Of Smothering The Deleterious Effects Of Deliberate Indifference, Angela Dixon
Cardozo Journal of Equal Rights & Social Justice
The article argues that the deliberate indifference standard, as applied in Eighth Amendment jurisprudence, fails to adequately address inhumane and unconstitutional prison conditions, particularly in Mississippi. It critiques the standard for prioritizing prison officials' intent over objective conditions, allowing systemic neglect and racial disparities to persist. The analysis advocates for a shift toward an objective standard to better protect human dignity and hold prison administrators accountable.
Open Hunting Season: Black Bodies As A Threatened Species, Mark C. Grafenreed
Open Hunting Season: Black Bodies As A Threatened Species, Mark C. Grafenreed
Cardozo Journal of Equal Rights & Social Justice
Tracing the Endangered Species Act of 1973 provides striking parallels with the historical, legal, and cultural aspects of bondage mapped upon Black bodies. The United States Congress promulgated the Endangered Species Act to protect and conserve threatened and endangered wildlife species. However, this gives rise to a serious moral dilemma and cognitive dissonance in that nearly 1,500 wildlife species benefit from the Endangered Species Act's protections. At the same time, Black bodies disproportionately suffer without similar federal protections. Congress has strengthened the Endangered Species Act's force through four amendments since its inception, even while there have been mounting threats to …
Conceptual Schemes/Frameworks And Their Relation To Law: A New Argument For Separation Of Church And State, Vincent J. Samar
Conceptual Schemes/Frameworks And Their Relation To Law: A New Argument For Separation Of Church And State, Vincent J. Samar
Cardozo Journal of Equal Rights & Social Justice
A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, "How to Interpret the Constitution," Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to arrive at more than a provisional understanding of what would be the best interpretation in any given area of …

Death At The Door Of Relief: The Criminalization Of Humanitarian Work And Asylum, William Fox
Death At The Door Of Relief: The Criminalization Of Humanitarian Work And Asylum, William Fox
Cardozo Journal of Equal Rights & Social Justice
The note argues that the criminalization of humanitarian aid to migrants at the U.S.-Mexico border violates international human rights law and exacerbates a growing refugee crisis. It contends that the U.S. government's "prevention through deterrence" policy funnels migrants into dangerous conditions, leading to increased deaths and human rights violations. The analysis calls for structural reforms, including expanded humanitarian parole, temporary protected status, and refugee resettlement programs, to align U.S. policy with its international obligations and mitigate the crisis.
If It Can Make It There, It Can Make It Anywhere: How New York's "Green Amendment" Is Catalyzing Environmental Progress In Light Of Federal Failures, Zoe Zingale
Cardozo Journal of Equal Rights & Social Justice
The note examines the challenges faced by minority and low-income communities in seeking legal redress for environmental injustices, highlighting how federal legal avenues like Title VI of the Civil Rights Act of 1964 have been limited by Supreme Court rulings. It proposes that state-level Green Amendments, such as New York's, offer a promising alternative for these communities to assert their right to a healthy environment and seek relief from disparate environmental impacts.

Approaches from diverse disciplines, including history, philosophy, sociology, literary studies, and law, fill initial gaps but also reveal problems, challenges, and areas for further study. Ultimately, this volume lays the foundation for a deeper understanding of antisemitism in legal scholarship and practice.

An Information Flow Model Of Online Mediation: Jeopardizing Privacy And Autonomy In The Shadow Of Innovation, Rachel Ringort, Ayelet Sela
Cardozo Journal of Conflict Resolution
Online mediation has developed significantly over the past decade, and increasingly so following the COVID-19 pandemic. Online mediation platforms are now integrated into both private and public settings, enabling mediation through diverse means-from videoconferencing software to dedicated platforms that use various procedural and technological tools, including artificial intelligencepowered applications. The digital transformation of the mediation process introduces challenges and opportunities for mediators, parties, and mediation platforms, many of which stem from new digital datahandling practices. This article explores how such digital transformation of mediation impacts the parties' rights to self-determination and privacy. Recognizing that these rights derive from the parties' …

Comparing Joint Session And Caucus Outcomes: Factoring In Substantive Discussions And Case Characteristics, Roselle L. Wissler, Art Hinshaw
Cardozo Journal of Conflict Resolution
Many of the traditional components of initial joint sessions occur less frequently today than they did historically and are more likely to take place during initial caucuses than during initial joint sessions. These changes in mediation practice lead to questions about whether initial joint sessions still provide the benefits historically attributed to them and whether initial caucuses now provide not only the benefits specifically ascribed to them but also the benefits typically associated with initial joint sessions. The presentArticle addresses these questions while taking into consideration differences in case and mediator characteristics as well as the extent of discussions in …

Arbitral Reliance On "Precedent", Ariana R. Levinson
Arbitral Reliance On "Precedent", Ariana R. Levinson
Cardozo Journal of Conflict Resolution
We conclude that "precedent" may not be the most appropriate term for arbitrators' reliance on other awards. While the term "precedent" might be used loosely in the sense that any past event is a precedent for any future event, the doctrines of stare decisis, collateral estoppel, and res judicata do not apply in labor arbitration. Only if a contract explicitly states or is interpreted by arbitrators to require past awards between the same parties to bind them into the future until a change is negotiated to the contract will these doctrines be utilized by arbitrators. Much more often, including in …

Artificial Intelligence And Mediation Ethics, Zachary R. Calo
Artificial Intelligence And Mediation Ethics, Zachary R. Calo
Cardozo Journal of Conflict Resolution
Artificial intelligence ("Al") presents many opportunities to improve the efficiency, effectiveness, and accessibility of mediation. More than that, it has potential to transform the nature of how mediation is practiced and what mediation is. While Al might not yet play a significant role in many mediations, there is widespread recognition that the technology is disrupting many established dispute resolution practices. What mediation will look like on the other side is unclear, but it will not be the same.

Technology And Victims' Compensation Systems: The Brumadinho Experience, Diego Faleck
Cardozo Journal of Conflict Resolution
The rupture of the B-I dam of the C6rrego do Feijio Mine, in Brumadinho, Minas Gerais, Brazil, owned by the company VALE S/A, which occurred on January 25, 2019, gave rise, from the point of view of civil liability, to a series of extrajudicial measures of socioeconomic reparation. These measures include the payment of emergency compensation to more than 100,000 people, and the implementation of an individual, optional, and voluntary compensation program for civil and labor claims, for the victims and their families. The compensation program was designed according to the principles and techniques of the evolving field of study …
