Neiman V. Chairman Of The Elections Committee, Meir Shamgar, Miriam Ben-Porat, Aharon Barak, Menachem Elon, Moshe Bejski

Translated Opinions

The Knesset Elections Law establishes a Central Elections Committee, to which are submitted the various proposed candidates lists that wish to participate in the Knesset elections. The Committee reviews the lists to ascertain that they conform to the requirements of the Law, approves such lists as comply and disqualifies any list that does not comply, supervises the conduct of the election campaign and the elections themselves, rules on various issues that arise during the campaign and during the elections and certifies the results of the voting. A Theory Of Contractual Debt Subordination And Lien Priority, David G. Carlson May 1985

A Theory Of Contractual Debt Subordination And Lien Priority, David G. Carlson

Articles

The article advocates for treating debt subordination agreements as assignments of debt rather than subjecting them to Article 9 of the Uniform Commercial Code (UCC). This approach would align subordination with economic principles, simplify legal handling, and protect senior creditors' interests by ensuring they receive double dividends in bankruptcy. The article emphasizes the need for legislative exemptions, …

Freedom From Freedom Of Contract: The Enduring Value Of Servitude Restrictions, Stewart E. Sterk Mar 1985

Freedom From Freedom Of Contract: The Enduring Value Of Servitude Restrictions, Stewart E. Sterk

Articles

The article examines the legal and policy implications of enforcing contractual servitudes that bind successors-in-interest to land, arguing that unrestricted enforcement could lead to significant externalities and transaction costs. While Richard Epstein advocates for maximal contractual freedom, the analysis highlights the need for doctrinal limitations to protect future generations and public interests. The article critiques existing doctrines like the touch and concern requirement, changed conditions doctrine, and durational limitations, proposing reforms to balance private autonomy with broader societal concerns.

Tuchmintz V. Carmel, Moshe Bejski, Avraham Halima, Shlomo Levin Feb 1985

Tuchmintz V. Carmel, Moshe Bejski, Avraham Halima, Shlomo Levin

Translated Opinions

The Respondent petitioned the Tel Aviv-Jaffa District Court for the enforcement of the Appellant’s obligation to purchase a 3 room apartment for her, and for the appointment of a receiver to execute that obligation. The said obligation was part of a divorce agreement between the Appellant and the Respondent that was given the force of a judgment. The Appellant argued that he and the Respondent had made a parol agreement to delay the execution of the obligation. The District Court granted the Respondent’s request. This led to the appeal, which focused upon the question whether a parol agreement can alter …
