Contract Law And The Liberalism Of Fear, Nathan B. Oman
Contract Law And The Liberalism Of Fear, Nathan B. Oman
Faculty Publications
Liberalism’s concern with human freedom seems related to contractual freedom and thus contract law. There are, however, many strands of liberal thought and which of them best justifies contract is a difficult question. In The Choice Theory of Contracts, Hanoch Dagan and Michael Heller offer a vision of contract based on autonomy. Drawing on the work of Joseph Raz, they argue that extending autonomy should be the law’s primary concern, which requires that we extend the range of contractual choices available. While there is much to admire in their work, I argue that autonomy as conceived by Dagan and Heller …

Justice On The Line: Prosecutorial Screening Before Arrest, Adam M. Gershowitz
Justice On The Line: Prosecutorial Screening Before Arrest, Adam M. Gershowitz
Faculty Publications
Police make more than eleven million arrests every year. Yet prosecutors dismiss about 25% of criminal charges with no conviction being entered. Needless arrests are therefore clogging the criminal justice system and harming criminal defendants. For instance, Freddie Gray was fatally injured in police custody after being arrested for possession of a switchblade knife. Prosecutors later announced, however, that they did not believe the knife was actually illegal. If prosecutors had to approve warrantless arrests before police could take suspects into custody, Freddie Gray would still be alive. Yet prosecutors’ offices almost never dictate who the police should or should …
Counterfeit Campaign Speech, Rebecca Green
Counterfeit Campaign Speech, Rebecca Green
Faculty Publications
We are entering an era in which computers can manufacture highly-sophisticated images, audio, and video of people doing and saying things they have, in fact, not done or said. In the context of political campaigns, the danger of “counterfeit campaign speech” is existential. Do current laws adequately regulate faked candidate speech? Can counter speech effectively neutralize it? Because it takes place in the vaulted realm of core political speech, would the First Amendment stymie any attempt to outlaw it? Many smart people who have looked at the general problem of deceit in campaigns have concluded that the state has no …

Shellfish Production In Virginia: Private Leasing Grounds, Nathan Burchard
Virginia Coastal Policy Center
During its 2019 session, the Virginia General Assembly passed numerous pieces of legislation related to the private leasing grounds program. In addition to increasing lease application and transfer fees and requiring that VMRC establish a fee structure for lease renewals, the new legislation also expanded the factors for VMRC to consider when approving, renewing, or transferring a lease. In spring 2019, VMRC formed the Aquaculture Management Advisory Committee (AMAC), which will provide ongoing management advisory assistance to VMRC staff and continue to address shellfish management issues addressed by the SNR Work Group. AMAC is comprised of industry, nonprofit, and academic …

Shellfish Production In Virginia: Public Grounds, Geoffrey Grau
Virginia Coastal Policy Center
One potential impediment to the continued growth of the aquaculture industry in Virginia is the current management framework associated with the use of the public Baylor Grounds. Virginia’s constitution provides, in part, that the “natural oyster beds, rocks, and shoals in the waters of the Commonwealth shall not be leased, rented, or sold but shall be held in trust for the benefit of the people of the Commonwealth.” Originally, oyster beds in the Chesapeake Bay (the “Bay”) were so plentiful that “oyster reefs rose so high that they grazed the bottoms of boats sailing the Bay.” By the late 19th …

The Territorial Reach Of Federal Courts, A. Benjamin Spencer
The Territorial Reach Of Federal Courts, A. Benjamin Spencer
Faculty Publications
Federal courts exercise the sovereign authority of the United States when they assert personal jurisdiction over a defendant. As components of the national sovereign, federal courts' maximum territorial reach is determined by the Fifth Amendment's Due Process Clause, which permits jurisdiction over persons with sufficient minimum contacts with the United States and over property located therein. Why, then, are federal courts limited to the territorial reach of the states in which they sit when they exercise personal jurisdiction in most cases? There is no constitutional or statutory mandate that so constrains the federal judicial reach. Rather, it is by operation …

A Reasonable Solution For Working Parents: Expanding Reasonable Accommodation Under The Americans With Disabilities Act To Parents Of Children With Disabilities, Katherine Lease
William & Mary Journal of Race, Gender, and Social Justice
There is a growing intersection between a woman’s child-rearing and work responsibilities, but federal law inadequately addresses this issue. For mothers who have a child with a disability, they face increased parenting demands, which often lead to detrimental changes in their employment status and negative perceptions of their work ability and commitment. Many women face expectations to simultaneously be the perfect mother and the ideal worker, but this is largely unattainable when faced with the demands of raising a child with a disability.
This Note will explore the development and inadequacy of the current protection against association discrimination, that is, …

Tenant-Victims, Abusers, And No Way To Escape: The Need For An Amendment To The Florida Residential Landlord And Tenant Act, Adam Bent
William & Mary Journal of Race, Gender, and Social Justice
Under the Florida Residential Landlord and Tenant Act, there is no right to early lease termination for tenants who must move to escape domestic, stalking, sexual, or dating violence. Florida’s failure to grant a right to early lease termination compounds the physical and psychological harm that victims face; abusers often live with the victim or know where the victim lives. In turn, abusers can return to the victim’s home and harm the victim; often, this results in serious physical harm or death. This Article explains why existing criminal and civil law does not adequately protect victims from their abusers. The …

The Genetic Information Nondiscrimination Act At Age 10: Gina’S Controversial Assertion That Data Transparency Protects Privacy And Civil Rights, Barbara J. Evans
William & Mary Law Review
The genomic testing industry is an edifice built on data transparency: transparent and often unconsented sharing of our genetic information with researchers to fuel scientific discovery, transparent sharing of our test results to help regulators infer whether the tests are safe and effective, and transparent sharing of our health information to help treat other patients on the premise that we gain reciprocity of advantage when each person’s health care is informed by the best available data about all of us. Transparency undeniably confers many social benefits but creates risks to the civil rights of the people whose genetic information is …
Tax Lawyers As Tax Insurance, Heather M. Field
Tax Lawyers As Tax Insurance, Heather M. Field
William & Mary Law Review
Transactional tax lawyers, by rendering tax opinions, provide a version of insurance to clients. This insurance is clearly incomplete, but by providing a tax opinion, a lawyer conditionally agrees to indemnify the client for at least part of the potential loss the client incurs if the favorable tax treatment described in the opinion is successfully challenged. Although insurance is not the primary function of transactional tax lawyers, and although this Article does not argue that tax opinions should be regulated as insurance, indemnification—a key element of insurance—is an important part of the economic relationship between a client and a lawyer …
Justice Begins Before Trial: How To Nudge Inaccurate Pretrial Rulings Using Behavioral Law And Economic Theory And Uniform Commercial Laws, Michael Gentithes
Justice Begins Before Trial: How To Nudge Inaccurate Pretrial Rulings Using Behavioral Law And Economic Theory And Uniform Commercial Laws, Michael Gentithes
William & Mary Law Review
Injustice in criminal cases often takes root before trial begins. Overworked criminal judges must resolve difficult pretrial evidentiary issues that determine the charges the State will take to trial and the range of sentences the defendant will face. Wrong decisions on these issues often lead to wrongful convictions. As behavioral law and economic theory suggests, judges who are cognitively busy and receive little feedback on these topics from appellate courts rely upon intuition, rather than deliberative reasoning, to resolve these questions. This leads to inconsistent rulings, which prosecutors exploit to expand the scope of evidentiary exceptions that almost always disfavor …
The Federal Courts’ Rulemaking Buffer, Jordan M. Singer
The Federal Courts’ Rulemaking Buffer, Jordan M. Singer
William & Mary Law Review
Procedural rulemaking is often thought of as a second-order task for the federal court system, relevant to the courts’ work but not essential to their function. In reality, rulemaking plays an integral role in the court system’s operation by actively insulating the courts from environmental pressure. This Article explains how power over procedural rulemaking protects the federal courts from environmental uncertainty and describes the court system’s efforts to maintain the effectiveness of the rulemaking buffer in response to historical and contemporary challenges.

The Popular Constitutional Canon, Tom Donnelly
The Popular Constitutional Canon, Tom Donnelly
William & Mary Bill of Rights Journal
Popular constitutionalism scholarship has often left out the American people. Sure, ordinary citizens make cameo appearances—often through the actions of elected officials and elite movement leaders. However, focusing on high politics among elite actors—even if those actors are not judges—simply is not enough. If popular constitutional views do, indeed, matter, then we can expect constitutional partisans to try to manipulate the processes through which these views emerge. Some constitutional scholars have made a start, reflecting on the importance of the constitutional canon. However, these scholars focus mostly on the legal canon and often ignore its popular analog. At the same …
