Community Property And Tort Liability In Washington, Howard P. Pruzan
Community Property And Tort Liability In Washington, Howard P. Pruzan
Washington Law Review
Of no small proportions was the task faced by the judges of this state when the legislature saw fit to superunpose upon our background of common law a system of community property, a development of the civil law And nowhere are the difficulties of reconciling these two conflicting systems felt more acutely than in the field of tort liability. In addition to inherent difficulties there is the urge which constantly influences judges to circumvent existing law when it requires turning away a just claimant empty-handed (or, what amounts to the same thing, turning hun away with a judgment winch cannot …

Contracts-Remedies For Misrepresentation-Measure Of Recovery, Richard J. Archer S.Ed.
Contracts-Remedies For Misrepresentation-Measure Of Recovery, Richard J. Archer S.Ed.
Michigan Law Review
In a preceding comment in this series, the various remedies affording relief for misrepresentation were examined for the purpose of determining what remedies are available in case of an innocent misrepresentation. Discussion was directed toward actions for damages for deceit, actions at law and in equity for restitution, the recovery of damages for breach of warranty, and the action based on the enforcement of representations on a theory of estoppel. The purpose of the present comment is to re-examine these remedies to determine what relief can be obtained by each of them, assuming for this purpose that all of the …

Negligence-Contributory Negligence-Customary Violation Of Statute By Defendant As Bearing On Issue Of Plaintiff's Contributory Negligence, James A. Sprunk
Michigan Law Review
Plaintiff's empty truck, proceeding uphill, collided on plaintiff's side of the road with defendant's loaded truck which was traveling in the opposite direction. Both trucks were engaged in the same road-surfacing project. The road had a washout on defendant's side. Defendant's answer alleged that there was an established custom under which drivers of empty trucks yielded the right of way to drivers of loaded trucks when about to meet in a narrow or defective place in the highway; that defendant relied upon such custom which plaintiff failed to observe; and that the plaintiff's failure to observe the custom constituted contributory …

Executors And Administrators-Personal Tort Liability-Effect Of Statutes Authorizing Continuance Of Decedent's Business, Leroy H. Redfern S.Ed.
Michigan Law Review
It is the purpose here to consider the effect of statutes which provide authority for personal representatives to operate a business on the representatives' tort liability. An important factor in deciding whether the statutes change the common law rules relating to tort liability of executors and administrators is the manner in which the courts regard those rules-are they fair and do they make for good law, or are they harsh and arbitrary? For this reason attention is first directed to the practical operation of and reasons behind the common law doctrine.
Executors And Administrators-Tort Action Against Personal Representative After Estate Is Closed, Leroy H. Redfern S.Ed.
Executors And Administrators-Tort Action Against Personal Representative After Estate Is Closed, Leroy H. Redfern S.Ed.
Michigan Law Review
Plaintiff sustained personal injuries due to the negligent act of an employee in a business operated by defendant executor with court authorization. Eight months after the accident occurred the assets of the estate were distributed and the executor discharged. Four months later the plaintiff instituted a suit for damages against defendant in his individual capacity. Held, discharge of the executor did not relieve him of personal liability for the tortious acts of his agent. Johnston v. Long, ( Cal. 1947) 180 P. (2d) 21, as modified on denial of rehearing 181 P. (2d) 645.
