The Evolution And Utilization Of The Gatt/Wto Dispute Settlement Mechanism, Pao-Li Chang

This paper provides a theoretical framework of dispute settlement to explain the surge in blocking incidence of GATT panel reports during the 1980s and the variations in withdrawn incidence versus total disputes across different decades of the GATT regime. The study first suggests the role of the degree of legal controversy over a panel ruling in determining countries' incentives to block (appeal) a panel report under the GATT (WTO) regime. The study then analyzes the effects of political power on countries' incentives to use, and their interactions in using, the dispute settlement mechanism, when two-sided asymmetric information exists regarding panel …

Using data collected from the Chicago Women's Health Risk Study (Block 2000), this study looked at female perpetrated intimate partner homicide. The purpose of this study was to identify what factors, if any, differentiate between abused women who kill versus abused women who do not kill their intimate partners. Through conducting this study, several factors such as substance abuse, support networks and severe violence were compared between abused women who kill their intimate partner versus those who were abused women but did not kill. Studies have examined the impact of environmental variables on academic achievement among student athletes in the revenue-generating sports of men’s basketball and football. However, while evidence concerning the positive impact of male student athlete and faculty interaction is virtually unequivocal, we are not certain whether the benefits accruing from particular types of interaction vary across different racial/ethnic groups. This study explores the relationship between male Black and White student athletes and faculty as well as the impact of specific forms of student athlete– faculty interaction on academic achievement. A distributed infrastructure that would enable those who wish to do so to contribute their scientific or technical data to a universal digital commons could allow such data to be more readily preserved and accessible among disciplinary domains. Five critical issues that must be addressed in developing an efficient and effective data commons infrastructure are described. We conclude that creation of a distributed infrastructure meeting the critical criteria and deployable throughout the networked university library community is practically achievable.

This study was initiated in order to provide more factual insight into the recent debates on patent reforms in general and more particularly, the practice of patent continuations in the United States Patent and Trademark Office (“USPTO”). Several important trends that have not been previously quantified are brought to light. De minimis cutoffs are a familiar feature of risk regulation. This includes the quantitative “individual risk” thresholds for fatality risks employed in many contexts by EPA, FDA, and other agencies, such as the 1-in-1 million lifetime cancer risk cutoff; extreme event cutoffs for addressing natural hazards, such as the 100-year-flood or 475-year-earthquake; de minimis failure probabilities for built structures; the exclusion of low-probability causal models; and other policymaking criteria. All these tests have a common structure, as I show in the Article. A de minimis test, broadly defined, tells the decisionmaker to determine whether the probability of some outcome is …

Initial discussions concerned the declining role of scientific resource management due to the increased inclusion of economic-cost benefit analysis and public participation in the decision-making process.
