In legal education, we tend to focus first and foremost on producing graduates who can effectively serve and thrive in the private for-profit, non-profit, and federal government economies. There are pressing reasons to maintain these priorities. And yet, assuming legal educators come to believe -- as Schragger has (and I have) -- that cities belong "at the center of economic and constitutional thinking," it stands to reason that law schools should find a way to place cities among the subjects at the center of legal educational thinking. Now is the time to consider how law schools can help raise up …

Local Control Funding Formula: A Continuum Of Discrimination Against Minority Youth In Education, Alafia Delahaye May 2016

Local Control Funding Formula: A Continuum Of Discrimination Against Minority Youth In Education, Alafia Delahaye

Poverty Law Conference & Symposium

The issue of public school education funding is at the core of the inequalities between schools located in wealthy school districts and those in low-income school districts. Every state struggles to remedy inequitable funding, partly due to long histories of segregation and racism. Nevertheless, many states continue to believe that allowing localities to manage school funding will remedy the problems, but many localities fail to effectively and fairly manage funds.

Part I discusses the background and legal history of public school education funding in California. Part II describes the recent law passed in California, the Local Control Funding Formula (LCFF) …

The Myth Of The “Welfare Queen”: Reproductive Oppression In The Welfare System, Emily R. Champlin Apr 2016

The Myth Of The “Welfare Queen”: Reproductive Oppression In The Welfare System, Emily R. Champlin

Poverty Law Conference & Symposium

This paper focuses on two major policy flaws that are rooted in the racist stereotype of the “welfare queen.” These policies work together to punish single motherhood and deny poor women the ability to control their own reproductive futures. They were enacted under the guise that they will stop the cycle of poverty. In reality, they drive women and families deeper into it.

First, in the background section, this paper gives an overview of the history of the “welfare queen” myth and the dramatic changes in the U.S. welfare system. In the analysis section, part one covers the family cap …

2015 Veterans Professional Career Conference, Golden Gate University School Of Law

Veterans Legal Advocacy Center

Golden Gate University’s focus on the need for veteran advocacy and professional development programs began in 2012, after GGU Law’s Dean Rachel Van Cleave lost her friend, late Ambassador Christopher Stevens, in Benghazi. At his memorial, Dean Van Cleave met with student veterans who expressed the challenges student veterans face due to their unique experiences and perspectives. From that day on, Dean Van Cleave sought to help veterans with legal and professional services in order to help them navigate higher education and to transition into professional careers. For the past two years, Dean Van Cleave and GGU have worked with …

California Agencies

To better understand California’s LGBT veterans’ needs, California’s Department of Veterans Affairs (CalVet) worked closely with the California LGBT Veterans Leadership Forum Planning Committee to convene the first state LGBT Veteran Leadership Forum. The forum was held September 26-27, 2014, at California State University, Sacramento. CalVet requested that the California Research Bureau (CRB) provide research consultation for pre- and post-event surveys, train facilitators, develop a specialized forum methodology and publish the results.

This white paper summarizes the results from the qualitative and quantitative data collected before, during and after the forum.

Education Disparities Based On Wealth: Struggles Facing Poor Aspiring Lawyers, Angelica Torres May 2015

Education Disparities Based On Wealth: Struggles Facing Poor Aspiring Lawyers, Angelica Torres

Student Publications

This paper will focus on my lack of knowledge about how growing up poor would make my own struggle to become a lawyer – especially a lawyer hoping to one day serve her own community – seem cluttered with unending obstacles. Given the costs of becoming a lawyer, and given that poverty disproportionately affects minorities, it is easy to understand why diversity is still lacking in the legal profession. Furthermore, because of the economic obstacles the poor face from the very beginning, attempting to work in the public interest field can add to the lists of challenges by disincentivizing those …

When Family Meets Business: The Challenge Of Work/Life Balance, Michele Benedetto Neitz May 2015

When Family Meets Business: The Challenge Of Work/Life Balance, Michele Benedetto Neitz

Publications

Some businesses in San Francisco are listening closely to the needs of their employees while maximizing efficiency. Technology companies, for example, were pioneers in designing workspaces to fit the physical and emotional needs of their workers. This includes cafeterias with free food and coffee, gym and exercise rooms, meditation rooms, and oncall massage therapists.

Of course, tech companies' use of onsite facilities can be viewed as an attempt to stack the work/life balance deck, allowing people to spend more of their "life" at the workplace. In turn, employees in these companies need not ever leave the building — a clear …

Articles About GGU Law

The former general counsel of the U.S. Department of Veterans Affairs, retired Col. Will Gunn, posed two questions to students, academics and others at the Golden Gate University School of Law‘s Second Annual Veterans Law Conference: “Is there anything interesting and meaningful left to do in veteran’s law and policy? Haven’t we solved these issues?”

‘Tough’ Lawyer Keker Counsels Giving Veterans Legal Aid With Love, Katrina Dewey

Articles About GGU Law

The Purple Heart honoree recently spoke about his experiences at the Second Annual Veterans Conference at Golden Gate University School of Law, telling an audience of students, academics and fellow leaders of the bar how best to provide legal advice to the men and women who constitute the nation’s 19.6 million military veterans. He came to the Mission Street campus, he said, because he’ll go anywhere to help vets – and to help students who work at Golden Gate’s veteran’s clinic and others who counsel veterans to appreciate who their clients are.

California’S Women Veterans Responses To The 2013 Survey, California Research Bureau Sep 2014

California’S Women Veterans Responses To The 2013 Survey, California Research Bureau

California Agencies

The women veteran population in the United States now exceeds 2.2 million. About 8 percent of these women live in California, for a population of more than 180,000. Women veterans have much in common with their male counterparts but have unique experiences and needs as well. Anticipating and addressing these needs is a growing focus of state and federal governments. One component of California’s response to the growing women veteran population is the California Women Veteran Survey, a biennial survey of women veterans living in the state. Begun in 2009, this survey is administered by the California State Library’s California …

Bitcoin: Crypto-Currency Or Bust, Ilon Oliveira

GGU Law Review Blog

Bitcoin’s nature makes regulation extremely difficult for international governments. The currency’s resistance to regulation also makes it appealing to people who want freedom from government or central bank control. However, given the rapidly moving growth and emerging uses of Bitcoin, governments will need to take action sooner rather than later, to prevent fraud and protect Bitcoin users.

The mass shooting that left three dead and sixteen injured this year at Fort Hood is a stark reminder of the challenges and difficulties facing our service men and women. Within days of the tragedy, I attended two conferences in Washington, D.C. to discuss how the legal community may work to serve veterans. One was hosted by the U.S. Department of Veterans Affairs and the other by the Puller Clinic at William & Mary Law School.

Paging Dr. Derrida: A Deconstructionist Approach To Understanding The Affordable Care Act Litigation, Laura A. Cisneros

Sovereignty federalism and cooperative federalism represent the two dominant federalism narratives among Supreme Court justices and scholars. The Court consistently invokes formal protections to safeguard the states' right to preside over their own empires.' Sovereignty scholars tend to embrace this dualistic vision of federalism that locates federalism's success in the state's ability to exercise supreme policymaking authority within its own sphere of influence without federal interference. By contrast, academics that lean toward cooperative federalism locate the states' power in their position as federal servants, not separate sovereigns. Scholars have commented that even though these academics tend to resist the rigid …
