The Right To Financial Privacy Act Of 1978-The Congressional Response To United States V. Miller: A Procedural Right To Challenge Government Access To Financial Records, Nancy M. Kirschner
The Right To Financial Privacy Act Of 1978-The Congressional Response To United States V. Miller: A Procedural Right To Challenge Government Access To Financial Records, Nancy M. Kirschner
University of Michigan Journal of Law Reform
This article will review the factors leading to the Miller decision and the legislative response to that decision. Part I will examine the bank customer's expectation of privacy and the way Miller affects this expectation. Part II will discuss the congressional response to Miller and the competing interests which led to the Right to Financial Privacy Act. The Act itself will be discussed in detail in Part III. Part IV will evaluate the Act, and offer recommendations for reform. The article concludes that the Act, by adopting a purely procedural approach, fails to provide adequate protection to bank customers.

Production And Consumption Of Informal Law: A Model For Identifying Information Loss, Sandra M. Huszagh, Fredrick W. Huszagh
Scholarly Works
This Article seeks to indicate where the probability of citizen ignorance is greatest, and to identify the important independent variables that determine the probable level of ignorance. On the basis of this analysis, the Article sets forth a model designed to facilitate development of law communication reforms that can restore legitimacy to the government's assumption that ignorance is not a proper defense to noncompliance. The model can be applied at any jurisdictional level. The nine charts at the end of the Article illustrate how various communication factors individually and cumulatively condition information flow at each level.

An Analysis Of The U.S.-Canadian East Coast Fisheries Resource Agreement, Michael V. Guimond
Marine Affairs Theses and Major Papers
This analysis of the U.S.-Canadian East Coast Fisheries Resource Agreement was initiated at the request of a group of fishing industry representatives concerned about some of the terms enumerated in this document. The purpose behind this research project was threefold. First, to determine if this Agreement was consistent with the intent of the FCMA. Second, to determine the economic impact of this Treaty upon the New England fishing industry. The third purpose, which is not in the scope of this paper, was to aid in determining what the response of the user groups should be.

Maritime Unions & U.S. Shipping Policy, Jon Lucas
Marine Affairs Theses and Major Papers
This paper explores the role played by the U.S. maritime unions in influencing the formation of American shipping policy. The thesis of the paper is that maritime unions have exerted great influence on legislators, through lobbying efforts to foster special-interest legislation which benefits union members at the expense of the taxpayer. The research is based on standard works on shipping and maritime labor relations, Hearings of the House and Senate Merchant Marine committees, and newspaper and magazine articles which trace the progress of various pieces of maritime legislation. Only the activities of the seagoing unions are discussed, and the paper …

The Federal Strip Mining Act: Environmental Protection Comes To The Coalfields Of Virginia, Edward Shawn Grandis
University of Richmond Law Review
Strip mining, for those of us who are touched by it, either as residents of areas affected by the mining or as professionals or bureaucrats concerned with the legal or technical issues involved, conjours up vivid images of land devastation, offsite property damage and high profits with little risk involved for the operator.
