The Fate Of Native American Diversity In America's Law Schools, Raymond Cross Oct 2013

The Fate Of Native American Diversity In America's Law Schools, Raymond Cross

Faculty Law Review Articles

I contend that America’s law schools, through their adoption of an appropriately modified version of this community development model, will be better positioned to promote their public service and social justice missions. My goal is to demonstrate two points: first, this available diversity initiative, known popularly as Native American diversity, has succeeded in facilitating the community building efforts of eligible minority communities throughout Indian Country; and second, this diversity initiative has also reinvigorated the social justice and public service missions of those law schools that have chosen to embrace it.

My article is divided into three parts. Part I describes …

Justifying Academic Freedom, Brian L. Frye Oct 2013

Justifying Academic Freedom, Brian L. Frye

Law Faculty Scholarly Articles

While academic freedom can only be described in relation to academic norms, its justification can and should depend on its contribution to the common good. Academics contribute to the common good by producing scholarship. But scholarship is a means to an end, not an end in itself. Academic freedom is justified not only because enables academics to produce more and better scholarship, but also because it enables academics to challenge academic norms that diminish the quantity or quality of scholarship they produce.

Specialization In Law And Business: A Proposal For A J.D./'Mbl' Curriculum, Robert J. Rhee Oct 2013

Specialization In Law And Business: A Proposal For A J.D./'Mbl' Curriculum, Robert J. Rhee

UF Law Faculty Publications

This paper provides the specific details of how an interdisciplinary program of law and business can be structured in a three-year J.D. program. The program envisioned is a J.D./”M.B.L.”, which is distinguished from the better known J.D./M.B.A. The “M.B.L.” stands for “masters of business law,” which is simply an idea tag. The moniker can represent a program conferring a supplemental degree in law and business, or simply a specialized course of study to complete a J.D. Either way, the program is an interdisciplinary program of concentrated study in core transaction-oriented law courses and core business courses. The most effective education …

Value(S) Of Lawyers, Rachel A. Van Cleave

Top concerns facing legal educators and the legal profession today are the cost and quality of a legal education and the job market for graduates. President Barack Obama's comments in August about whether law school should be shortened to two years have generated healthy discussions about the trifecta we are grappling with: cost, quality and employment. These are critical issues. However, it is important not to lose sight of both the value of the legal profession as well as our fundamental values as lawyers and what model might best support these.

Legal Education For All (Or More Than Just Lawyers), Carol A. Parker Sep 2013

Legal Education For All (Or More Than Just Lawyers), Carol A. Parker

Faculty Scholarship

While the need to acquire a working understanding of our laws and regulations seems only to grow, access to legal information is still largely kept at a premium by legal educators, who provide it almost exclusively through the juris doctor degree.

Only a small percentage of American law schools offer master's-level legal-studies degrees, which are typically equivalent to taking two semesters' worth of law-school courses. These non-J.D. graduate degrees are aimed at students seeking knowledge about law, but combining such programs with subject matter drawn from other disciplines to create discrete programs remains rare.

A More Cost Effective Model For Legal Education, Jack Graves Sep 2013

A More Cost Effective Model For Legal Education, Jack Graves

Scholarly Works

In his most recent book, Richard Susskind focuses on three primary drivers of change in the market for legal services: (1) the “more-for-less” challenge; (2) the “liberalization” of the regulatory environment; and (3) the effective use of “information technology.” These same three drivers provide the keys to unlocking a more efficient and effective system of legal education. The price of a legal education must be significantly reduced at the vast majority of law schools, and we must deliver a better education at this reduced price. Together, these two objectives comprise the obvious, yet daunting, “more-for-less” challenge we face as educators. …

Justadvice: Studying Law In Snapshots, Brenda Bratton Blom, Leigh Maddox

Faculty Scholarship

Access to legal services continues to be a critical need in the United States. Clinical programs in law schools are part of responding to the demand for these services, but often face the challenge of filling gaps left by larger programs serving the poor or responding to unique legal needs. JustAdvice was designed to provide limited advice to a broad range of people with legal needs, unbundling those services where possible. The story of the development, implementation and transformation of the program into a teaching, triage and referral system that importantly links multiple organizations and services is the core of …

Using Experiential Education To Develop Human Resources For The Nonprofit Community: A Course Study Analysis, Ann C. Hodges Aug 2013

Using Experiential Education To Develop Human Resources For The Nonprofit Community: A Course Study Analysis, Ann C. Hodges

Law Faculty Publications

In this era of shrinking resources and increased pressure to produce "practice-ready" lawyers, law schools are seeking new and cost-effective ways to provide experiential education. This article reports and analyzes the results of a survey of graduates and students from a course in Nonprofit Organizations that incorporated a community-based project designed to develop skills, enhance learning and encourage post-graduation involvement with nonprofits. Although limited to one course, this course study, like a case study, offers valuable information. Consistent with other research on experiential education, the survey supports the conclusion that such projects, while less resource intensive and comprehensive than clinics, …

Law Schools’ Untapped Resources: Using Advocacy Professors To Achieve Real Change In Legal Education, Wes R. Porter Jul 2013

Law Schools’ Untapped Resources: Using Advocacy Professors To Achieve Real Change In Legal Education, Wes R. Porter

Publications

If the current law school model is dilapidated, then the remodel requires more than a face-lift; it requires real structural and architectural changes. Legal education (finally) must cater to the needs of students. By most accounts, that means teaching students the knowledge, skills, and values required to serve clients and solve problems. However, to reinvent legal education in a meaningful way, law schools must involve and elevate their former second-class citizens on the faculty: advocacy professors, clinicians, and legal writing instructors. These faculty members already teach, and have long taught, in the way that would represent real change in law …
