Climate Change And The Law Of National Security Adaptation, Mark P. Nevitt
Climate Change And The Law Of National Security Adaptation, Mark P. Nevitt
Faculty Articles
The Department of Defense (DoD) is the largest employer in the world, owns and operates an enormous global real estate portfolio, and emits more Greenhouse Gases (GHGs) than many nations. Entrusted with the national security, the DoD is now threatened by a new enemy—climate change. Climate change imperils national security infrastructure while undermining the military’s capacity to respond to climate-driven disasters at home and abroad. However, legal scholarship has yet to address what I call “the law of national security adaptation” and related questions. For example, how do environmental and climate change laws apply to the U.S. military? What laws …

Environmental Soft Law As A Governance Strategy, Cary Coglianese
Environmental Soft Law As A Governance Strategy, Cary Coglianese
All Faculty Scholarship
Soft law governance relies on nongovernmental institutions that establish and implement voluntary standards. Compared with traditional hard law solutions to societal and economic problems, soft law alternatives promise to be more politically feasible to establish and then easier to adapt in the face of changing circumstances. They may also seem more likely to be flexible in what they demand of targeted businesses and other entities. But can soft law actually work to solve major problems? This Article considers the value of soft law governance through the lens of three major voluntary, nongovernmental initiatives that address environmental concerns: (1) ISO 14001 …
Implementation Strategy Report, G Jager, M Musariri
Implementation Strategy Report, G Jager, M Musariri
Policy
In essence the Implementation Strategy provides a plan for implementing and maintaining an optimal South African Water Resources Monitoring Network. As such the Strategy includes a number of key aspects considered for each of the surface water, groundwater and water quality monitoring programs, as summarized below:
Finalizing the optimal monitoring network design, including the location, the variables/constituents being monitored, the frequency of observations, as well as the implementation priority for each monitoring site.
Identifying opportunities for the integration of processes involved in the implementation process, such as the coordinated development or upgrading of monitoring sites based on physical location and …

Scientific Review Report, J D. Rossouw, M Musariri
Policy
This report provides the Scientific Review results and recommendations regarding the existing surface and groundwater monitoring sites for all nine Water Management Areas following the Regional WMA Network Design Workshops held in Nelspruit, Cape Town, Durban,King Williams Town, Bela-Bela and Bloemfontein from March to June 2016. During these workshops theoretical monitoring network considerations for each WMA were presented to various stakeholders, and the considerations were used to review the existing networks and obtain changes and improvements to the networks as recommendations. The main objectives of the workshops were to review the existing monitoring networks against the prioritized National Monitoring Objectives …

Thawing Out: The Role Of The Arctic Council Service In A Melting Arctic, Taylor J. Enos
Pell Scholars and Senior Theses
With the changing natural and political climate of the Arctic, conflicts over resource extraction and navigation will become inevitable. Empowering an intergovernmental institution like the Arctic Council Service may be the only solution. This paper analyzes the importance and history of the Arctic as a political environment, which is prone to abuse in the very near future at the hands of Russia and the United States.

The Department of Water and Sanitation (DWS) is the custodian of ten national monitoring programs. The overall aim of this project is to undertake an evaluation of each monitoring network, in its present condition, and to redesign and realign the network based on scientific analysis and the strategic and management objectives of DWS and of the country as a whole. The water resources monitoring network will be optimised to ensure sustainable, relevant and up-to-date data of an acceptable quality. This Network Inventory Task focused on the production of maps to illustrate the spatial distribution of the existing monitoring stations for …

The ability to harness energy is fundamental to economic and social development. Worldwide, almost 3 billion people have little or no access to beneficial energy resources for cooking, heating, water sanitation, illumination, transportation, or basic mechanical needs. Energy poverty exacerbates ill health and economic hardship, and reduces educational opportunities, particularly for women and children. Specifically, access to efficient and affordable energy services is a prerequisite for achieving the Millennium Development Goal (MDG) relating to poverty eradication.
In response, the UN …
