Journal of Collective Bargaining in the Academy

For over five decades following its founding in 1915, the American Association of University Professors (AAUP) carried out its mission outside of the realm of collective bargaining. The organization formulated policy on a constantly evolving range of issues of concern to higher education, and worked to have those policies adopted by individual institutions and state public higher education systems. The mechanisms employed were a combination of: encouraging faculty to use their participation in shared governance to work towards policy adoption; interacting directly—including in the initial formulation of policy pronouncements and in joint endorsements—with organizations representing the interests of administrators and …

The FLSA provides certain protections for individuals who are classified as employees. Employees are considered “non-exempt,” i.e., eligible for all of those protections (minimum wage and overtime) unless they fall within specific exemptions. The burden of proof is on the employer to establish that employees fall within an exemption.

Colleges and universities often struggle with unique challenges in determining whether certain jobs are exempt. The exemptions below only focus on the requirements under the FLSA. There are often different and more restrictive requirements under state law that must be considered as well.

Faculty governance is experiencing new pressures as a result of changes in established practices in higher education. As a result of salary compression and inversion and increased workloads and non-optimal working conditions, faculty is seeking alternative ways to impact decision-making in higher education. Union activists on higher education campuses are energized by these efforts as they seek new and comparable salaries for faculty as a result there is a renewed interest in collective bargaining .1 Staff and faculty collective bargaining is heightened by the attention on salary requests.
