The U.S. Supreme Court's landmark 2021 decision in NCAA v. Alston has opened the door to serious consideration of the potential for college athlete unionization and collective bargaining. The ruling, highlighted by Justice Kavanaugh's concurring opinion, suggests collective bargaining as a potential solution to the National Collegiate Athletic Association's ("NCAA's") antitrust vulnerabilities. This Article delves into the initial legal and strategic questions surrounding the prospect of unionization, focusing particularly on NCAA Division I football and basketball, due to their significant revenue generation making them prime candidates for unionization efforts.

At midcentury, New York City was among the preeminent manufacturing centers in the United States. Within a generation, this manufacturing economy suffered an extraordinary collapse. Beginning in the 1950s, workers and their unions began to use the term “runaway” to describe factories that pulled up stakes in New York and set them back down in other climes. This dissertation explores the deindustrialization of New York City through case studies of “runaway” plants, or factories that left New York for the American South or abroad between the years 1945 and 1975.

In this Essay, I hope to do two things: First, I try to put the current labor-disability controversy into that broader context. Second, and perhaps more important, I take a position on how disability rights advocates should approach both the current contro-versy and labor-disability tensions more broadly. As to the narrow dispute over wage-and-hour protections for personal-assistance workers, I argue both that those workers have a compelling normative claim to full FLSA protection—a claim that disability rights advocates should recognize—and that supporting the claim of those workers is pragmatically in the best interests of the disability rights movement. There is no question; nurses play a key role in healthcare. Nurses provide direct care, coordinate health promotion activities, educate, and provide support and advocacy to patients. Today, there are over two million registered nurses in the United States. My research aims to determine the variables that influence some nurses to be more politically active and more engaged in unionization than their counterparts. I analyze The National Sample Survey of Registered Nurses 2004 looking at a variety of potential explanations for union participation. The labor movement or union community of America has been in a steady decline for more than a decade. The 1950s saw the pinnacle of success with one-third of the U.S. workforce being unionized. Today only 8% of the private workforce is unionized. One way in which this decline may be perceived as more pronounced is through media alienation. Each year, the National Basketball Association (NBA) conducts its annual entry draft (NBA Draft), which is the exclusive process by which premiere amateur players gain entrance into the NBA. To the dismay of many commentators, a number of drafted players will have just completed their senior year of high school. Routinely, these players are dismissed as immature, unprepared, and ill-advised, even though most will sign guaranteed, multi-million dollar contracts before their college educations would have begun. Ballou and Podgursky offer solid economic analysis on issues surrounding the debate over whether increasing salaries for teachers leads to a more qualified teaching workforce. The authors find little evidence to support the link between increased salaries and teacher quality, then address two questions: (1) What went wrong? and (2) Which reforms are likely to meet with increased success?
