Diamonds In The Rough : Corporate Paternalism And African Professionalism On The Mines Of Colonial Angola, 1917–1975, Todd Cleveland

Diamonds in the Rough explores the lives of African laborers on Angola’s diamond mines from the commencement of operations in 1917 to the colony’s independence from Portugal in 1975. The mines were owned and operated by the Diamond Company of Angola, or Diamang, which enjoyed exclusive mining and labor concessions granted by the colonial government. Through these monopolies, the company became the most profitable enterprise in Portugal’s African empire. After a tumultuous initial period, the company’s mines and mining encampments experienced a remarkable degree of stability, in striking contrast to the labor unrest and ethnic conflicts that flared in other …

Major League Baseball's Antitrust Exemption And The Impact Of The Curt Flood Act, Gina Scalzo

For many years, professional baseball has enjoyed a privileged antitrust exemption apart from other professional sports. With the passing of the Curt Flood Act in 1998 this exemption was removed; however, the act may not be as influential as it seems. Court rulings were prominent in initiating and maintaining the antitrust exemption for professional baseball. These include the Supreme Court Trilogy, especially the case of Curt Flood, a baseball player who fought against the reserve clause system which limited his and other players’ employment options. Workplace Dignity In A Total Institution: Examining The Experiences Of Foxconn’S Migrant Workforce, Kristen Lucas, Dongjing Kang, Zhou Li

In 2010, a cluster of suicides at the electronics manufacturing giant Foxconn Technology Group sparked worldwide outcry about working conditions at its factories in China. Within a few short months, 14 young migrant workers jumped to their deaths from buildings on the Foxconn campus, an all-encompassing compound where they had worked, eaten, and slept. Even though the language of workplace dignity was invoked in official responses from Foxconn and its business partner Apple, neither of these parties directly examined workers’ dignity in their ensuing audits. A Moral Contractual Approach To Labor Law Reform: A Template For Using Ethical Principles To Regulate Behavior Where Law Failed To Do So Effectively, Zev J. Eigen, David S. Sherwyn

If laws cease to work as they should or as intended, legislators and scholars propose new laws to replace or amend them. This paper posits an alternative—offering regulated parties the opportunity to contractually bind themselves to behave ethically. The perfect test-case for this proposal is labor law, because (1) labor law has not been amended for decades, (2) proposals to amend it have failed for political reasons, and are focused on union election win rates, and less on the election process itself, (3) it is an area of law already statutorily regulating parties' reciprocal contractual obligations, and (4) moral means …
