Civility And Academic Freedom, Risa L. Lieberwitz

Journal of Collective Bargaining in the Academy

This paper is intended to provide a foundation for further discussion and debate at the plenary panel on “Civility and Academic Freedom” at the National Center’s annual conference on April 20, 2015. The discussion, below, sets forth a structure for evaluating university policies seeking promote “civility” in faculty and student discourse. In particular, this paper evaluates the asserted justifications for civility-related policies and their implications for academic freedom. The paper provides, as well, a list of AAUP materials useful for considering the academic freedom implications of civility-related policies in universities.

From Hierarchies To Markets: Fedex Drivers And The Work Contract As Institutional Marker, Julia Tomassetti

Georgetown Law Faculty Publications and Other Works

Judges are often called upon today to determine whether certain workers are “employees” or “independent contractors.” The distinction is important, because only employees have rights under most statutes regulating work, including wage and hour, anti-discrimination, and collective bargaining law. Too often judges exclude workers from statutory protection who resemble what legal scholars have described as typical, industrial employees — long-term, full-time workers with set wages and routinized responsibilities within a large firm. To explain how courts reach these counterintuitive results, the article examines recent federal decisions finding that FedEx delivery drivers are independent contractors rather than employees. Since 1968, liberation theology has emerged as a prominent feature of religion and politics, particularly in South America. Originally stemming from the writings of Peruvian priest Gustavo Gutiérrez, this at-once theological and overtly political ideology decries the institutionalized violence of the world’s capitalist society on the poor and oppressed, and argues that God is particularly concerned with the plight of the suffering masses. Christians should therefore make assistance of these poor souls their highest priority, and advocate for any and all methods of alleviating suffering, especially those that work from the premise that society must be toppled and rebuilt for …

Diamonds In The Rough : Corporate Paternalism And African Professionalism On The Mines Of Colonial Angola, 1917–1975, Todd Cleveland

Diamonds in the Rough explores the lives of African laborers on Angola’s diamond mines from the commencement of operations in 1917 to the colony’s independence from Portugal in 1975. The mines were owned and operated by the Diamond Company of Angola, or Diamang, which enjoyed exclusive mining and labor concessions granted by the colonial government. Through these monopolies, the company became the most profitable enterprise in Portugal’s African empire. After a tumultuous initial period, the company’s mines and mining encampments experienced a remarkable degree of stability, in striking contrast to the labor unrest and ethnic conflicts that flared in other …

Boom & Bust: The Perils Of Guaranteed Long Term Contracts. Evidence From Ops100 Performance Over The Contract Cycle, Heather M. O'Neill

This study focuses on panel data of 256 MLB free agent hitters under the 2006-2011 Collective Bargaining Agreement (CBA) to demonstrate that hitters, on average, increase their offensive production, measured by OPS100, during the last year of their contract and subsequently underperform the first year of the newly signed long term contract. The contract year phenomenon arises from the incentive to land a lucrative guaranteed contract for players not intending to retire. Signing a long term guaranteed contract creates an incentive to shirk (underperform) the first year of the new contract because performance and pay become unlinked and the need …

The food and beverage industry in Las Vegas gaming resorts has rapidly been moving towards a lease model where independent third parties operate outlets. This is in comparison to the past where resorts operated such outlets with their own employees. Food and beverage operations in resorts have always been labor intensive, requiring the need for large numbers of employees to run properly. As food and beverage operations in resorts are heavily intertwined with organized labor, it warrants a look into the changing aspects of the relationship due to this new leasing trend. Employment Duration And Match Quality Over The Business Cycle, Ismail Baydur, Toshihiko Mukoyama

Research Collection School Of Economics

This paper studies the cyclical behavior of employment duration using data from the National Longitudinal Survey of Youth 1979 cohort. We estimate a proportional hazard model with competing risks, distinguishing different types of separations. A higher unemployment rate at the start of an employment relationship increases the probability that the worker quits to take or look for another job, but it decreases the probability that the firm fires the worker. The net effect of these opposing forces on the overall duration of the employment is negative, but small, implying that match quality is weakly pro-cyclical. We also build a simple …
