Shaping Immigration Law Through A Business Law Model, Mitchell Reber

Brigham Young University Prelaw Review

This article argues that state-produced immigration law can be a more effective method of regulating immigration when compared with current federal regulation. Currently, regulation as controlled by the federal government supersedes any laws created at the state level and subjects those laws produced by states to extensive review by the courts. The article proposes that immigration law should follow a business-law model when regulating immigration on a state level and discusses how the Immigration Reform and Control Act of 1986 needs to be reinterpreted. This study focuses on the ways in which the tourism industry in Raja Ampat has contributed to local livelihoods and encouraged the preservation of marine resources, looking specifically at the case of a dive operator and a volunteer tourism operation. The study illuminates the challenges that these operators face when engaging with the local community to protect the environment, and recommends more effective strategies for improving relations between tourism operators and the communities in which they reside. The opioid epidemic is not just a problem that affects major cities, as there is a growing market for heroin in suburban communities. North Andover saw a spike from only seven overdoses in 2015, to twenty-three possible overdoses in just the first nine and a half months of 2016, depicting evidence of how grave the problem really has become in the community. The epidemic is not an issue that can be delayed and gradually deliberated, as immediate action is required to treat individuals affected and heal the community as a whole. The main focus of this thesis is to analyze the behavior of stock price on ex-dividend day of ADRs in Spain, Mexico, and Chile. Announcement date, and ex-dividend date for each ADR is collected to be analyzed against the other ADRs. One would expect different behaviors in the different markets because of different tax treatments in Chile, Mexico, and Spain. Traditional event testing is being used to analyze the stock price behavior on and around ex-dividend days. Connecting the entirety of Southeast Asia to the Indian and Pacific Oceans, the South China Sea is among the world’s most vital commercial and strategic arenas. Robust shipping lanes funnel several trillion dollars in trade through the South China Sea annually; and lucrative fisheries and potentially vast hydrocarbon resources fill its waters. The South China Sea also hosts a tremendously complex geopolitical puzzle which hinges on overlapping maritime sovereignty claims made by Vietnam, China, Philippines, Malaysia, Taiwan, and Brunei. This report examines corporate inversions to determine whether this practice benefits the majority of stakeholders or merely a select few. A sample of firms previously incorporated in the United States that have since undergone inversions is examined to answer this question. Annual stock price returns, stock price volatility, and earnings per share changes from the sample of inversion firms are the main sources of data examined. These results are compared to the S&P 500 and peer firms to determine whether the changes can be attributed to the inversions, or are merely a result of general economic conditions. The accounting field holds a background in ethical understanding to be of great importance. The purpose of this project was to investigate the extent to which ethics education is emphasized and implemented within the business, and specifically accounting, curricula of US collegiate level institutions. Course curricula from a sample of 445 AACSB (Association to Advance Collegiate Schools of Business) accredited business programs in the US were examined for their emphasis on ethics education. This emphasis was quantified through a novel measurement, the Ethics Education Index, which is an originally constructed weighted measure of the number of stand-alone courses dealing with …

The present study examined justice perceptions of an intercollegiate athlete who was punished for a team rule violation outside of competition. This scenario study is a modified replication of Severs’ (2009) study on justice perceptions of intercollegiate athletes; one additional factor, importance of the next competition, was examined in the current study. Perceptions of fairness and perceptions of likelihood of deterring future misconduct were examined using a factorial design with two levels of punishment severity (severe and moderate), two levels of misconduct severity (severe and moderate), two types of punishment distribution (consistent and conditional), and two types of game importance …

Country-Level Institutions, Firm Value, And The Role Of Corporate Social Responsibility Initiatives, Sadok El Ghoul, Omrane Guedhami, Yongtae Kim

Accounting

Drawing on transaction cost theories and the resource-based view of a firm, we posit that the value of corporate social responsibility (CSR) initiatives is greater in countries where an absence of market-supporting institutions increases transaction costs and limits access to resources. Using a large sample of 11,672 firm-year observations representing 2445 unique firms from 53 countries during 2003–2010 and controlling for firm-level unobservable heterogeneity, we find supportive evidence that CSR is more positively related to firm value in countries with weaker market institutions. We also provide evidence on the channels through which CSR initiatives reduce transaction costs. We find that …

Competitive balance is an issue in every major sport, though Major League Baseball struggles significantly due to the lack of a salary cap. Understandably, the players’ union disagrees and refuses to allow a salary cap, as player salaries would most likely not only be slowed but halted altogether. Major League Baseball contrasts this as perfect competition is preferred though unrealistic. Prior research indicates that competitive balance measures such as the luxury tax and revenue distribution are somewhat effective, though they still do not completely solve the issue plaguing the league, specifically small-market teams.

This paper analyzes indicators of local median housing prices in the Essex County, Massachusetts area. The housing market is a significant sector of the United States economy and therefore it is important to develop models, which can predict and identify movements in their prices. This study examined the relationship of the serve-specific core self-evaluation scale (SS-CSES) with serve performance of inter-collegiate volleyball athletes. The SSCSES is a modified version of the core self-evaluations scale (CSE). It was hypothesized that SS-CSES would be related to serve performance, that SS-CSE would be more related to serve performance than CSE, and that SS-CSE would have incremental validity over CSE when predicting serve performance. Responses to the two scales and selfassessments of server performance were collected online through self-report questionnaire. Additionally, NCAA serve statistics were collected by the researchers.
