This paper explores the potential content and feasibility of a set of harmonized choice of law rules (HICOL Rules) that would apply in insolvency proceedings. It contemplates a main insolvency proceeding opened in a debtor’s center of main interests (“COMI”) and the existence of (or possibility of opening) one or more non-main (or secondary) proceedings. It also contemplates the possibility that an insolvency representative in a main or non-main proceeding may seek and be granted recognition in another state under the UNCITRAL Model Law on Cross-Border Insolvency (codified as Chapter 15 of the Bankruptcy Code in the U.S.) Under HICOL …

Whites And The Active Representation Of Racial Minority Interests, Maykao Y. Hang

This study explored personal and organizational factors that contribute to White public administrators actively representing the interests of racial minority minorities. Data collection comprised of 15 semi-structured interviews. The average age was 54, and the length of service was 3-33 years. Subjects were asked about their personal background, what it means to be White, and work experiences in local county government.

Personal factors found were racial consciousness, major life events, and significant relationships with people of color. Organizational factors included a diverse and inclusive work environment, bureaucracy, legal and compliance issues, and supervisor support. Findings included that Whites did not …

The Statewide Nonresident Travel Survey is conducted throughout Montana, and the resulting data are analyzed and made available to the public on the ITRR website on a quarterly basis. Statewide visitation and traveler spending estimates, as well as an analysis of the contribution of nonresident travel to Montana's economy, are published annually. This research note provides information regarding the survey methods and data analysis process.

Despite the scholarly interest in workplace incivility in the field of organizational behavior, public administration (PA) scholars have paid much less attention to this timely and relevant topic. Based on a unique sample of 401 individuals (nested in 83 work units) employed in a public organization in Thailand, the present study seeks to address this void by examining whether different sources of workplace incivility (i.e., supervisors, coworkers and customers) will have differential effects on different types of employee deviant behaviors (i.e., deviance directed towards the organization, supervisors, coworkers and customers). Prominent recent examples include the Stop Online Piracy Act (SOPA) and the Protect Intellectual Property Act (PIPA), network neutrality, the increasing availability of location information, and the NSA’s surveillance program. Other emerging issues include data privacy, online video distribution, patent policy, and spectrum policy. In short, the rapid rate of technological change has increasingly shown that law and engineering can no longer remain compartmentalized into separate spheres. In this Essay, I take stock (as something of an outsider) of the behavioral economics movement, focusing in particular on its interaction with traditional cost-benefit analysis and its implications for agency structure. The usual strategy for such a project—a strategy that has been used by others with behavioral economics—is to marshal the existing evidence and critically assess its significance. My approach in this Essay is somewhat different. In 2010, an estimated population of the 311,212,863 Americans generated approximately 1,014,688,290 physician office encounters (Moore, 2010). The frequency and number of professional interactions between caregivers and patients/family members in medical office settings equated to a staggering 1,931 visits per minute. Based on the massive volume of interactions that occurred between patients of different races, ethnicities, genders, sexual orientations, and socioeconomic standings that generated an average household income of $49,445 in 2010 (United States Census Bureau, 2010a) with a physician workforce that the Association of American Medical Colleges (2010) captured as being 75% White that earned (primary care specialties) in …

Removing household hazardous waste (HHW) from the municipal solid waste stream is important to protect health, safety and the environment. Communities across the U.S. separate HHW from regular trash for disposal with hazardous waste, however nationally, participation rates are low with only five to ten percent of households estimated to participate in any given collection. This two-part study used the Theory of Planned Behavior (TPB) to understand individuals’ beliefs and attitudes toward HHW collections, and to develop a print message intervention to increase participation. The Impact Of Clean Energy On Economic Growth: An Econometrics Approach, Cheng Zhang

This paper reviews the relationship between economic performance and clean energy using country level data. A combined instrumental variable and fixed-effect regression model is adopted to determine the relationship. By examining data in the past 50 years, we conclude that developing alternative energy will harm GDP growth, but to a relatively small degree. Thus, policymakers can take advantage of alternative energy research and development as a long-term investment that will reduce reliance on traditional energy sources.

On October 1st, 2013, a mandate was adopted by the California Public Utilities Commission (CPUC) requiring that 1.325 GW of energy storage capability be installed on the California electricity grid by 2024, through the actions of the state’s three investor-owned utilities. While this is a bold first step towards mandated energy storage in the United States, it may be only the beginning for an energy storage industry in this state.
