Strategies For Managing An Aging Workforce, Marie F. Jones
Strategies For Managing An Aging Workforce, Marie F. Jones
The Southeastern Librarian
Demographic trends show that the population of librarians in the U.S. is rapidly aging. This paper examines the ways that library managers can make workplaces more attractive to older librarians in order to encourage them to remain in the workforce beyond retirement age. The article dispels some negative stereotypes of "the older worker" and shows the advantages of retaining individuals with experience and maturity. It also addresses organizational climate, management, and training issues related to older workers.

An Exploratory Look At An Evolving Tourism Industry: Maine's Nature-Based Tourism Industry In Transition, Marc Edwards
An Exploratory Look At An Evolving Tourism Industry: Maine's Nature-Based Tourism Industry In Transition, Marc Edwards
Electronic Theses and Dissertations
Maine's natural resources have been attracting visitors to the State for more than 150 years, from artists drawn to the beauty and wildness of the coast, such as Thomas Cole in 1844, to Henry David Thoreau's well-documented trip to Katahdin popularized in his collection of essays The Maine Woods. Early artists like Cole lodged with local farmers and Thoreau's journeys into the Maine woods were aided by Native American and local guides. These early artists and adventurers could be said to be among the first nature-based tourists in Maine, while those who provided lodging and guide services were among the …
Vacating The City: An Analysis Of New Homes Vs. Household Growth, Thomas Bier, Charles Post
Vacating The City: An Analysis Of New Homes Vs. Household Growth, Thomas Bier, Charles Post
All Maxine Goodman Levin School of Urban Affairs Publications
The high price of housing on the coasts, population growth in the large metropolitan areas of the south, southwest, and west, and the issue of affordability for low- and moderate-income households across the country fueled the view that housing production was insufficient and that the shortfall was contributing to rising prices and limited housing choice. Indeed, underlying all of the housing-related changes and issues of the 1990s were the factors of supply and demand. The nation grew by 13.5 million households while 13.2 million building permits were filed. Nationally, housing supply was just about in balance with population growth. But …
Dirigo Health: A Small Business Perspective, Deborah Cook
Dirigo Health: A Small Business Perspective, Deborah Cook
Maine Policy Review
In her commentary Deborah Cook, executive director of the Maine Small Business Alliance, discusses Dirigo Health from the viewpoint of small businesses, whose employees and families, along with the self-employed, represent the largest proportion of uninsured in Maine’s population. She notes that rising costs of health care and insurance are a major threat to the viability of small businesses.
The Challenge Of Preserving And Expanding Affordable Health Care In Maine, Wendy Wolf
The Challenge Of Preserving And Expanding Affordable Health Care In Maine, Wendy Wolf
Maine Policy Review
Maine’s health care system is in crisis. The state’s health care expenditures represent the third highest percentage of Gross Domestic Product in the nation; state health care spending is projected to top $11 billion per year, or $8,291 per person per year, over the next seven years; businesses in Maine pay 12-23% more for coverage than the national and New England state averages; and, the state’s uninsured and vulnerable populations continue to grow. In this article, Wendy Wolf charts the rising cost of health care in Maine and the implications of these costs for all Mainers. In turn, she looks …
The Changing Nature Of Long-Term Care In Maine, Paul Saucier, Julie Fralich
The Changing Nature Of Long-Term Care In Maine, Paul Saucier, Julie Fralich
Maine Policy Review
The increase in the proportion of older adults, many with one or more chronic medical conditions, will increase the demand for long-term care. Paul Saucier and Julie Fralich discuss the socio-demographic factors affecting long-term care policy, and describe various state and federal options for providing and financing long-term care. They note that Maine’s long-term care system has so far been able to absorb considerable growth in people by serving increasing numbers in lower-cost settings. Cost sharing has been introduced, and tax policy has been changed to provide incentives for long-term care insurance. Policymakers must now consider whether the current balance …
Getting Creative About Elderly Housing, Frank O’Hara
Getting Creative About Elderly Housing, Frank O’Hara
Maine Policy Review
In his commentary on Stephen Golant’s article in this issue, Frank O’Hara notes that Golant has very successfully identified the problems of some older homeowners. However, he suggests that the solution Golant proposes—government-assisted rental housing—may apply to only a few members of the group. Moreover, very little government-subsidized rental housing is being built or planned in Maine. Using Golant’s data, O’Hara extrapolates that affordability is the primary problem for older Maine homeowners. He notes that very few are interested in the public policy alternative that would best meet their needs, namely reverse mortgages. However, he observes that older Maine homeowners …
Government-Assisted Rental Accommodations: Should They Accommodate Homeowners With Unmet Needs?, Stephen M. Golant
Government-Assisted Rental Accommodations: Should They Accommodate Homeowners With Unmet Needs?, Stephen M. Golant
Maine Policy Review
Stephen Golant, a national expert on elderly housing concerns, describes the types and seriousness of housing problems facing elders nationally and in Maine. Although older adults are predominantly homeowners, national policymakers often downplay the needs of this group and hand over responsibility to state and local governments. The author reviews arguments that cynics have offered for deemphasizing older homeowners’ needs, and discusses various solutions to meet those needs. He poses the question: Do we unrealistically romanticize aging in place? As the title of the article suggests, Golant proposes that a good solution to the needs of older homeowners is to …

The Securities Analyst As Agent: Rethinking The Regulation Of Analysts, Jill E. Fisch, Hillary A. Sale

Recent press has highlighted shocking examples of bias, self-dealing, and inaccuracy in the behavior of the securities analyst. Critics have attributed the bubble and subsequent crash in the technology sector to analyst hype and posited that undue analyst optimism contributed to scandals such as Enron. After many years of minimal regulator oversight analysts are now the subject of extensive regulatory reform proposals, including a mandate in the Sarbanes-Oxley Act of 2002 requiring that the Securities and Exchange Commission adopt a variety of restrictions on analyst behavior.
Despite the media attention, there have been few attempts to conceptualize carefully the analyst's …
Is There A Role For Lawyers In Preventing Future Enrons?, Jill E. Fisch, Kenneth M. Rosen
Is There A Role For Lawyers In Preventing Future Enrons?, Jill E. Fisch, Kenneth M. Rosen
All Faculty Scholarship
Following the collapse of the Enron Corporation, the ethical obligations of corporate attorneys have received increased scrutiny. The Sarbanes-Oxley Act of 2002, enacted in response to calls for corporate reform, specifically requires the Securities and Exchange Commission to address the lawyer’s role by requiring covered attorneys to “report up” evidence of corporate wrongdoing to key corporate officers, and, in some circumstances, to the board of directors. Failure to “report up” subjects a lawyer to liability under federal law.
This Article argues that the reporting up requirement reflects a second-best approach to corporate governance reform. Rather than focusing on the actors …

The Qualified Legal Compliance Committee: Using The Attorney Conduct Rules To Restructure The Board Of Directors, Jill E. Fisch, Caroline M. Gentile
All Faculty Scholarship
The Securities and Exchange Commission introduced a new corporate governance structure, the qualified legal compliance committee, as part of the professional standards of conduct for attorneys mandated by the Sarbanes-Oxley Act of 2002. QLCCs are consistent with the Commission’s general approach to improving corporate governance through specialized committees of independent directors. This Article suggests, however, that assessing the benefits and costs of creating QLCCs may be more complex than is initially apparent. Importantly, QLCCs are unlikely to be effective in the absence of incentives for active director monitoring. This Article concludes by considering three ways of increasing these incentives.
