The digital age brought many challenges for copyright law. While offering enticing new formats for the production and dissemination of copyright content, it also raised the specter of large scale digital piracy. Since the end of the 20th century, content industries have reeled to keep up with technological developments that offer significant promise as well as threats of large scale piracy. There has always been some tension between promoting innovation in content creation and promoting innovation in technologies that enable the enjoyment of copyright works, such as photocopiers, audio tape recorders, video tape recorders, and peer-to-peer file sharing systems. Offering Rss Feeds: Does It Help To Gain Competitive Advantage?, Dan Ma

Nowadays, many Websites have adopted the really simple syndication (RSS) technology to deliver online content to visitors. In this paper, I build an analytical model to examine how the offering of RSS feeds impact the number of visitors, total traffic load, and profit of Websites in a competitive setting. I show that although RSS can always attract more visitors, it may reduce the Website's profit. Interestingly, in a competitive market there are cases that the RSS feeds hurt the offering Website but benefit the competing Website instead. Toward A Unified Theory Of Access To Local Telephone Systems, Daniel F. Spulber, Christopher S. Yoo

One of the most distinctive developments in telecommunications policy over the past few decades has been the increasingly broad array of access requirements regulatory authorities have imposed on local telephone providers. In so doing, policymakers did not fully consider whether the justifications for regulating telecommunications remained valid. They also allowed each access regime to be governed by its own pricing methodology and set access prices in a way that treated each network component as if it existed in isolation. The result was a regulatory regime that was internally inconsistent, vulnerable to regulatory arbitrage, and unable to capture the interactions among …

On April 18-19, 2008, the University of Pennsylvania Law School hosted a landmark conference on “The Enduring Lessons of the Breakup of AT&T: A Twenty-Five Year Retrospective.” This conference was the first major event for Penn’s newly established Center for Technology, Innovation, and Competition, a research institute committed to promoting basic research into foundational frameworks that will shape the way policymakers think about technology-related issues in the future. New media has emerged as a significant dimension of branding and global sports sponsorship because it provides the capability to communicate with consumers worldwide via a multitude of digital platforms. This paper discusses the results of a systematic review of the development of global sports sponsorship and the importance of new media integration to the sector for the future. Results indicate that a new paradigm is emerging which involves thematically linked, integrated, strategic global marketing initiatives driven by new media applications, which have enhanced the value of sports sponsorship.

Online product reviews provided by consumers who previously purchased products have become a major information source for consumers and marketers regarding product quality. This study extends previous research by conducting a more compelling test of the effect of online reviews on sales. In particular, we consider both quantitative and qualitative aspects of online reviews, such as reviewer quality, reviewer exposure, product coverage, and temporal effects. Using transaction cost economics and uncertainty reduction theories, this study adopts a portfolio approach to assess the effectiveness of the online review market. In this Article, Professor Christopher Yoo directly engages claims that mandating network neutrality is essential to protect consumers and to promote innovation on the Internet. It begins by analyzing the forces that are placing pressure on the basic network architecture to evolve, such as the emergence of Internet video and peer-to-peer architectures and the increasing heterogeneity in business relationships and transmission technologies. It then draws on the insights of demand-side price discrimination (such as Ramsey pricing) and the two-sided markets, as well as the economics of product differentiation and congestion, to show how deviating from network neutrality can benefit consumers, …

The Olympics in Beijing has been a great disappointment. No one has collapsed into a coughing fit from the air pollution. This seemed a certainty from all the reports leading up to the opening of what are so quaintly termed “the games.” The American cyclists who arrived in the Beijing Airport wearing face masks seemed to have made it through the opening ceremonies without contracting “black lung” or suffering a terminal case of “ring around the collar.” I feel I have been let down yet again by the press.

Some will remember it as nearly replicating the game of 2002 in Milwaukee when the managers ran out of players and someone (the Commissioner) had the good sense to stop the game. We have arrived at that moment in mid-summer when baseball takes a break for the All-Star Game. I read the other day that Wednesday will be the only day of the year in which there is not a major professional sporting event taking place in the United States. That is a fact worth some thought and contemplation and may lead to some conclusions about overkill and saturation. Rather than that, I would like to make a few observations about the current baseball season which I have found to be strange and maybe even portentous.

Yesterday the long and courageous struggle of Jules Tygiel ended. For the last several years Jules has been battling cancer with considerable success against high odds. In the past several weeks the options for treatment began to close down, and from his last health update two weeks ago it was clear that the battle was coming to its tragic conclusion.

The article discusses the duties and responsibilities of managers in assessing workplace threats. Managers should care when someone causes harm in the workplace. It is a duty of the managers to warn through a collaborative discussion about the advantages or drawbacks in a small group meeting. It is also an obligation of managers to act when an employee indicates that he or she is being harassed or threatened.

Big Brown's victory at The Preakness yesterday has set the stage for a possible Triple Crown winner. At Belmont Park on June 7, and in the three weeks leading up to it, there will be much excitement and speculation in anticipation of Big Brown's big race. Ten horses have made it to this stage over the past three decades only to fall short at the Belmont Stakes. Nearly all of these ten, and now Big Brown, were felt to have an excellent chance to join the elite group of Triple Crown winners.

I have been trying to remember a time when two players who dominated their sport retired within a day of one another. Two of the most significant people in sport have walked away well before time demanded. In the case of Justine Henin the fact that she is only 25 adds to the surprise, while even with Annika Sorenstam at age 37 it seems as if she is leaving early.
