Consumers who want to express themselves by wearing contemporary clothing styles should not have to choose between expensive brands and counterfeit products. There should be a clear distinction in trademark law between illegal, counterfeit goods and perfectly legal (at least with respect to trademark law) "knockoffs," in which aesthetically functional design attributes have been copied but trademarks have not. Toward that end, as a normative matter, the aesthetic features of products should not be registrable or protectable as trademarks or trade dress, regardless of whether they have secondary meaning, just as functional attributes of a utilitarian nature are not eligible …

As direct-to-consumer marketing of medical genetic tests grows in popularity, there is an increasing need to better understand the ethical and public policy implications of such products. The complexity of genetic tests raises serious concerns about whether consumers possess the knowledge to make sound decisions about their use. This research examines the effects of educational intervention and feedback on consumers' genetic literacy and calibration -- the gap between consumers' actual knowledge and how much they think they know. The authors find that consumers' genetic knowledge was generally low and that people tended to underestimate their knowledge level. Furthermore, consumers' perceived …

A large Mexican-American population already exists in Los Angeles and, with each generation, it continues to rise. This Mexican-American community has maintained its connection to its heritage by playing and watching soccer, Mexico’s top watched sport. In this thesis, I analyze how Major League Soccer's Chivas USA serves as an outlet through which many Mexicans in Los Angeles have developed their ethnic identities. Since the early twentieth century, Mexicans in Los Angeles have created separate residential communities and sports organizations to strengthen their connections with one another.

This dissertation explores the various ways in which the multiple leaders portrayed in the science fiction television series Battlestar Galactica (2003-2009) navigate extreme conditions of continual change. In addition, the dissertation contains a discussion of the larger narrative themes of love, forgiveness, redemption, and embracing the Other as principles effective leaders must cultivate. Through an interpretation of this specific popular media text, a deeper emotional sensitivity to and understanding of leadership, positive and negative, during extreme crises is gained. This dissertation examines various aspects of economic and social consequences associated with the history of coffee production in the rural municipality of Senahú, a province located in the central Guatemalan province of Alta Verapaz that is home to one of the four major Mayan language groups in Guatemala; the Q'eqchi' Maya. In particular, the investigation is concerned with how German and other Anglo-European entrepreneurs initiated large-scale coffee production in the late 19th century and the social and economic disparities that arose with the early successes of large-scale coffee production. Previous research suggests that women entrepreneurs face many challenges in starting and growing a business. In this study, we examine the relationship of intangible resources and the growth of women-owned businesses. We focus on four intangible resources: social-, human-, and reputational capital, as well as social competence. Using case studies of women entrepreneurs, we found that a woman entrepreneur’s social-, human-, and reputational capital are related to the growth of her business. We alsofound that social competence moderates the social-, human-, and reputational capital – growth relationship in women entrepreneurs.

During the 1970s college campuses in the United States were often the venue through which change occurred. Female faculty and students were assertive in their efforts to influence equality between men and women across the country (Morris, 1984). This historical phenomenological study examined the oral history of several women who advocated for women's rights at Old Dominion University (ODU) by establishing the Women's Caucus, Women's Studies Program, and Women's Center during the late 1970s through the 1990s.

Advances in collaborative work tools and communication technologies have made computer-mediated teams a part of virtually every organization. One of the challenges for members of virtual teams is the development of trust. This study examined the reciprocal relationship between trust and effectiveness in virtual teams, employing an input-process-output-input approach. Data were collected from 183 individuals comprising 61 teams. Teams participated in a computer-simulated search and rescue mission. Three alternative latent change score structural equation models were fit to the data to examine the bidirectional relationships between trust and effectiveness. Results revealed that the two

This study seeks to determine whether the process of mortgage finance liberalization, manifested in concurrent activities of securitization, deregulation, and neo-liberal policy, have resulted in changes to the tenure of residents in neighborhoods in Tampa Bay. It makes use of existing literature on gentrification and mortgage finance and compares those findings with three sample neighborhoods in and around the city of Tampa. In recent years, a sense of community has declined throughout the United States. Common Point Community Church has responded to this trend by prioritizing "community" as an organizational metaphor. The present study explores how this metaphor is co-constructed through the communication practices of current organizational leaders and members. I begin this process, first, by positioning the study within existing literature on institutional theory, institutional legitimacy, community, community of practice, social construction of race, sensemaking, organizational metaphor, tension-centered approach, and dialectic theory. The Mediating Role Of Regulatory Focus In The Relationship Between Transformational/Transactional Leadership And Follower Work Outcomes, Erin J. Walker

The purpose of this research was to integrate the areas of leadership and motivation by examining how leaders' behaviors affect their followers' regulatory foci. Specifically, a separate laboratory experiment and field survey were conducted to determine whether leader transformational and transactional behaviors shape followers' work-based promotion and prevention regulatory foci, which in turn affect followers' outcomes at work. Overall, there was limited evidence that inspirational motivation and contingent reward leader behaviors were related to follower work-based regulatory focus, and work-based regulatory focus was related to several work-related outcomes. This study analyzes the differences between the neoliberalist and the Keynesian perspectives used in the debates emerged from the current economic crisis. The common good ethics is presented as a paradigm for recuperating the social, human and moral responsibilities of economic development. The assumption is that neoliberal economic models have produced prosperity but also technocracy, inequality and discontent. Through the examination of the principles of solidarity, subsidiarity, sustainability and synchronicity used in Catholic Social Teaching, the author introduces an integrated model for ethical decision-making beyond ideological divisions and for the common good.
