A Feedback Loop Of Exclusion: The Treatment Of Bilingualism In The Courtroom, Simone Stover

Northwestern University Law Review

In the 1991 case Hernandez v. New York, the United States Supreme Court characterized bilingualism as a race-neutral trait that can be used to exclude individuals from jury service. This Note proceeds by demonstrating how the current state of the law undermines the interests of bilingual individuals and then proposes a solution. Focusing specifically on Hispanic bilingual Spanish speakers, this Note first employs Professor Jennifer Lackey’s multi-directional credibility model to show that bilingual Spanish speakers suffer injustice in the courtroom due to both credibility deficits and excesses. The research questions in this essay ask whether or not the Nebraska State Archives contains literature in the Russian and Spanish languages. These documents, and others written in English on the same topic, are introduced and analyzed throughout the essay, exploring the history of immigrants from Russia and Latin America. As well as history, the documents delve into the current state of these immigrant groups, and how their traditions have changed Nebraska and continue to influence it today. Luis Jiménez’s Southwest Pietà (1984) intended to combat cultural amnesia that obscured Native Americans’ and Mexicans’ contributions to the state. Jiménez’s Pietà sought to counter the iconography that shaped New Mexico’s colonialist heritage. But Old Town Albuquerque shrouds Native American and Mexican contributions to the region. Albuquerque’s public art has often been deployed as a wedge to write and rewrite narratives about land inhabitants, but the city’s public art tells a powerful story about race and place in New Mexico. Christ Child Bearing the Instruments of the Passion (acc.# 228017) is a 17^th century Peruvian Viceregal painting on copper belonging to the Carl & Marilynn Thoma Art Foundation. The painting depicts the Christ Child on a flower laid path as he carries the instruments of the passion also known as the Arma Christi Paintings executed on copper convey new and challenging preservation issues based on their materials and techniques.. The work had been heavily restored and exhibited several condition issues, including significant overpaint and broad losses. Latinas currently make up 76% of overall Latino/a/e participation in psychology (American Psychological Association, 2022); however, the numbers of Latinas in top echelon leadership positions are low (National Center for Education Statistics, 2021, 2022). Notedly, the information on the current state of Latine representation in the field of psychology is even more limited. The Petitioning for Freedom Project is an NSF funded database project that seeks to collect and encode carceral, institutional, and interpersonal habeas corpus petitions from county, state, and federal courts all throughout the American West.

This research project explores and analyzes the twenty-four habeas corpus petitions that were submitted between 1851 and 1857 to the Saint Louis County Law Commissioners Office to challenge the enlistment of underage recruits stationed at Jefferson Barracks.

Maternal Chains: Black Women's Legal Battles For Freedom In Pre-Emancipation America, Roshawnna Brinkley

This research examines the use of habeas corpus petitions by Black Women in antebellum America to secure freedom for themselves and their children. Given that slave status was inherited matrilineally, these legal actions had implications for generational freedom. In Dr. Jagodinsky’s Petitioning for Freedom project there are numerous cases of Black Women utilizing Habeas Corpus. This study focuses on these Women's agency in navigating a hostile legal system.

I am from Oxnard, California, a predominantly Latinx city that is stereotyped as “too hood”, “too ghetto”, or “crime-infested” because of its low-income Brown people. Such negative narratives are so commonplace that they become believable, but we can challenge these oppressive narratives using critical race counterstorytelling. There are multiple ways to tell a story, and I pride myself in producing counterstories that are accessible and enjoyable to mi gente. Exploring The Social Processes Influencing The Well-Being And Social Integration Of Systemically Marginalized Students In Higher Education: A Mixed-Methods Approach, Zeinab Abbas Hachem

Comprising two manuscripts, this dissertation employs a mixed-methods approach to comprehensively examine the intrapersonal and interpersonal processes influencing the socioemotional well-being and social integration of systemically marginalized students. The first manuscript quantitatively explored the relationship between ethnic identity commitment and indices of well-being, the mediating role of social relationships, and the moderating roles of gender and immigrant generation status among Latinx college students (N = 707). Results suggested that ethnic identity commitment was positively associated with socioemotional well-being. Although both types of relationships were significant mediators on their own, maternal (vs. peer) relationship quality was the stronger mediational influence. Furthermore, …

Carrying Meaning, Bridging Worlds: Indigenous Language Localization In Western Courts, Nora K. Rivera

This work examines the localization practices of Indigenous court interpreters through prototyping and analyzing legal glossaries in eight Indigenous languages from the State of Oaxaca, Mexico. These languages are often needed in Mexican courts and immigration court hearings in the United States. Thus, examining the localization praxes of the court interpreters who use them can provide important intercultural technical and professional communication insights in global contexts. I compare the preliminary results of this ongoing study with the court interpreters' code of ethics from the State of California to demonstrate how Western court assumptions about language interpretation cause gaps between worldviews. …

This dissertation explores contemporary literary manifestations in the Canary Islands and the Spanish-speaking Caribbean, with a stronger focus on the islands of Tenerife and Puerto Rico. Through an archipelagic approach, this study delves into the analysis of Los lenguas cortadas (2020) by Cirilo Leal, Boat People (2005) by Mayra Santos-Febres, Panza de burro (2020) by Andrea Abreu and PR3 Aguirre (2018) by Marta Aponte Alsina. The analysis states that these literary works build alternative forms of affective archives of archipelagic memory.
