This study examines the ethical and structural limitations of the Expanded Access program in the United States, with particular focus on its application to terminal pediatric illness. Although the program is intended to provide patients with life-threatening conditions access to investigational therapies outside of clinical trials, its effectiveness in serving critically ill children remains uncertain. This program is analyzed through careful consideration of regulatory review and ethical theory. This dissertation starts from the position that the stability of liberal-democratic political schemes relies on its citizens mutually accepting a basic conception of political justice. While these conceptions of justice may vary, most incorporate the inter-connected concepts of autonomy, liberty, liberalism, and the rule of law. Within this conception of a liberal democracy, a potentially destabilizing issue arises when a legislatively passed law is put into effect, but a portion of the citizens perceive it as unjust. Hannah Arendt’s 1958 book The Human Condition describes modernity through the lens of the vita activa. While useful in understanding human experience with modernity, the way the world has advanced makes the vita activa insufficient for describing our present world. I argue that the world is now in a state of hypermodernity, and use the vita activa to describe how powerlessness develops in the face of large-scale hypermodern crisis. The concern of hypermodernity is that humans experience an inability to perform true action, and this results in powerlessness. What is civil disobedience? Civil disobedience is often thought of as peaceful protesting or non-violent law breaking. However, the textbook definition is “the refusal to obey the demands or commands of a government or occupying power, without resorting to violence or active measures of opposition” (Britannica). Peaceful protesting has been an integral part of American history. Henry David Thoreau, Rosa Parks, and Martin Luther King Jr. were all civilly disobedient citizens who altered the course of history. Any and all protests, however, cannot be considered civil disobedience, since there are some requirements of this category.

This paper aims to develop a strong account of recognition. It begins with a Hegel-inspired account of recognition as a fundamental desire that drives humanity. This account establishes recognition as fundamental to the initial subject formation of independent self-consciousnesses as agents. I offer the lord-bondsman dualism to provide a critique of domination as oppositional to securing the means for recognition. We can reconceptualise warfare by contrasting Clausewitz with the modern practice of cognitive warfare, as evidenced by Ukraine’s defence methodologies. The strategic orchestration of ‘infopolitik’ and the sophisticated use of social media can shape narratives and public perception. This article revisits Clausewitz’s tenet of war as a political instrument and juxtaposes it with contemporary conflict’s multidimensional tactics. Jonathan Neufeld proposes a concept of aesthetic disobedience that parallels the political concept of civil disobedience articulated by John Rawls in A Theory of Justice. The artistic transgressions he calls aesthetic disobedience are distinctive in being public and deliberative in their aim to bring about specific changes in accepted artworld norms. We argue that Neufeld has offered us valuable insight into the dynamic and potent nature of art and the artworld; however, we contend that Neufeld errs by constraining aesthetic disobedience to the artworld. The second conjunct of the Republic’s account of justice—that justice is “not meddling in the work of another”—has been neglected in Plato literature. This paper argues that the conjunct does more work than merely reiterating the content of the first conjunct—that justice is “doing one’s own work.” I argue that Socrates develops the concept at work in this conjunct from its introduction with the Principle of Specialization in Book II to its final deployment in the finished conception of justice in Book IV.
