What is the law and society framework and where has it gotten us? A student in a classroom might raise their hand and offer "understanding legal pluralism" as a possible answer. However, the conceptual problem with legal pluralism is the coexistence of potentially conflicting bases of justification. Given this, desiring to understand how the law shapes the structural underpinnings of whichever "legal" phenomena and its "ongoing transformation", is nevertheless an immense achievement that stops short of its underlying goal – the achievement of human dignity through human rights. Construing Character: Virtue As A Cognitive-Affective Processing System, Denise Vigani

This dissertation, Construing Character: Virtue as a Cognitive-Affective Processing System, develops an empirically plausible account of neo-Aristotelian virtue based on the psychological model of personality as a cognitive-affective processing system. The psychological model holds that an individual’s subjective construal of a situation is crucial to understanding that individual’s behavior. The account of virtue developed in the dissertation begins, therefore, with an elaboration of the distinctive way in which the virtuous person construes situations, which is used to develop and defend a McDowellian view of practical reasoning. The central question of my dissertation is: what makes it the case that certain considerations are reasons for acting? This is a question about the truth-makers of claims about reasons, that is, what makes it the case that one has a reason to Φ rather than Ψ. There are two leading camps in the philosophical debate devoted to answering this question: subjectivism and objectivism. Subjectivist theories hold that one has a reason to do something when one has a non-truth evaluable favoring attitude towards that thing, e.g. desiring it. Objectivist theories insist that one’s desires are irrelevant to establishing the …

Previously, I examined the establishment of a person’s substantive rights and, correlatively, duties. But this was only the first step. This Article addresses the second step: the means for recognizing requital rights violations, including their articulation, adoption, and implementation. Taking a deontic, individualistic perspective on rights, this Article aims to delineate and protect one’s personal freedom, one’s autonomy. To do so, this Article, using a formal understanding of the categorical imperative, will examine whether an agent’s chosen maxims are deontically acceptable. The maxims need to be both first-order, substantive ones that establish autonomy boundary baselines, and second-order, requital ones that …

Many people seem to understand the term 'dignity' as applying to all human persons regardless of their race, creed, sex, or religious beliefs. As to what the concept 'dignity' means is a difficult and complex problem. Is the concept 'dignity' an empty concept, void of meaning? What does it mean when we say that this or that person has dignity? Most of the current philosophical literature has very little to say as to what dignity is. Peasant Revolts As Anti-Authoritarian Archetypes For Radical Buddhism In Modern Japan, James Mark Shields

The late Meiji period (1868-1912) witnessed the birth of various forms of “progressive” and “radical” Buddhism both within and beyond traditional Japanese Buddhist institutions. This paper examines several historical precedents for “Buddhist revolution” in East Asian—and particularly Japanese—peasant rebellions of the early modern period. I argue that these rebellions, or at least the received narratives of such, provided significant “root paradigms” for the thought and practice of early Buddhist socialists and radical Buddhists of early twentieth century Japan. Even if these narratives ended in “failure”—as, indeed, they often did—they can be understood as examples of what James White calls “expressionistic …

An Account Of Virtue And Solidarity From Pakikipagkapuwa, Jacklyn A. Cleofas

There has been a resurgence of interest among philosophers in Asian conceptions of virtue. In this paper I derive and develop an account of virtue in general, and solidarity in particular, from two Filipino concepts: pakikipagkápuwâ (comradeship with fellow humans) and pakikiramdám (emotional sensitivity). The primary source used for the discussion of these concepts is Filipino psychology, which allows for an account of virtue that is grounded in a particular cultural practice. The ensuing account of virtue, however, is not just contextsensitive; it also showcases an aspect of Filipino culture that has a potential for universality. More specifically, the account …

I will be addressing the broad set of impacts generally referred to as "the environmental crisis.” I argue that this environmental crisis is truly an ecological one, insofar as humans are its primary drivers as well as its primary victims. I then investigate the structural cause (or structural causes) which produce this multitude of effects. In turn, this leads me to seek out and address the social underpinnings of this problem. I identify capitalism (specifically, its current form of global neoliberal economics) as a major driver of the ecological crisis and explore the relationship between capitalism and environmental practice.
