Operational Responsibility In Ai Governance: A User-Centric Liability Framework, Zhengyang Chen

Who bears responsibility when artificial intelligence systems cause harm? This question has become central to AI ethics and governance. Most existing approaches focus on developers, yet this faces serious practical and theoretical problems. Drawing on tort law, agency law, and philosophy of technology, this paper argues that AI should be understood as an instrument whose outputs remain the responsibility of human operators rather than developers. We call this 'user-centric governance.' Placing accountability with deployers promotes public trust by creating clear lines of responsibility, a concern that governance approaches have often overlooked. People are tasked with making decisions that often come with consequences, whether it be for someone else or themselves. Due to this, there is an ambiguity in understanding what is “right” and “wrong” in a given scenario. However, limited research has examined how interpersonal relationships and intensity of the punishment may affect this decision-making process. This study examines the effect of interpersonal closeness and punishment intensity on moral decision-making, defined in terms of fairness and empathy. Is health deserved? Is your health owed to you? What does this mean, and whose responsibility is it? I argue that American culture’s use of  personal autonomy, “framing”, and ethical intimidation has stunted the improvement of both political and legal structures. This is evident in the politicization of the ‘for-profit’ healthcare system in the United States. American policymakers frequently weaponize moral foundations in order to coerce voters into supporting or opposing certain healthcare policies derived from the principle that some people are more "deserving" of health than others. It emerges from the work of the National Collaborative on Humanities and Ethics in Dentistry (NCHED), a multi-institutional partnership formed in 2023 to address the persistent exclusion of dentistry from broader health humanities conversations. Now, youth sports use private pay-to-play, or “competitive” sports models. In this paper, I explore some of the ways in which artificial intelligence might enhance the sentencing process through recidivism prediction technology. Notably, this technology can increase the accuracy of risk predictions and the speed with which sentencing decisions are reached. I then show, however, that the recidivism prediction technology is likely to turn into what data scientist Cathy O’Neil calls a Weapon of Math Destruction. The recent wave of anti-LGBTQ+ politics and policies in Florida pose potential risks to the mental health and well-being of Florida’s LGBTQ+ students. The present study surveyed LGBTQ+ students attending private colleges in Florida to measure their self-reported stress levels in comparison to non-LGBTQ+ students, the level at which they believed specific sources of stress contributed to their stress levels, their level of distress upon experiencing discrimination, their sense of sexual identity distress, and their awareness of and involvement in advocacy against Florida’s anti-LGBTQ+ bills. A system of civil recourse is a precondition for a just society. In this paper, I outline the ideal version of a system of civil recourse and analyze the accounts of various liberal philosophers to explain how a non-instrumental and mutual accountability theory of civil recourse best encapsulates its stated purpose. I analyze the American system of civil recourse, specifically tort law, and argue that it bypasses the threshold of tolerable injustice for marginalized people in the United States. Racial discrimination and inequality have perpetuated within the U.S. since its inception. In 2016, Colin Kaepernick initiated the national anthem protests to oppose the oppression of people of color in America. This study was developed in 2018 to identify social determinants of health underlying discriminatory beliefs and behaviors. The objective was to investigate the impacts of college students’ race, gender, political ideology, socio-economic status [SES], NFL interest, patriotism, and general protest support on support for the national anthem protests.
