Describes a theory of gaming inspired primarily by Jean Baudrillard’s claim that gaming is characterized by a “passion for rules.” Key elements of the theory include that games are an attempt to create a new reality, that games create a space for individuality even in an otherwise homogenized world, and that pain and happiness are not diametrically opposed concepts to the gamer. The theory also emphasizes the importance of the player’s meeting with the “superplayer,” the player’s own constructed ideal that he tries to imitate within the game world. Small medical and dental practices must comply with the Health Insurance Portability and Accountability Act (HIPAA) of 1996, and Title XIII Health Information Technology for Economic and Clinical Health (HITECH) of the American Recovery and Reinvestment Act (ARRA) of 2009. The case study, utilizing interviews, observations, and existing documentation of two medical and the two dental practices, not only analyzed the compliance solution choices made involving procedures and technologies, but also analyzed the emotion aspects of fear of non-compliance, perceived confidence in compliance, and the primary and secondary appraisals of the compelled compliance. This study considered the impact of explicit teaching of misconceptions regarding randomness on cognitive growth of preservice teachers. Specifically, the purpose was to compile and validate instructional materials that facilitate preservice teachers’ conceptual understandings of randomness. The quasiexperimental design compared the cognitive effects of the instructional materials. Hence, in addition to the instructional materials, assessment instruments were compiled and validated. These items were intended to illuminate the cognitive growth resulting from the treatment instruction. The convenience sample of 67 students represented approximately one third of the teacher-education students enrolled in a mathematics education content course at this institution. Three sections …

In the first part of this article, we summarize the standardized version of the model of the interaction between scientific activities and values (M-CV) presented in Lacey & Mariconda (in press). Then, we sketch some arguments, developed (Lacey, in press) from the model, in favor of three proposals: (1) that there is a profound incoherence in the self understanding of the modern scientific tradition; (2) that the main options actually available to ensure continuity with the positive realizations of this tradition can be well represented by two sorts of ideal types that we name, respectively, "commercially orientated technoscience" and "multi-strategic …

An Environmental Value Engineering (EVE) analysis was used to conduct an environmental life cycle assessment of transportation alternatives consisting of high-speed passenger rail and interstate passenger car transportation. This analysis was formulated on the EMERGY inputs of environment, fuel energy, goods, and services (labor). EMERGY input tables were calculated based on subsystem inputs for each mode of transportation. Areas of commonality were identified for analysis exclusion while aspects that showed differentiation were included as viable inputs into the calculation of the total EMERGY for each system. I stand in fundamental agreement with what Thomas Schärtl has said in his article describing recent trends in US Catholicism. I am a lifelong Catholic and a lifelong Democrat. I felt personally distressed and discouraged by the support given to Mitt Romney and the Republicans by some leading US Catholic bishops. Most of this support may have technically passed the legal test of being nonpartisan, but undeniably it functioned in a partisan manner, as did the attacks launched on President Obama in the midst of a campaign to defend religious liberty. In my remarks here, I will try to defend Claus’s iconoclastic tone by identifying the important difference between prediction theories of law and Hart’s. I start with a number of distinctions. By a prediction theory of law I mean a theory under which a statement about the law, such as “The Securities Exchange Act is valid law,” is a prediction of the behavior and attitudes of people in a community. It is customary in a symposium honoring a book as valuable as Laurence Claus’s for the commentators to begin by noting their general agreement with the author’s thesis and then explaining that, in the spirit of academic engagement, they will focus on one small but interesting area in which the author and the commentator disagree. Alexis de Tocqueville (1805-1859) is best remembered in the United States for Democracy in America, his penetrating study of life in the early nineteenth-century. Tocqueville was, of course, an analyst of his own France, and his The Old Regime and the Revolution remains a classic analysis of pre-Revolutionary and Revolutionary France. Less well-known, however, is that Tocqueville was also keenly interested in England, traveling to England several times and following with great interest the political and social developments there during his lifetime. I argue that a Humean account can make sense of the phenomenology associated with testimonial justification; the phenomenology being that in standard cases hearers regularly simply accept a testifier’s assertions as true – hearers don't engage in monitoring. The upshot is that a Humean account is in a better position dialectically than is usually supposed. I provide some background to the debate before setting out two challenges facing accounts of testimonial justification. In this thesis I explore the conception of the mountain as a "sacred space" based on the definition provided by Mircea Eliade in The Sacred and The Profane and other works. I recognize three major elements in Eliadean sacral spatiality: a) order and orientation b) liminality and c) reality. Using various sources but mainly the oracle bones inscriptions, the Yugong ("Tributes of Yu") of the Shujing ("Book of Documents") and the Shanjing ("Classic of Mountains") of the Shanhaijing ("Classic of Mountains and Seas"), I demonstrate how the three basic components of sacrality are to be found in each of the …

This is the first known study to examine the relationship between Native identity and psychological well-being, which is defined by Ryff in positive psychology as existential strengths. It is also the first known study to investigate the relationship between Native identity and blood quantum through quantitative measures. Overall, 199 Natives from two American Indian Centers, three Indiana powwows, and online from Facebook participated by completing the Ryff’s Scales of Psychological Well-being, Phinney’s Multigroup Ethnic Identity Measure, and demographic information. The purposes of the study included examining how four-year institutions of higher education define student success, measuring student success, and examining how words associated with student success were used to appeal to people interested in college degree attainment. Information from the Carnegie Classification of Institutions of Higher Education was used to obtain a sample of 30 academic institutions with similar attributes to Indiana State University. Websites from Academic Affairs, Office of the President, and Student Affairs were examined for mentions of student success. The purpose of this study was to examine high school teachers’ perceptions of technology in the classroom, including technology access, usage, and effectiveness. This study was conducted by administering a survey to high school teachers, Grades 9 through 12, in Indiana. The survey, entitled Teachers’ Perceptions of Technology Effectiveness in High Schools was used with high school teachers’ to determine their perceptions of technology access, usage, and effectiveness in classrooms. A total of 343 teachers submitted complete responses to the Teachers’ Perceptions of Technology Effectiveness in High Schools. The topic of this paper is the logical analysis and translation of definite descriptions (structures of the form ‘the F’), in particular Bertrand Russell’s Theory of Descriptions, as put forth in “On Denoting” (1905). I argue in favor of an opposing theory, a presuppositional analysis of definite descriptions that fits in the tradition of Frege and Strawson, building upon the recent work of Heim and Elbourne. I argue that a definite description has a referential function that is supported by presuppositions of existence and uniqueness located outside of the analyzed sentence.
