Justice In Context: Assessing Contextualism As An Approach To Justice, Michael Buckley

Publications and Research

Moral and political philosophers are increasingly using empirical data to inform their normative theories. This has sparked renewed interest into questions concerning the relationship between facts and principles. A recent attempt to frame these questions within a broader approach to normative theory comes from David Miller, who has on several occasions defended ‘contextualism’ as the best approach to justice. Miller argues that the context of distribution itself brings one or another political principle into play. This paper examines this claim. It considers several plausible strategies for carrying out Miller’s general project and argues that each strategy fails. Nevertheless, the author …

Every ethical situation has a "system" characteristic with a group of human and nonhuman elements linked in a variety of interactions and interdependencies. The system allows the elements to act in part or as a whole towards achieving a spectrum of goals, objectives, or ends. The systems view asserts that any local and bipolar understanding of an ethical situation would be deficient as it would neglect certain interactions and interdependencies as well as overlook differing orientations of agents towards different goals and objectives. The purpose of this paper is to highlight the need for a systems-based view of ethics.

In an otherwise superbly edited compilation of student notes from Wittgenstein’s 1939 Lectures on the Foundations of Mathematics, Cora Diamond makes a false step that reveals to us our own tendencies to misread Wittgenstein. The student notes she collated attributed the following remark to a student named Watson: “The point is that these [data] tables do not by themselves determine that one builds the bridge in this way: only the tables together with certain scientific theory determine that.” But Diamond thinks this a mistake, presuming instead to change the manuscript and put these words into the mouth of Wittgenstein. …

Knowledge of our roots can sometimes help us figure out how we ought to proceed. Many claim that engineering began in ancient antiquity with the Egyptian pyramids, Archimedes' inventions, or the Roman aqueducts. Others give contemporary engineering a more recent history, tracing its origins to the Industrial Revolution or the Enlightenment. Yet what is often overlooked is the fact that contemporary engineering owes part of its identity to medieval monasticism.

The advantage of remembering this history is the bearing it has on the questions "What is engineering for?" and "How ought engineering be practiced?"

In this paper, Jack Mulder, Jr. argues that those who hold 1) the major Christological and Trinitarian tenets of the historic Christian faith and 2) the view that original sin and its psychological consequences are in some way inherited and not learned (which includes a wide swath of leading figures in the historic Christian tradition) have strong reasons for why they should also hold that the Virgin Mary never received original sin (or its psychological consequences).

Although previous studies examined the ethical dilemmas faced by student affairs administrators (Janosik, Creamer, & Humphrey, 2004; Janosik, 2007), no such study explored the ethical dimensions of administering student conduct. The purpose of this mixed method study was to identify the ethical dilemmas experienced by student conduct administrators and to test the applicability of Kitchener's model as a framework for resolving ethical dilemmas. Also examined were the theories, professional codes, and core values informing ethical decision making. Further, the study explored possible correlations between knowledge of ethical principles and codes, and actual use of the ethical principles and codes. Finally, …

The definitions of ‘deduction’ found in virtually every introductory logic textbook would encourage us to believe that the inductive/deductive distinction is a distinction among kinds of arguments and that the extension of ‘deduction’ is a determinate class of arguments. In this paper, we argue that that this approach is mistaken. Specifically, we defend the claim that typical definitions of ‘deduction’ operative in attempts to get at the induction/deduction distinction are either too narrow or insufficiently precise. We conclude by presenting a deflationary understanding of the inductive/deductive distinction; in our view, its content is nothing over and above two sorts of …

Philosophy

Developmentalism is a theory concerning the order of composition and the interpretation of Plato's dialogues. It is a modern phenomenon; ancient interpreters of Plato were ' unitarians' (Annas 1999:3-5; unitarians believe that there is a systematic unity of Platonic doctrine or belief among all the dialogues). There are several varieties of developmentalism; what is common to them all is the idea that the philosophical views contained in the dialogues, which are taken to reflect Plato's own views, changed significantly over time.

The Force Of Reason : An Argument Against David Hume's Doctrine On The Inertness Of Reason, Damian Christopher Thibeault

Is human reason capable of being the direct cause of an action? David Hume's answer to this question was an unequivocal no. He argues that "reason is perfectly inert," and instead claims that only our emotions are capable of moving us. The argument of this paper is that given Hume's empirical account of causation, as he establishes it in Book One of his Treatise of Human Nature, his inertia of reason doctrine fails. This paper will demonstrate that Hume has not shown--and perhaps cannot show--that reason is incapable of causing action.

This thesis focuses on the relationship of Michel Foucault's concepts of madness and confinement through three Gothic stories by Edgar Allan Poe: "The Imp of the Perverse", "Hop Frog", and "The System of Doctor Tarr and Professor Fether". It seeks to recognize the way Poe lures the reader into the unconscious mind of the madman, and how that madness is decisively endured. Also, it investigates how these Gothic texts negotiate the physical and incorporeal boundaries of confinement created by, and established for, the mad.

The goal of this dissertation is to analyze the kinds of ethical challenges soldiers encounter during counterinsurgency operations, what decision making processes or values they use to resolve these challenges, and how military institutions and culture influence soldiers' ethical reasoning. The first part of the dissertation is an assessment of various theories of applied ethics and how these can be used by soldiers during counterinsurgency operations. The second part discusses the institutions and cultures of the American Army, British Army, and Israeli Ground Forces. In the third part, I take up the problem of how soldiers from each of these …
