International instruments now defend a “right to the truth” for victims of political repression and violence and include truth telling about human rights violations as a kind of reparation as well as a form of redress. While truth telling about violations is obviously a condition of redress or repair for violations, it may not be clear how truth telling itself is a kind of reparations. This dissertation explores the "Is"--"Ought" problem (IOP) as it relates to natural law theory (NLT). It begins with a brief analysis of the type of "ought"--precepts upheld by traditional natural law theorists as well as a consideration of the precise nature of the IOP. Chapter two considers the attempts of Searle and Gewirth at establishing that it is possible validly to derive an "ought"--conclusion from "is"--premises and asks whether their attempts can be imitated successfully by those who wish to uphold the basic claims of NLT. Feminist epistemologists have long been concerned with clarifying the legitimate roles that social and ethical values might play in the acceptance or justification of empirical theories and beliefs. Their concern stems, at least in part, from what Louise Antony has defined as the ‘bias paradox’ (1993). Whereas in earlier works, with concepts such as “performativity,” Butler put the ethical and critical capacities of the subject into perspective, works such as Giving an Account of Oneself, Precarious Life (2004) and to some extent Antigone’s Claim (2000), give the impression of a “turn” to ethics.

We argue that the modus operandi of data analysis is implicitly based on the belief that if we have collected enough and sufficiently diverse data, we will be able to answer most relevant questions concerning the phenomenon itself. This dissertation addresses the question of marginalization in cross-cultural communication from the perspectives of hermeneutic philosophy and postcolonial theory. Specifically, it focuses on European colonialism‘s effect on language and communicative practices in Latin America. I argue colonialism creates a deeply sedimented but unacknowledged background of inherited cultural prejudices against which social and political problems of oppression, violence and marginalization, especially towards women, emerge—but whose roots in colonial and imperial frameworks have lost transparency.
