The Return Of Lost Property According To Jewish & Common Law: A Comparison, Michael J. Broyde, Michael Hecht

This article compares the legal rules and jurisprudence of the American common law and Jewish law in the area of finding and returning lost or abandoned property, illustrating the interplay between the purely legal and ethical components of the respective legal systems. Surprisingly enough, the differences between the two systems are not usually significant; they follow the same basic legal principles, and typically lead to the same results. There are, however, two major exceptions: Jewish law imposes a duty to rescue the lost property of one's neighbor, while the common law does not require that one initiate the process by …

Scholarly Works

A roundtable discussion about the relevance of contemporary hermeneutical philosophy for legal theory raises a foundational question often neglected in interdisciplinary articles: What is the relationship between law and philosophy? The burgeoning scholarship drawing connections between legal theory and philosophy increasingly has come under attack for displaying a naive view about the potential legitimate exchanges between philosophers and legal academics. I have written elsewhere at length about the important insights that philosophical hermeneutics can lend to jurisprudential discussions of the rule of law. The goal of this thesis is to construct a solid base of information that will inform and help direct discussion in Christian ethics. Albert Schweitzer’s ethics of reverence for life is more complex and interesting than first appears. It contains themes relevant to contemporary environmental ethics, including a virtue-ethics approach that emphasizes personal responsibility and tolerance, empathy for living organisms, and the fundamental unity of life. Not surprising, then, Schweitzer has recently been acknowledged for pioneering a biocentric (life-centered) ethical theory.

At the same time, Schweitzer’s ethic has four unpalatable features: pantheism, anthropomorphism, excessive subjectivity, and guilt mongering. I trace these features to the metaphysical framework in which Schweitzer develops his ideal of reverence for life. I also show how the framework can …

Leopold's call stemmed from his concern over the increasing degradation of the environment as a result of a utilitarian approach which judges nature as good only insofar as it is good for human economic and recreational benefit. This paper approaches this ancient problem by incorporating the new science of chaos. Chaos is the name given to the discovery that even "simple deterministic systems with only a few elements can generate random behavior" {Crutchfield et al., 46). Chaos shows that deterministic systems can act in ways which are not predictable while at the same time showing that many seemingly random phenomena are more explainable than once thought. At its annual conference the Australian Division of the Australasian Association of Philosophy marked the occasion with a symposium on claims by Aboriginal p_eople for compensation arising out of that settlement. This study asked the question: What are the effects of an inservice on classroom modifications for secondary learning disabled students on the teaching practice of four highly able teachers? A secondary question asked was: To what extent are teachers‘ behavior and attitudes affected by follow-up consultation? The participants were four secondary regular classroom teachers representing four curricula areas (English, social studies, health, and biology). All four had been recognized as having the ability to work well with learning disabled students. Genius And Monologue, Ken Frieden

Books

"Genius is the intellectual obsession of our time," Ken Frieden writes, "and monologue is one symptom of the disorder." From ancient, spiritual conceptions of genius to modern notions of the extraordinary mind, Frieden traces associated philosophic and literary expressions of inspiration and individuality.

Frieden juxtaposes the evolving forms of genius with traditions of monologue in pre-Shakespearean and Shakespearean drama, Romantic poetry, and nineteenthand twentieth-century fiction. He delineates the linguistic mechanisms that have shaped the dominant ideology of genius, showing that while literary monologues typically break the conventions of dialogue, aethetics ultimately identifies originality with deviance and madness. Despite the familiar and correct disclaimer that information theory (Shannon and Weaver, 1949) does not concern the semantic level of communication, the technical definition of information nonetheless bears directly and importantly on the subject of meaning. Meaning, at least in one sense of the word, is the recognition of constraint and is based on isomorphism of structure. Constraint reduces information yet information is also the very substrate of meaning. Meaning is thus the union of the informative and the intelligible (Moles, 1958), the reconciliation of this dialectical opposition being achievable in several different ways.

This chapter identifies the results of Kant's philosophical system on the contemporary discussion concerning an inerrant revelation. Knowledge, for Kant, is possible only as the forms and categories of the mind organize the raw data of the senses. Beyond this phenomenal world, the mind can only postulate what must or ought to be. It cannot know what is. The first postulate of this practical reasoning is freedom. The individual is autonomous, knows the good, and is capable of willing and doing as he ought.

Within such an epistemological framework, revelation becomes unnecessary, useless, and unverifiable. Inerrancy is not only false …
