Substance, Process And Outcome In Constitutional Theory, David B. Lyons May 1987

Substance, Process And Outcome In Constitutional Theory, David B. Lyons

Faculty Scholarship

Scholarship in philosophy proceeds at a slower pace than in the law. As Tom Lehrer, the poet laureate of a recent generation, might have said, the law biz travels on a faster track. Or so it seems to a philosopher who has recently been treading the tracks of constitutional lawyers.

And so it is with apprehension that I take as my text a book that was published as long ago as 1980. As the title of this lecture might suggest to someone with so long a memory, the book is John Hart Ely's Democracy and Distrust.' That work provoked an …

The Legal Ethics Of Radical Individualism, Thomas L. Shaffer Jan 1987

The Legal Ethics Of Radical Individualism, Thomas L. Shaffer

Journal Articles

Most of what American lawyers and law professors call legal ethics is not ethics. Legal ethics has come to be rules that appeal to sanction, and not the lawyer’s conscience. This Article analyzes the ethical quandary arising from modern ethics, and presents an assessment of the ethics of radical individualism in terms of the religious tradition’s influence on legal ethics.

Church-State Relations And Religious Convictions, Kent Greenawalt Jan 1987

Church-State Relations And Religious Convictions, Kent Greenawalt

Faculty Scholarship

Since the title of my talk is hardly self-explanatory, I want to begin by outlining my topic. My overall concern is with the proper place of religious convictions in lawmaking in our society. My special focus is on the place of religious convictions in the political resolution of churchstate issues.

The Connection Between Law And Morality: Comments On Dworkin, David B. Lyons Jan 1986

The Connection Between Law And Morality: Comments On Dworkin, David B. Lyons

Faculty Scholarship

Our discussions yesterday seemed haunted by a contrast--never quite formulated--between Natural Law and Legal Positivism. The standard interpretation turns on the idea of a "necessary connection" between law and morality. Positivism has often been understood to hold, and Natural Law to deny, that there can be unjust laws.

Justification And Judicial Responsibility, David B. Lyons Mar 1984

Justification And Judicial Responsibility, David B. Lyons

Faculty Scholarship

These Centenary Lectures are devoted to the "tension between rule and policy" in adjudication. The charge to the lecturers suggests it is "naive" to suppose that "the proper function of a court is to apply an established rule of law to the dispute before it." This topic has been a focus of legal theory at least since Holmes delivered his famous lecture, "The Path of the Law"--nearly as long as law has been taught at the University of California. It merits our continuing study.

Legal Theory And The Problem Of Definition, Philip E. Soper Jan 1983

Legal Theory And The Problem Of Definition, Philip E. Soper

Reviews

Natural Law and Natural Rights is a refreshingly direct book about some decidedly difficult matters. It is also a book that refuses to do homage to the complexity of its subject by limiting the topics covered. Here is virtually a mini-treatise in moral philosophy, with illuminating discussions on the whole range of human value and on a good part of the related range of metaethics, legal theory, political theory, and the problems of methodology in the descriptive social sciences.
