Daniel Webster warned Whig associates in 1841 that the Supreme Court would likely declare unconstitutional the national bank bill that Henry Clay was pushing through the Congress. This claim was probably based on inside information. Webster was a close association of Justice Joseph Story. The justices at this time frequently leaked word to their political allies of judicial sentiments on the issues of the day. Even if Webster lacked first-hand knowledge of how the Taney Court would probably rule in a case raising the constitutionality of the national bank, the personnel on that tribunal provided strong grounds for Whig pessimism. …

M’Culloch v. Maryland is rightly regarded as a landmark opinion, one that affirmed the ability of Congress to exercise implied powers, articulated a rule of deference to Congressional judgments about whether given legislative actions were in fact “necessary,” and limited the ability of the states to impair or restrict the operations of the federal government. Most scholarly discussions of the case and its legacy emphasize these aspects of the decision. Less common are attempts to place M’Culloch within the ebb and flow of the Marshall Court and the political and social realities of the time. So, for example, very few …

March 6, 2019 marked the 200th anniversary of the Supreme Court’s issuance of its decision in McCulloch v. Maryland, upholding the constitutionality of the Second Bank of the United States, the successor to Alexander Hamilton’s national bank. McCulloch v. Maryland involved a constitutional challenge by the Second Bank of the United States to a Maryland tax on the banknotes issued by the Bank’s Baltimore branch. The tax was probably designed to raise the Second Bank’s cost of issuing loans and thereby disadvantage it relative to Maryland’s own state-chartered banks. Marshall’s opinion famously rejected the Jeffersonian strict-constructionist argument that implied powers …

A century ago, on May 21, 1919, the US House of Representatives voted difinitively (304 to 89) in support of women’s suffrage. Two weeks later, Wisconsinite Belle La Follette sat in the visitors’ gallery of the US Senate chamber. She “shed a few tears” when it was announced that, by a vote of 56 to 25, the US Senate also approved the Nineteenth Amendment, sending it on to the states for ratification.1 For Belle La Follette, this thrilling victory was the culmination of a decades-long fight. The im(migration) and refugee crisis that are being exacerbated under the Trump administration, is a manifestation of empire-building and the long history of colonization of the Global South. A Marxist-humanist perspective recognizes these as consistent aspects of a clearly racist global capitalism that functions in the interest of multibillion dollar U.S.–based corporations and increasingly transnational corporations. Trade agreements, international economic policy, political intervention, invasion or the threat of these, often secure corporate interests in specific countries and regions. The authors use critical discourse analysis to examine the discourses around Mexican, Central American, and Syrian im(migrants) and refugees as examples of …

This thesis is a comprehensive interpretation of European political history in the periodization from 2008 to 2016. The history begins with an exploration of the intellectual and political origins of the post-World War II project of European integration and the development of, and opposition to, the early institutions that eventually formed the contemporary assemblage of the European Union. The Cold War in Latin America had marked consequences for the region’s political and economic evolution. From the origins of US fears of Latin American Communism in the early 20th century to the collapse of the Soviet Union in the early 1990s, regional actors played central roles in the drama. Seeking to maximize economic benefit while maintaining independence with regard to foreign policy, Latin Americans employed an eclectic combination of liberal and anti-imperialist discourses, balancing frequent calls for anti-Communist hemispheric unity with periodic diplomatic entreaties to the Soviet bloc and the nonaligned Third World. This presentation will elaborate how tribal community leaders originally envisioned utilizing gaming revenues to fund cultural investments such as language retention or elders’ programs, and whether they and their fellow community members assigned cultural investments a greater value than economic investments (e.g., infrastructure such as paved roads). Preliminary research suggests that leaders seeking casino or gaming site construction commonly identified cultural investments as an essential element of community development initiatives, and that they could be considered unique from and complementary to economic development initiatives. Louisiana developed an extensive system of levees throughout the Atchafalaya Basin and along its territorial Mississippi River. This system reached its zenith on the eve of the American Civil War. It went into dramatic decline following the conflict due to the confluence of military activity, protracted irregular warfare, and neglect stemming from labor and capital revolution. These shifts intensified with the 1863 Emancipation Proclamation and finally consolidated after the ratification of Louisiana’s Constitution of 1879. During the course of the 18th and 19th centuries the British Navy took an age old method of manipulating and dominating an enemy, the naval blockade, and perfected it. The blockade was going to be used by a generation of admirals, captains, and crews in a way that would cause pain, financially, physically and psychologically, on a large swath of the western world, much of it specifically centered on ensuring that Napoleon and his aggressively expansionist France would pay too dear a price if they tried to move off of the European mainland. Historically, political parties have constructed systems to target voters and win elections. Since the end of the Second World War, scholars and experts have examined the use of cinema in spreading totalitarian propaganda. Nazi Germany, in particular, has caught the most attention. However, most of these studies focus exclusively on one nation, and relatively few studies have tried to directly compare the cinematic propaganda of different countries. This study aims to directly compare cinematic propaganda of Stalinist-era Russia and Nazi Germany and find out who utilized the medium of film more effectively. The U.S. intervention in El Salvador had a number of unintended consequences, some negative and some positive, that still have a great impact on the U.S., El Salvador, and the international community as a whole today. Although the focus of the mass media is on the negative unintended consequences, the positive really outweigh the negative. This paper offers a comprehensive political history of the Rhode Island Earned Income Tax Credit (EITC) and an analysis of Rhode Island EITC recipients. It explores the history of the Rhode Island EITC, an income subsidy available to low-income workers, from its introduction in 1975 through 2018. It details the forces behind expansions and reforms and the effects of those changes. It also analyzes microdata to construct a profile of current EITC recipients. This paper concludes that the Rhode Island EITC has historically been viewed as both a poverty alleviation program and an incentive for labor market work. The Rhode …

This thesis examines cosmopolitan democracy theory as a method of addressing the problems of globalization. I begin by introducing the concept of “cosmopolitan democracy.” I then proceed to discuss contemporary political climate and its relation to critiques of globalization. Finally, I conclude by examining the elaborations of cosmopolitan democracy by various theorists as a way of addressing these problems. Chapter 1 introduces the work of David Held who introduced the concept in his book, Cosmopolitan Democracy and the Global Order: Reflections on the 20th Anniversary of Kant’s “Perpetual Peace.” Cosmopolitan democracy refers to global governance through democratic theory. In 1927, the Farmers’ Federation agricultural cooperative in Western North Carolina launched an organization to solicit funds from wealthy donors. The money raised through philanthropic campaigns enabled the cooperative to fund large-scale agricultural projects, which helped members navigate the dramatic agricultural transformations of the early twentieth century. Although the cooperative advocated a progressive program of business-minded, scientific farming, its leadership modified programs to reflect farmer members’ limited resources and the realities of mountain production. As a result, the co-op provided a crucial bridge between white farmers and new methods of agricultural production that reached deep into peoples’ familial and productive …

Oral argument scholars like Adam Feldman have categorized the Supreme Court justices’ behavior during oral argument using the approach-based method, labeling each as one-sided, even-handed, or restrained. This approach is too narrowly constructed. Scholars sometimes categorize justices in terms of the tools they use, which include questions, hypotheticals, declarations, interruptions, tone of voice, and silence (Feldman 2018a). Neither of these methods alone produce a nuanced analysis of each justice’s actions during an individual case or across a Term. Statutes governing preservation of presidential records must be adapted to accommodate presidents’ evolving use of social media accounts. The Freedom of Information Act is meant to promote government transparency, and subjects governmental agencies to information requests from members of the public. However, as it relates to social media records, the problem is one of volume; are the means of preservation currently in place able to adequately address the vast amount of records created by a President’s use of social media? Apartheid South Africa represented a paradox as a US ally and human rights pariah. “Genocide Masquerading” uncovers the implications of US foreign policy on the rise and decline of apartheid, looking specifically at the 1960 Sharpeville Massacre and the 1976 Soweto Uprising. By comparing Presidents Eisenhower, Kennedy, Ford, and Carter foreign policy responses, this thesis creates a comparative analysis of how effective, or ineffective, the United States was during pivotal moments in apartheid history. This thesis will not only expand on the developing South African literature but add to the conversation of international aid, diplomacy practices, and North-South relationships.

In countless speeches and articles in La Follette’s Magazine, Belle Case La Follette urged that women needed the vote to secure “standards of cleanliness and healthfulness in the municipal home,” and because “home, society, and government are best when men and women keep together intellectually and spiritually.” This range of often mutually exclusive arguments created an inclusive big tent. The article is an examination of the persons and trials of Soghomon Tehlirian and Sholem Schwartzbard, their political assassinations as acts of vengeance for genocide and pogroms, their trials and subsequent acquittals. It is also an examination of the influences of these two events on the evolved thinking of Raphael Lemkin on his conceptualization of the needs for an international law contra genocide. Finally, it also elaborates on what information is now available on both men and their associations, and what was known and unknown to Lemkin and whether or not these two cases remained centrally important to his understandings.

The Custom and Border Protection (CBP) border security policy was explicitly presented by former Acting Commissioner of CBP, David Aguilar, in testimony before the United States Senate Homeland Security and Governmental Affairs Committee (HSGAC) on April 4, 2017 in testimony on the subject of “Fencing Along the Southwest Border.” Important for discussion here are the key components of the DHS/CBP/Border Patrol’s strategy, or sets of policies, laying forth elements of the border walls (including barriers, fences), personnel, and technology in order to hinder, or intercept, undocumented migrants (homo sacer) from entering the United States illegally—all socially constructed.
