A Painful Case: The Wright-Sanborn Incident In Norfolk, Virginia July-October, 1863, Ervin Leon Jordan Jr.

The purpose of this paper is to study the political and legal implications of the shooting of a Union officer, 2nd Lieutenant Alanson C. Sanborn, by Dr. David Minton Wright, a Norfolk physician, on July 11, 1863 in that city. Dr. Wright, who was tried and found guilty by a military commission, appealed his conviction to President Abraham Lincoln, who denied it. The author, with the use of primary and secondary sources, raises the issue of several problems encountered by Americans during the Civil War such as civil liberties, the role of Negro troops, and the problems of administration of …

Samuel L. Southard And The Origins Of Gibbons V. Ogden, Michael J. Birkner

On January 12, 1815, the former Federalist governor of New Jersey, Aaron Ogden, wrote a brief letter to a young political antagonist, Samuel L. Southard, requesting Southard's "professional aid in a hearing before the Legislature, which I expect will take place on Tuesday next." Observing that he had the relevant documents organized so that Southard could get quickly acquainted with the facts of the matter at issue, Ogden added that "the cause will be entertaining and interesting, and as to compensation, you will please to name your own sum."

The Body Of John Merryman: Ex Parte Merryman, A Case Of Executive-Judicial Conflict Over The Suspension Of Habeas Corpus, Eric Paul Anderson

At the outbreak of the Civil War the Federal military arrested certain people whose loyalty was suspect. One victim, John Merryman, attempted to free himself by petitioning for a writ of habeas corpus. However, President Lincoln authorized the military to suspend the writ in such cases. The matter came before Chief Justice Taney who disputed the president's authority to suspend the writ and ruled in Merryman's favor. This thesis recounts the history of the habeas corpus process in Anglo-American law and its inclusion in the Constitution, Merryman's role in the first hostilities, his arrest, and the attempt to free him. …

The Evolution Of Child Labor Legislation In Illinois: 1818-1917, Frank Edward Storment

"The Evolution of Child Labor Legislation in Illinois, 1818-1917" traces the development of social, economic, and political attitudes towards child labor in the State of Illinois. These attitudes evolved from a general acceptance of working children as part of the socio-economic structure to the realization that the industrial employment was causing a moral, social, and economic degeneration of American life. These changing attitudes were reflected in the legislation passed by the Illinois General Assembly between 1818 and 1917.
Between 1818 and 1874 most legislation offered token protection to the child, but emphasized the moral well-being rather than the physical and …
